WITNESSETH, that the party of the first part, in consideration of
TEN and 00/100 ($10.00) DOLLARS, and other good and valuable
consideration, paid by the party of the second part, does hereby
grant and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the
buildings and improvements thereon erected, situate, lying and
being at Mattituck, in the Town of Southold, County of Suffolk
and State of New York, known as Lot No. t60 Block 12 on a certain
map entitled, "Captain Kidd Estate" and filed in the office of
the Clerk of Suffolk County as Map No. 1672 on January 19, 1949.
Said premises are known and designated as District 1000, Section
106.00, Block 03.00 and Lot 027.000.
SING AND INTENDED to be the same premises conveyed to the party
of the first part by Deed dated March 14, 2008 and recorded in th
Office of Clerk of the County of Suffolk on March 21, 2008 in
Liber 12544 at page 887.
SUBJECT TO: Zoning restrictions, covenants, easements, conditions,
reservations and agreements, if any; subject to any state of fact
as may appear from an accurate survey; subject to facts as to
possession and occupancy and subject to whatever physical
condition of the premises may be; subject to any violations of th ,
zoning and other municipal ordinances and regulations, if any, an
if the United States of America should file a tax lien, or other
lien, subject to the equity of redemption of the United States of
America; subject to the rights of any lienors of record whose
liens have not been foreclosed herein, if any; subject to the
rights of holders of security in fixtures as defined by the
Uniform Commercial Code; subject to taxes, assessments and water
rates which are liens on the premises at the time of sale, with
accrued interest or penalties thereon;
TOGETHER with all right, title and interest, if any, of the party of th
first part in and to any streets and roads abutting the above described
remises to the center lines thereof; TOGETHER with the appurtenances,
and also all the estate which the said decedent had at the time of
decedent's death in said premises, and also the estate therein, which
the party of the first part has or has power to convey or dispose of,
Nether individually, or by virtue of said will or otherwise; TO HAVE
AND TO HOLD the premises herein granted unto the party of the second
art, the heirs or successors and assigns of the party of the second
art forever.
AND the party of the first part covenants that the party of the first
art has not done or suffered anything whereby the said premises have
been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the
Lien Law, covenants that the party of the first part will receive the
consideration for this conveyance and will hold the right to receive
such consideration as a trust fund to be applied first for the purpose
of paying the cost of the improvement and will apply the same first to
the payment of the cost of the improvement before using any part of the
total of the same for any other purpose. The word "party" shall be
construed as if it read "parties" whenever the sense of this indenture
so requires.
