(1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted,because: The proposed house is at 35' from the front yard setback, however, the front yard of the lot is at the end of a right of way. The front yard is the rear property Pane of the Main Bay View Road parcel. The applicant wishes to increase the setback to the tidal wetlands line. The wetlands along West Creek reduce the buildable area of the parcel and pushes the house towards the front yard. The variance is not visible from the street. The proposed house will be (175+35)210' feet from Main Bayview Road. We would like to reduce the front yard more, however, the proposed IA sanitary system must be located in the front yard and 35' leaves adequate room for the sanitary system. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue,other than an area variance, because: A 50' setback from the front property line would result in placing the house 15' closer to the wetlands. This is not favorably considered by the NYSDEC. The goal is to build a house as far from the wetlands as is feasible. (3) The amount of relief requested is not substantial because: A 35' foot front yard setback is a conforming setback to a lot which is less than 20,000 square feet. The subject lot is large (40,000 sq.ft.) However the upland adjacent area is only 17,282 sq.ft. (Less than 20,000 sq.ft.). The proposed house is in total 2,920 sq.ft.and 16.9% of the buildable area of the lot(adjacent area). (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The setback to the wetlands have been maximized by the requested front yard variance. The proposed house is only 16.9% of the buildable area and proper drainage has been proposed. In addition the proposed sanitary system is an IA system. The proposed system is a Fugi Clean system. Health Department can not be obtained until the variance is granted. (5) Has the alleged difficulty been self-created?
