The owners of 35 Bayview Ave are in the process of selling their house as a year round
dwelling. There is however one indication in the building departments records dating back to
1995 classifying the residence as a seasonal dwelling.
My research of all documents that were made available to me show the following interactions
with the building department since 1959:
• Certificate of Occupancy (Z-378) dated August 17, 1959 was issued for a private one
family dwelling;
• Pre existing Certificate of Occupancy (Z-23822) dated August 17, 1995 was issued for
a one family SEASONAL dwelling with an asterix refering to an engineer's report;
• Building Permit 24017-Z was issued March 31, 1997 for a utility room addition;
Records show that the final inspection passed (OK for CO) in August 12, 1997;
The field inspection report states that the insulation inspection passed per NYS
Energy Code; There is no record that the CO was actually issued.
• Certificate of Occupancy (Z-26059) dated October 23, 1998 was issued for a one
family dwelling to add a new utility room and a wood deck. There is no mention of a
seasonal one family dwelling. Photos that were submitted by the current owners
show insulation in the attic and exterior walls.
Results of my research show that the cottages along Ruch Lane and Bayview Avenue were
constructed as summer colonies I believe in the 1930's. Over the years they all have been
upgraded and expanded into year round homes. Local builders would have applied current
building codes at that time.
I recently inspected 35 Bayview and found the house fully insulated including the crawl
space. Each room is equipped with baseboard heaters.
I hereb issue the statement that - to the best of my professional knowledge - this house is

Dear Mike,
I was present when the inspection of the above referenced dwelling was conducted by the
building inspector John Jarski on March 23, 2021.
The basis of this application is to convert a pre-existing seasonal dwelling to a single family
dwelling in circa 1999 (260W to 210W).
According to John the insulation appears to meet the code for the time in which it was done.
Photos show insulation in ceiling and filled stud wall cavities, R-3 per inch of batt insulation.
Attached with this letter please find the permit application and the specifications of the gas
boiler that was installed after 1997 when Permit#24017-Z was issued for the addition of a
utility room and a hot water heater.
1 hope this clarifies the classification of the dwelling as a 210 single family dwelling.
