The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP)Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me,the proposed lot coverage variance is recommended as INCONSISTENT with the below LWRP policies. Policy 1. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. The proposed action is located with the Residential 40 low density zoning district: The purpose of the Low-Density Residential R-40 District is to provide areas for residential development where existing neighborhood characteristics, water supply and environmental conditions permit full development densities of approximately one dwelling per acre and where open space and agricultural preservation are not predominate objectives. The lot coverage variance, if approved,would set precedent and reinforce a traditional land use pattern that is not supported by the purpose of zoning regulations and the bulk schedule. The proposed action does not enhance community character. Therefore,this policy is not met. The proposed shed setback variance is recommended as EXEMPT from LWRP review pursuant to: § 268-3. Definitions. MINOR ACTIONS item"F"which states: F. Granting of individual setback, lot line and lot area variances, except in relation to a regulated natural feature or a bulkhead or other shoreline defense structure or any activity within the CEHA. Pursuant to Chapter 268,the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. The lot is a long lot leading from Jackson Street to Peconic Bay. The proposed garage would be near the dwelling but on the westerly side of the property so as not to block the view from the house to the highway.
