MAUREEN BENIC#7389 -Request for a Variance from Article III, Section 280-15 and the Building Inspector's November 21, 2019 Notice of Disapproval based on an application for a permit to legalize an"as-built" accessory pergola; at 1) located in other than the code required rear yard; located at: 375 North Parish Drive, (Adj. to Southold Bay) Southold,NY. SCTM No. 1000-71-1-4. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program(LWRP)Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, the proposal is recommended as INCONSISTENT with the below LWRP policies. Policy 1. Foster a pattern of development in the Town of Southold that enhances community, character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. The as-built Pergola is not supported and in conflict with the purpose of zoning regulations and the bulk schedule. Therefore, this policy is not met. Policy 4 Minimize loss of life, structures, and natural resources from flooding and erosion. The as-built Pergola is located within a FEMA VE(Velocity Hazard) flood zone. The risk of loss of structures from waves and wind during storms(Hurricanes) is moderate to high. The proposed action does not meet this policy. Pursuant to Chapter 268,the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
