Historically, the policy of the building department is to refer any applications which include a dedicated staircase (versus a "pull down staircase")to a conditioned (versus unfinished and unconditioned)%story, above the 2nd Floor, automatically to the Zoning Board of Appeals. In other words, any use of the aforementioned Y story for anything other than an unfinished, unconditioned, attic space for storage is deemed prohibited, requiring Zoning Board intervention. Said policy is based on the Building Department's reading of the Town Code, specifically Article III §280-18 & §280-4. We respectfully disagree with said reading and are requesting that the Zoning Board resolve the issue via a formal Interpretation thereof. Our position is as follows: • The subject property is located in the R-40 Zoning District; • As such, according to the Town of Southold Bulk Schedule for Residential Districts the maximum number of stories is 2 Y (it should be noted that 2%stories is the maximum for every other residential zoning district as well); • §280-18 states in pertinent part that"No building...shall be erected...unless same conforms to the requirements of the Bulk Schedule..." • Here, we a proposing a 2%story building, which is clearly permitted in the Bulk Schedule; • The subject%story is to be accessed by a dedicated staircase and it will be a finished and conditioned space to be used for storage (as there is no basement proposed due to FEMA regulations and the water table) and for a sitting room (no sleeping); • A NYS approved sprinkler system will be installed; • §280-4 defines a half-story as, "[a]ny space with a minimum clear height of five feet, partially within the roof framing where the clear height of not more than 50%of such space between the top of the floor beams and the structural ceiling level is seven feet six inches or more"; • As the construction plans show the subject Y story falls squarely within those parameters; • The Bulk Schedule,the "Story, Half"definition, and the rest of the Town Code for that matter does not restrict, at all,the use of such a%story and does not mandate that it be used solely for storage, nor that it be accessed solely by a "pull down staircase", nor that it be unconditioned and unfinished; • These qualifications placed upon the use of such %story, it is our position, have been read-irrtathe Code by the Building Department and are seemingly an ultra vires act; • The Town Code is sacrosanct and §280-4 (B) entitled "Definitions and usages"states, that "[u]nless otherwise expressly stated, the following terms shall, for the purpose of this Chapter [Zoning], have the meanings as herein defined..."; • Thus, we argue that the Building Department is-stuck with the four corners of the story definition, as written, and is not able to inject further restrictions not imposed therein; • In sum, we are asking the Board to interpret the subject provisions as written, with the affect that 2% stories are indeed permitted, without qualification, within residential zoning districts, and homeowners need not be forced to apply to the Zoning Board to make a use of said % story whether for storage or habitable, so long as the space falls within the definitional construction parameters; • This Interpretation request has no bearing on state code requirements for sprinklers, and as previously stated will be installed here; • Additionally, the exterior of the subject dwelling will not change from the previously permitted plans, and all this Interpretation is concerned with is the internal use of the subject%2 story; • Lastly, it is our position that if the Town Board agrees with the subject policy it requires codification in order to be in farce here. The property is a waterfront parcel containing wetland and restricted areas. The applicants have no other alternative and desire to build a garage as an accessory use in this yard location southwest of the house, at 35 ft. instead of 40 feet from the front line. Without variance relief, the proposed garage in a reasonable location, and their rear yard is very close in proximity to the wetlands and restricted buffer area. The proposed garage is 24 feet by 36 feet with the entrance to the east. The front yard setback pursuant to Article MV, Section 100-244 is 40 feet, the proposed structure is shown at'35 feet from the front yard line. The prpposed garage will be heavily screened from the north and west by dense woods and a non-disturbance buffer, and from the south by heavy vegetation along Bay Shore _ Road. 3. The variance is not substantial in relation to the code requirement, representing a reduction of 12.5%of the code requirement. 4. The alleged difficulty has been self-created because the applicants were aware of the limitations of the nonconforming size of the lot when it was purchased. 5. No evidence has-been submitted to suggest that the relief granted will have an adverse impact on physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a garage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
