Furse DATE PREPARED: 9/28/2020 III.Proposed Construction Description(Alterations or Structural Changes) The applicant is seeking a variance for a proposed one-story addition in place of an existing wing that is in structurally unsound and needs to be rebuilt. As originally built, the applicant's house (called hereafter the Cottage)was a one-bedroom dwelling of 868 sq. ft. At the time, the lot on which the Cottage sits was part of a larger parcel that was owned by the applicant's parents. The Cottage was the guest house for the larger primary residence. In 1985, a large three-bedroom, two-story wing was added to the Cottage. This wing is now in a very unstable and dangerous condition. The floor joists have rotted, which is causing the entire wing to list to one side. This wing is literally pulling away from the original cottage. There is a crack of visible daylight between the 1985 wing and the original cottage. In the interest of safety, It is the intention of the owner to demolish this wing as soon as possible. In 1988, the original parcel owned by the applicant's parents was subdivided, putting the Cottage on its own lot. Given how the lot was subdivided, the Cottage did not have conforming setbacks. A variance was received at the time to allow for the Cottage to be legal. The owner would like to remove the structurally unsound wing and construct a new addition that is smaller in area, height and volume. The front setback would remain the same as existing, and the setback to the shoreline would be slightly increased. Architecturally, the wing to be demolished has no relationship to the original cottage. It is an entirely different house stylistically. By this application, appellant requests approval of the insufficient lot area of proposed Lot 42 of not less than .94 acre(s) , insufficient average lot depth of 106+- feet, and insufficient setbacks of the existing buildings to the proposed division line as shown on the Map amended April 12, 1988, prepared by Chandler, Palmer & King. 5. Article III, Section 100-31, Bulk. Schedule, of the Zoning Code requires a minimum lot area of 80,000 sq. ft. , minimum lot depth of 250 feet, and minimum frontyard setback at 60 feet and rearyard setback at 75 feet. The percentage of relief requested in relation to these requirements is substantial, approximately 50%. 6. Article III, Section 100-31 excepted those lots having a lot area of less than 80,000 sq. ft. that were "held in single and separate ownership prior to November 1971, and there- after," or were approved by the Planning Board prior to May 20, 1983. The record shows that these parcels were not held in single and separate ownership, although the two single-family dwellings were in existence and occupied prior to the May 20, 1983 increase in lot area requirement. No prior appeals have been found of record concerning these premises. 8.
