Main Rd. &Youngs Ave.) Southold, NY 11971 G • Q Telephone: 631 765-1938 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To* Glenn Goldsmith, President Town of Southold Board of Trustees From: Mark Terry, AICP LWRP Coordinator Date: December 9, 2020 Re: LWRP Coastal Consistency Review of NORTH FORK REALTY HOLDINGS, LLC SCTM# 1000-88-5-65 Jeffrey Patanjo on behalf of,NORTH FORK REALTY HOLDINGS, LLC requests1a,Wetlan0 Permit to remove and replace 104 linear feet of existing timber bulkhead with new vinyl bulkhead; and to install and perpetually maintain a 10'wide non-turf buffer along the landward edge of the bulkhead. Located: 1095 Watersedge Way, Southold. SCTM# 1000-88-5-65 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the Policy Standards and therefore is INCONSISTENT with the LWRP based upon: 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and' regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. A Wetland Permit for the bulkhead was not located within Town records. To further Policy 6, it is recommended that the vegetation that occurs landward of the bulkhead be preserved in a vegetated buffer. Instructions to the contractor should be given to minimize disturbance and the replanting of disturbed areas should be required. A non-turf buffer with no vegetation does not provide erosion control, nutrient filtration or wave attenuation during storm events. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
