Located: 8570 Nassau Point Road (aka 350 Aborn Lane), Cutchogue. SCTM# 1000- 118-5-5 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the LWRP policies and therefore CONSISTENT with the LWRP. This recommendation is made in consideration of Wetland Permit 4084 issued in 1992. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listing both supporting and non- supporting facts. If an action cannot be certified as consistent with the LWRP standards and conditions, it shall not be undertaken. See LWRP,Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes ❑ No ❑ Not Applicable LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR HEATH CHRISTOPHER GRAY& MOLLY MARIE RHODES 350 ABORN LANE (aka 8570 NASSAU POINT ROAD) CUTCHOGUE,NY SCTM#1000-118-5-5 Policy 6 The project consists of the modification of an existing,Town-permitted dock(Wetlands Permit 4084), specifically the replacement of an existing ramp and shore-parallel float with a longer ramp and shore-perpendicular float over the open waterway at the seaward end of the existing fixed catwalk to remain. As modified,the existing floating dock,which is resting in insufficient water depth pursuant to Town Trustee and NYSDEC policies,would be replaced by a float situated in water at least 30 inches deep at mean low water. And the dock, which is situated between two contiguous docks, would maintain the same separation distance from those docks and would extend no farther seaward than the existing pier line established by the two docks. The proposed dock modification would thus be consistent in all ways with the "construction and operation standards" for docks set forth by Town Code Section 275-11(C)(2)and would not have any adverse impacts on existing navigational conditions or otherwise affect the public and recreational use of the navigable waterway; create any "fragmentation of ecological communities;"or result in the physical loss, degradation, or functional loss of ecological components, or otherwise adversely impact the adjacent vegetated tidal wetlands or surface waters.
