Such precautions may include maintaining adequate work area . 2 between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. No change is proposed to the existing pool, which is considered an accessory structure. The proposed addition consists of a 2 story structure extending the house by 18' wide x 30' long other than an area variance, because: while proposed extension is of the same character as the exist house, it will change a part of the backyard where part of the exist pool is located into a side-yard. Since accessory structures are not allowed in side-yards, a variance is now needed to allow for the existing pool to be partially located in the new side yard. 3.The amount of relief requested is not substantial because: the proposed extension will not alter the use, floor area, height or lot coverage in a substantial way. The extension will comply with all requirements lot setbacks . 4.The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: the proposed extension doesn't have an environmental impact and complies with all requirements and setbacks from wetlands. 5.Has the alleged difficulty been self-created? { }Yes,or{J}No Why: The change in name designation of the yard with the proposed extension creates a conflict with the exist. pool, causing a conflict btw both structures. However, the use of the yard will remain the same and setbacks upheld. There is no feasible alternative to accomplish this extension without this conflict.
