Pursuant to § 280-11 the Applicant has submitted documentation, to the satisfaction of the Board that these lots were merged prior to the death of the owners. At the onset, it is necessary'for this Board to determine whether the Applicant has provided evidence of an appropriate relationship with the prior owner, Betty R. Deroski. Section 280-11 requires that"[t]he lot proposed to be recognized has not been transferred to an unrelated person or entity since the time the merger was effected". One of the neighbors informed the Board that people were living in an existing barn, and that trucks belonging to the owners of a Brooklyn based company are coming and going from the property. The neighbor further expressed concerns about safety for residents and neighborhood children. Photographs, along with comments,were submitted by a neighbor opposing the variance relief. Another neighbor testified that another garage on the property is not consistent with the character of the neighborhood, and referenced ZBA#6859 which allowed the construction of a one story structure as two car garage with attached storage that is now a three car garage. The applicant's representative stated that the Building Department has cited the applicant for using a barn for habitable space. He indicated that the owner collects cars and wants another garage in which to store his collection of cars, and further explained that the dwelling is shared with another couple who are not listed on the property deed. All of the other properties in Eugene Heights are smaller with smaller homes with no more than one accessory building Iocated on the property. First and foremost, I need to point out that the survey updated 1/29/21 does not reflect the current conditions of the property. Over the past few months, an additional wood shed was built on the property and is placed around the "lot 101" location on the survey. I believe this shed is over the size needed for a variance. In addition this is the sixth structure on the property. I also want to point out that Mr Pfanner does not reside on the property. Although he is named as one of the owners of the property, he actually resides at his residences in Brooklyn and Greenport. As for the "request of use" variance, Mr Pfanner HAD ALREADY illegally converted the second story of the existing accessory garage to living space several years ago. Septic, electric, a bathroom and internet was installed about 3 years ago and I believe was done without permits. The accessory "garage" (formally a barn) is being used as living space and people stay upstairs overnight periodically since converting. By converting legally to "office space", he's getting around formalizing a second residence on the property. And if he is actually going to create an office, the potential i increase of traffic on this ret idential street is not appropriat( area. The entrance on the Oak Street side is near a blind curve and causes a potential hazard. Finally, in deference to those of us that follow local laws and zoning codes, approving work that was originally done illegally sets a precedent for the rest of us. It would add the Change of Use for a non-resident office on the second floor and a commercial workshop on the first floor for SFA Interiors Inc that violates the R-40 Zone for single family residential use. An approval would also encourage the use of"as built" processes instead of the building codes provided by the township. Pfanner 7501 and 7502 ask for variances to make (a) alterations to an existing accessory garage, (b) convert it to an office/workshop for use in storage and processing of exotic woods, and (c) legalize the existing "as built" shed. This shed is shown in the 7501 and 7502 survey provided with the permit request and was not modified in the amendment.The shed is approximately 26 by 24 feet. The alterations requested are not clearly designated in the application and seem to indicate they are already part of the "as built" shed. In Pfanner 7501 and 7502, a variance request is added for an "as built" shed with dimensions of approximately 12.3 by 8.3 feet and the request for variances dropped for two (2) sheds, approximately 3x9 feet each, based on the functional approval by the Zoning Board of Appeals of on 6/8/2015. Pfanner 7501 primarily addresses the Variance for the 12.3 by 8.3 feet shed. Any request to legalize the shed (12.3 by 8.3 feet) might be difficult to explain as a Building Permit or as an As Built Building Permit since the shed is constructed as a kit and portable. The difficulty is self-inflicted and can be corrected easily by moving the portable structure into compliance on Lot 24.2 or use of the unit at the Mr Pfanner's residence in Greenport, NY. Use on Lot 24.2 might be considered near the added accessory structure south of the single-family structure at 2725 Harbor Lane and the patio under construction. 1 It is important to note in the ZBA determinations of 6/18/2015 (ZBA 6859), the functional variance for the two (2) woodsheds was based on an agreement by the applicant that when the woodsheds need to be removed or replaced, he would remove them or relocate them into compliance with the existing one-story barn/garage setback 28.1 feet from Oak Street shown on the 7501/7502 survey. Pfanner 7502 primarily addresses the one-story barn/garage referenced above in ZBA 6859. The accessory garage addressed in 7502 has been described in the permits and variance decisions as a "vacant non-habitable building" with certificate of occupancy in 1979, one story barn/garage" in 2015 (ZBA 6859), and a one story framed garage in 2018 (ZBA 7192). Substantial alterations to the one-story barn/garage are shown in the Pfanner 7501 and 7502 survey, plans, and photographs that change its use from a barn to a habitable two-story structure. Approval of the permit for alterations to an existing accessory garage and legalize an "as built existing shed" not only adds a floor to the structure but would allow the applicant to change its use in fundamental ways. Unnecessary hardship is not demonstrated by the applicant for any of the four (4) required tests. 1. Town Law 267- b(3)-b(1) Denying the use of the proposed use of the "barn" as an office or workshop does not create an unnecessary hardship. Mr Pfanner is not an on-site resident as stated by his attorney in ZBA 7192. Mr Pfanner could create an office environment within the single-family residences he owns or resides in at 250 Oak Street (just across from 275 Oak Street), 2725 Harbor Lane (lot 24.2), or 1240 Inlet Lane, Greenport. SFA Interiors is a CNC (computer numerical control) company and a workshop to develop its wood and metal products at 2725 Harbor Lane, Cutchogue, could be a liability to a cohabitating office in proximity to its wood or metal working tools. 2. Town Law 267- b(3)-b(2) "Multiple accessory structures" is not unique to the area but it is not clear that a hardship is created by having three accessory buildings. Mr Pfanner was denied a permit for a fourth accessory garage (ZBA 7192) for cars and the existing one-story barn/shed/frame garage could be used without variance for storage of cars or motorcycles. 3. Town Law 267- b(3)-b(3) The character of the neighborhood has been altered by the traffic to and from the proposed structure and has been noted by the residents (ZBA 7192). Use of the one-story shed/barn/framed garage was previously reported by neighbors (ZBA 7192) as a residence and for business purposes with the knowledge of the applicant. If approved as an office and workshop, the traffic can increase without the constraint of known occupancy. Mr Pfanner is CEO of SFA Interiors but he is not the Genral Manager or the Architect/Designer who might be users of an office cohabitating with a workshop. There is no way to limit the potential traffic to a non-resident business office and workshop so the character of the neighborhood will change as these activities increase. 4. Town Law 267- b(3)-b(4)The applicant must provide definition of the restrictive and non- inclusive zoning issues to be considered noted in his application. However, the one story shed/barn/frame garage has never been approved as two-story occupancy or for residential occupancy. The hardship must be self-created to try to establish a business office and workshop in an R-40 Single Family Zone. 5. Town Law 267- b(3)-b(5)The proposed uses will allow the applicant to send representatives as office or workshop employees to direct or operate CNC machines to create metal or wood products without regard to noise, dust, or smoke in a building created as a single-story garage. Lack of water and sanitary facilities have been noted but the existing use of the garage as an office and workshop make this limitation highly unlikely. 6. Town Law 267-b The spirit of the ordinance cannot be preserved by the very nature of this proposal. Every accessory structure on 24.2 has been subject to as-built attempts to modify without permit so the attempt to approve as-built construction with new design to change the physical structure from a 2 one-story garage to a two-story operation with a non-resident office on the second floor and a workshop for an existing corporation on the first floor cannot preserve the ordinance, protect the residents, or provide justice. Many inconsistencies are included in the Questionnaire for the ZBA (7502) application. a. The proximity of the applicant's property at 250 Oak Street is not shown on the survey with the corresponding proximity to East Creek (less than 250 feet). b. Construction of a patio is underway at 2725 Harbor Lane with no representation of accessory structure. c. Present use is residential with 3 garages according to ZBA decisions. A series of obvious discrepancies are noted in the Applicant's Project Description. The one-story barn/shed/framed garage is described as having two stories before alteration. This is not true based on the descriptions included in all of the ZBA actions and permits referenced in 7502 covering over two decades. The reference structure is a one-story barn/shed/framed garage. In the following Agricultural Data Statement and in the Short Environmental Statement, the description of the proposed project is to convert a barn into a first-floor workshop and second floor office. Responses to the Short Environmental Statement are incomplete and, in some cases, incorrect. East Creek is a Critical Environment Feature. It is continually monitored and tested based public access to shellfish. The SCWA installation along 2725 Harbor Lane and Oak Street was the result of critical assessments by the state of New York based on effluent from a business along State Highway 25 less than a mile from the location of 2725 Harbor Lane. Significant concessions were made to assist residents to move to public water. Public water is available on 24.2. To my knowledge, the applicant has not participated in the public water program. How is the proposed activity not a permitted activity under zoning regulations but consistent with an adopted comprehensive plan? Please ask the applicant or his attorney to provide a reference to the plan and a local source for review of the plan. Business activities result in increased traffic patterns not seen or realized in single family communities. No estimate of activity or lack of activity is provided with this change of use. Confessed lack of water usage from public or private water sources and lack of wastewater or sanitary management facilities at the barn is very confusing to the neighbors. SFA Interior employees have maintained residence at the barn for up to three days, a single male has been resident at different intervals for extended periods, and use of the facility by the applicant and his daughter was evident at a ZBA visit in 2018. To my knowledge, no portable sanitary facilities have been employed at the existing office and workshop described by the applicant in the permit application of January 7, 2021. Approval of the variance could establish the need for potable water and sanitary facilities not specified in the office or workshop designs but which seem to be available based on use since 2018. Proposed on site dry wells are referenced but not shown in the drawings. Is the plan presented for the shed accurate based on the architect's review of the structure? 3 SFA Interiors is a CNC company. VL'sworkshops use sophisticated machinery-co create wood and metal products. This usage change request will allow the company to discard its byproducts onsite which can include wood shavings and dust, metal filings, and the by-products of the equipment and materials used to dye, seal, stain, epoxy and glue the products.The request says they will burn the debris from woodworking. This is not an accepted use and the collection of dust and tailings addressed. Exotic woods is an unqualified description of the type of waste created by the workshop. Many hardwoods used to create these products are toxic. Anyone who has burned poison sumac, oak, or ivy knows the smoke can contain the oil from the plant and produce a rash. Certainly the dyes, sealers, glues, and epoxies and stains used in the process are not substances that melt into the ground and remain static. They will drain into East Creek. The applicant has several options to avoid change of zoning code, change of use, unspecified levels of traffic, occupancy, environmental debris, and business debris which will create a significant impact to a stable community. The one-story barn/shed/framed garage can be used as a garage for the applicant's automobile or motorcycles but the unapproved modifications would need to be removed. If the applicant wishes to continue to prepare the one-story structure for two-story residential use, he should consider separating the properties he proposed to be combined in 2014 and continue his approach to occupancy with an appropriate water supply and sanitary waste disposal.
