E : /00 ':1" ' i GcaL£ : lO0'=/" ,.:q gq ~3 A c t< · ' (5~)- (5/1/67) Permd No. 8150 PERMIT UNDER SECTION ]3& of ARTICLE VI of HIGHWAY LAW Whereas Section 136 of Article VI of the Highway Law provides: "No street surface or other railroad shah be constructed upon any portion of a road constructed or Improved on a county road system, nor shall any person, firm. corporation or municipality enter upon or construct any works in or upon such road, or construct any overhead or underground crossing thereof, or lay or maintain therein drainage sewer or water pipes underground except under such conditions and regulations as may be prescribed by the county super- intendent, notwithstanding any consent or franchise granted by any town or by the municipal authorities of any village or town. Any municipal cot oration may enter upon any road constructed or improved on a county road system for the purpose of widening the pavement or ~r any other purpose authorized by this section, but only after securing a permit as provided herein. Notwithstanding the limitations in any general or special law every municipal corporation shah have and is hereby given authority to depos t w th the county superintendent such a sum of money as may be required by the county superintendent as a condition precedent to the granting of the permit provided in this section. Any person, firm, or corporation violating this section shall be liable to a fine of not less than one hundred dollars nor more than one thousand donuts for each day of such violation, to be recovered by the county superUUendent and paid in to the county treasu~ to the credit of the county road fund created under section 117 of Article VI, of this chapter for the · construction, reconstruction and maintenance of county roads on the county road system in accordance with the provisions of said Section 117 of Article VI. and may also be removed therefrom as a trespasser by the county superintendent upon petition to the county court of the county or to the supreme court of the State, and WHEREAS, a certain highway known as the Hiddle Road CR No. has been improved and is on the Suffolk County Road System and requests permission to build res/dent/al e~pha.ltie driveway aee~ ~om new ~e~tdenee to Co.~d, 27 on n/s Htddle ~oad, C.R.27, 950±s ~/o~ Hoore% L~ne~ Hamle~ of G~eenport,T~ as per sketch or map attached. CO~IG, IN to do said work upon the following conditions: CONDITIONS AND RESTRICTIONS 1, When concrete is removed, cut concrete with concrete saw two feet outside the limits of the proposed excavation and for the full panel width. When the cut is mode in pavement wltlfin 10 feet of the panel joint, the pavmnent shall be removed for full panel width from the cut on the far side of the excavation to the p~nel joint. 2. Backfill ~nd thoroughly compact fill using POWER TAMPER, placing soils so that orlglnal surface. 1:1~ :3~ ~nix stone mix concrete; if bituminons nmterial, replace using same type 4. If concrete curb is removed, replace with similar curb 1:1 ~ :~ ~/z nflx. 5. Edge of Jacking Pits or a~y other excavation shah be not less than 5 feet from Edge of Pavement. No undercutting ~llowed in Pit. 6. Notify the Department at Yaph~nk 4-3451 when the work is to begin so that ~n inspection can be made of the operation. This permit shall not be assigned or transferred without the written consent of the Commissioner of Public Works. The work authorized by this permit shall be perfonned under the supervision and to the satlsfacfflon of the Com- missioner of Public Works or his representative. Particular attention is called to the necessity of thoroughly c(ympocting the back fill, which will be required by the Commissioner of Public Works. The ,Commissioner of Public Works shall be given one week's notice by said applicant of the date when it tends to begin the work authorized by this pe~anit, and prompt notice of its completion. The said applicant hereby agrees to hold the State, County and Town harmless on account of damages of any kind which may arise during the progress of the work authorized by this permit or by reason thereof. Applicant certifies all persons concerned ~vith actual work under this permit are duly covered by Workmen's Com- pensation Insurance and the State, County and Town shaIl be held harmless on account thereof. The Commissioner of Public Works reserves the right to at any time revoke or annul this permit should the said applicant fail to comply with the terms and conditions upon which it is granted. The applicant agrees to pay all necessary expenses incident to supervision and inspection by reason of the granting of such permit as certified by the Commissioner of Public Works, such payment to be made within ten days from the rendering of the certified account. Work under this permit to be commenced within thirty days from the date of permit and continued in an expeditious marmer. The applicant shah submit a detailed plan of structure to be built, with a description of proposed method of construction. It is understood that should future changes in the alignment or grade of the highway require changes in the work covered by this application and permit, the applicant shall on reasonable notice from the ,Commissioner of Public Works make such necessary changes at his own expense within the time so specified in notice.
