SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 thru A 14-25 and the Suffolk County Department of Planning issued its reply dated April 23, 2021 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a nonconforming 4,256.14 square foot parcel located in the Residential R-40 Zoning District. The northerly property line measures 49.05 feet and is adjacent to Mechanic Street, the easterly property line measures 86.59 feet and the southerly property line measures 50.00 feet and the westerly property line measures 85.58 feet. The parcel is improved with a single-family one-and-one half story frame dwelling with an enclosed front porch and a detached single car garage located in the rear southwest corner of the property as shown on the survey map prepared by Kenneth M. Woychuk,LS, and dated December 22,2020. BASIS OF APPLICATION: Request for Variances from Article XXIII, Section 280-124; and the Building Inspector's March 5, 2021 Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing single-family dwelling; at; 1) located less than the code required front yard setback of 35 feet; 2) located less than the code required minimum side yard setback of 10 feet; 3) located less than the code required rear yard setback of 35 feet;4)more than the code permitted maximum lot coverage of 20%; located at: 140 Mechanic Street, Southold,NY. SCTM# 1000-61-4-34. RELIEF REQUESTED: The applicant requests variances to construct additions and alterations to an existing single- family dwelling The proposed construction, on this nonconforming lot, is not permitted pursuant to Article XXIII Section 280-124 which states; lots measuring less than 20,000 square feet in total size require a front yard setback of 35 feet,a minimum side yard setback of 10 feet, a rear yard setback of 35 feet and a maximum lot coverage of 20%. Page 2,July 15,2021 #7512,Wylie SCTM No. 1000-61-4-34 The applicant proposes a front yard setback of+/—31 feet,a minimum side yard setback of 5 feet,a rear yard setback of 25 feet and lot coverage at 26.8% as shown in the Site Plan drawings submitted by Anne Surchin,Architect, and dated April 13, 2021. ADDITIONAL INFORMATION: Three letters of support for this application have been received to the Zoning Board of Appeals. The applicant wishes to make alterations for a first-floor mud room,adding a first-floor bathroom at the rear of the dwelling and a second-floor rear dormer addition. The proposed rear dormer will only add 220 square feet of habitable space to the second floor. To minimize the appearance of the dormer, the south facing exterior wall will be 6 ft.3 in.high lower than the standard 8-foot wall height. The existing roof ridge line will remain as is without being raised. The new one-story addition will be 69 square feet in area. The existing lot coverage measures 25.2% and the proposed addition will measure 26.8%, a difference of 1.6%. The house was built in the late 1920's. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 1,2021 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties This is an older neighborhood with small lots and homes that pre-date zoning and are now are almost all non-conforming with the town code The proposed additions and alterations are in keeping with the size of other homes in the neighborhood that have been renovated over time and with the existing architectural style of the subject dwelling. The property is well screened with vegetation and partially fenced in along the side and rear yard where the proposed addition will be located. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant or cannot be achieved by some method,feasible for the applicant to pursue,other than an area variance. The dwelling and the lot size are existing and quite small by today's standards. The applicant wishes to make the residence more functional and slightly larger to accommodate their growing family. It is currently a two-bedroom dwelling and the applicant wishes to add a third bedroom. The existing lot and dwelling pre-date existing zoning regulations so variance relief is required. 3. Town Law X267-b(3)(b)(3). The variances granted herein are mathematically substantial,representing 11%relief from the code for front yard setback, 50% relief from the code for side yard setback, 28.5% relief for the rear yard setback, and 34% relief from the code for lot coverage. However, because the lot and dwelling pre-date the zoning ordinances the applicant's architect has minimized increases to the pre-existing non-conforming footprint with only a 7.4 ft. x 9.5 ft. one story addition which will only add 69 square feet to the dwelling located in the rear yard where it will not be seen from the street or by adjacent neighbors, and the proposed shed dormer on the rear will add headroom to allow habitable space in the existing half-story and is also characteristic of the style of other homes in the neighborhood. 4. Town Law X267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a slightly larger and more efficient residence while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Acampora,seconded by Member Lehnert, and duly carried, to GRANT the variances as applied for,and shown on the Site Plan,dated April 13,2021 and Architectural Drawings last revised February 22,2021 (sheets 1-5)prepared by Anne Surchin,Architect. SUBJECT TO THE FOLLOWING CONDITION: 1. Prior to receiving a building permit,the owner(s)of the subject property cited herein must sign a statement acknowledging: a. That the applicant(s)have read this determination and understand the limits of the variance relief granted herein; b. That the applicant(s)will immediately contact the Building Department if a demolition,as defined by Section 280-4 of the Town Code,' occurs during construction, or any construction undertaken in any other way exceeds the scope of the approvals granted herein, or the issued building permit; c. That the applicants are aware that the Zoning Board of Appeals retains jurisdiction until the issuance of the Certificate of Occupancy and has the right, after a public hearing,to modify, suspend or revoke such approvals or any term or condition thereof or to impose thereon one or more new conditions, pursuant to Article XXV, Section 280-141 of the Town Code. The above conditions shall be written into the Building Inspector's Certificate of Occupancy, when issued. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void. The Board reserves the right to substitute a similar design that is de min imis in nature for an alteration that does not increase the degree of nonconformity. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals.
