USAN AMBROSIO #7415 — Request for Variances from Article III, Section 280-15 and the Building
�aspector's February 21, 2020, Amended July 22, 2020 Notice of Disapproval based on an application to
construct an accessory garage and two accessory sheds; at 1) accessory garage located in other than the code
required rear yard; 2) accessory shed located in other than the rear yard; 3) accessory shed located less than the
code required front yard setback of 50 feet; located at: 1940 Mason Drive, (Adj. to Broadwaters Cove)
Cutchogue, NY. SCTM No. 1000-104-7-16.1.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold
Town Code and the Local Waterfront Revitalization Program (LWRP)Policy Standards. Based upon the
information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the
records available to me,the proposal is recommended as CONSISTENT with the below LWRP.
This recommendation was based upon the following:
1. The Board of Trustees issued a Wetlands Permit in 9379 which included a I00'wide non-disturbance
buffer.
2. The majority of parcel area is wetland which limits the buildable area.
3. The entire parcel is located within mapped FEMA Flood Zone AE. There is not ability to re-locate the
structures to outside of the flood zone.
Pursuant to Chapter 268,the Southold Town Zoning Board of Appeals shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

The proposed accessory buildings on this conforming 62,613 square foot lot (29,943
upland area) in the Residential R-40 District is not permitted pursuant to Article III
Section 280-15, which states; "accessory buildings and structures shall be located in the
required rear yard, or in the case of a waterfront parcel, accessory buildings and
structures may be located in the front yard, provided that such buildings and structures
meet the front yard principal setback requirements as set forth by this Code and the side
yard setback requirements for accessory buildings in Subsection B above."
The accessory garage is partially located in the side yard. The northerly 8'x12'-and
8'x10' sheds require a 50 foot front yard setback and the survey shows the front
setback at 31 feet and±46 feet, respectively. The southerly 8'x12' shed is located in the
side yard.

Meeting held on Wednesday, November 13, 2019:
WHEREAS, SCOTT & SUSAN AMBROSIO applied to the Southold Town Trustees for
an Amendment to Wetland Permit#9379 under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated October 4, 2019, and,

Wetland 4Permit#9379 to demolish existing dwelling and foundation and construct new
20' landward; construct a 40' wide by 34' deep foundation with elevations to remain as
previousCy approved; construct a 40' wide by 34' deep two-story dwelling with a 40' wide
by 6' 9 12 deep front porch with roof to be 42'8" wide by 8'-11 '/" deep with approved
eaves on the east and west side of the house; demolish and remove existing seaward
side concrete patio; construct a new 36'-9 %" wide by 22' deep elevated framed deck
with 8' wide stairs attached to back and a 4' wide stairs on the west side of the deck
adjacentito the newly located house; install gravel under footprint of deck; construct a
39'9 %" wide by 13'4" deep patio roof; reconfigure existing driveway, add cobblestone
apron and sides and paver walkway from driveway to dwelling; install a 1,000 gallon
propane tank; eliminate one plastic shed and install one (1) 8'x10' shed for a total of two
(2) existing 8'x12' and one (1) 8'x10' plastic sheds; and to relocate and reconfigure
OWATS �ystem and grade to allow for new landward location; and as depicted on
survey prepared by Nathan Taft Corwin, III Land Surveyor, received on October 1,
2019, and stamped approved on November 13, 2019.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area(which includes all of Southold Town).
3. If any question in Section C on this form is answered "yes",then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable with the LWRP policy
standards and conditions. If an action cannot be certified as consistent with the LWRP policy
standards and conditions, it shall not be undertaken.
