The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program(LWRP)Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed solar panels located in other than the code required rear yard is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP. The"as built"six foot high fence is recommended as INCONSISTENT with"Policy 1. Foster a pattern of development in the Town of Southold that enhances community character,preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development" and the LWRP. The fence was installed without proper review. Pursuant to Chapter 268,the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. The Applicant would like to maintain the fence for privacy as the other homeowners along the flag enjoy a right of way for access to the beach along Long Island Sound. 2)A variance from the 60 foot front yard setback requirement of Town Code Section 280-15 to permit the construction of an accessory ground mounted solar panel array 34 feet from the property line. For the following reasons, the Applicant submits that variances from Sections 280-15 and 280-105(A) are warranted: 1. An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: The subject property is a flag lot with frontage on Long Island Sound that is significantly screened on its south, east and west sides by landscaping. The portion of the existing 6-foot fence that lies in the front yard is not visible from Route 25. The proposed solar array will likewise be screened from view by any adjacent property owner by the existing fence and landscaping. 2. The benefit sought by the Applicant CANNdT be achieved by some feasible method for the applicant to pursue other than an area variance, because: The Applicant has a pool in his yard. The neighboring homeowners to the south have a right of way for beach access. The 6 -foot fence is,re_quired for privacy and cannot be maintained without a variance. The placement`of the solar array in the front yard is necessary to maximize exposure and efficacy. It is the only fegsible location and as such, variance relief is required. 3. The amount of requested relief is not substantial because: The Applicant submits that the relief sought is not substantial in light of the location of the fence in relation to the surrounding properties. Similarly, while the 26 foot variance may be mathematically substantial, the relief is not practically substantial here in light of the configuration of the flag lot and ample screening. 4. The variance will NOT have an adverse impact on the physical or environmental conditions in the neighborhood or district because: As stated previously, the fence will only be visible to the applicant and neighbors accessing the beach. The solar array will also be essentially invisible to neighbors and further screened by the as-built fence. There is no perceivable environmental impact from either structure and solar generation will obviously have a positive impact on environmental conditions.
