4428 Morse Avenue, Studio City, CA 91604, individually, as beneficiaries under Article SECOND(B)of"The
Robert and Barbara Kaplan Personal Residence Trust No. 2," under Trust Agreement dated May 15, 1996,
with respect to a fifty(50%)percent interest in the property described below,and David J.Kaplan, residing at
25 Woodgreen Lane, East Hills, NY 11577 and Jonathan A.Kaplan, residing at 4428 Morse Avenue,Studio
City, CA 91604, as Trustees of the Trust under Article SECOND under the Will of Barbara Kaplan dated
February 11, 2014, who died a resident of Nassau County, New York on June 22, 2020, and which will was
probated under Nassau County Surrogate's file Number 2020-2805, with respect to the remaining fifty(50%)
percent interest in the property described below, which fifty (50%) percent interest was derived as more
particularly set forth below,party of the first part,
and
David J.Kaplan,residing at 25 Woodgreen Lane, East Hills, NY 11577 and Jonathan A.Kaplan,residing at
4428 Morse Avenue,Studio City,CA 91604,as Tenants in Common,party of the second part,
WITNESSETH,that the party of the first part, in consideration of ten dollars paid by the party of the second
part,does hereby grant and release unto the party of the second part,the heirs or successors and assigns of
the party of the second part forever,
ALL that certain plot,piece or parcel of land,with the buildings and improvements as described on Schedule A
annexed hereto and made a part hereof.
Being the same premises described in that certain deed dated May 15, 1996 recorded March 26, 1997 in Liber
11822 Page 537 in the Office of the Suffolk County Clerk.
With the fifty (50%) percent interest of the party of the first part derived under the Will of Barbara Kaplan,
deceased, receiving said fifty (50%) percent interest as residuary beneficiary under the Will of Robert I.
Kaplan,deceased,dated March 23, 1998,who received his fifty(50%)percent interest under Article SECOND
(A) of the aforementioned "The Robert and Barbara Kaplan Personal Residence Trust No. 2," as Robert I.
Kaplan did not survive the fifteen (15)year Fixed Term of the Trust. Said fifty (50%) percent interest in the
property transferred by the parties being a tenant in common interest.
The effect of this deed is to convey one hundred(100%)percent of the interest of the party of the first part in
the property hereunder to the party of the second part.
TOGETHER with all right,title and interest, if any,of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof;TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part,the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever,except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law,covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word"party" shall be construed as if it read"parties"when ever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has'duty executed this deed the day and year first above
written.
