SAMUELS, TRUSTEE CREDIT SHELTER TRUST SCTM# 1000-111-1-8.4 Samuels & Steelman Architects on behalf of ANITA M. SAMUELS, TRUSTEE CREDIT SHELTER TRUST requests a Wetland Permit to repair existing 5'x18', 90sq.ft. ± lower dock, with stringers raised at north end, level with existing adjoining dock, using existing pilings; repair two wood steps from basin wharf to dock, with handrails between upper and lower decked areas; existing 96 linear foot bulkhead, including pilings, stringers and deadmen to remain; replace 518 square feet of existing wharf decking on existing structure, in-kind with 2x6 treaded wood boards around basin; and there is to be no excavations nor filling of property. Located: 155 Fisherman's Beach Road, Cutchogue. SCTM# 1000-111-1-8.4 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the Policy Standards and therefore is INCONSISTENT with the LWRP based upon: 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The as-built structures were constructed without a Wetland Permit. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
