SCTM: #1000-69-6-11 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated April 23,2021 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief,permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject, 20,319.38 square feet, .47 acre, rectangular-shaped parcel located in the R40 Zoning District measures 119.7 feet along Main Road(N.Y.S.Route 25),then runs south 185.25 feet along a residentially developed lot to the east, then runs west 115.84 feet along a residentially developed lot to the south, and returns 167.69 feet north,back to Main Road, along agricultural lands to the west. The site is developed with a 2-story frame residence,a covered front porch,a covered side deck, brick walkways, gravel driveway, a brick patio, two small sheds and a stockade fence along the rear and side property lines behind the house as illustrated on the survey prepared by Michael J. Salice,LSA,Land Surveyer, dated December 14, 2020. BASIS OF APPLICATION: The applicants request a Special Exception pursuant to Article III, Section 280- 13B, subsection 14 of the Zoning Code, to operate a Bed and Breakfast within their existing single-family dwelling, accessory and incidental to their principal residential occupancy under the Building Department's Pre-Existing Certificate of Occupancy Z-23788 dated July 21, 1995. The existing 4 bedrooms for lodging and serving of breakfast to 8 B &B casual, transient roomers was created through additions and alterations to the applicants' existing one family dwelling under the following Certificates of Occupancy: Page 2,July 15,2021 #7507, Hoffman/Pierce—Bed & Breakfast SUM No. 1000-69-6-11 Z-28031 Dated October 26,2001 Addition to an existing one family dwelling as applied for Z- 38260 Dated April 22, 2016 Second floor alteration for a 41 Bedroom for a B&B as applied for Z-38261 Dated April 22,2016 "As Built"porch addition as applied for ADDITIONAL INFORMATION: The applicant recently purchased the dwelling which previously operated as the "Ellis House Bed & Breakfast" under Zoning Board of Appeals decision 45122 dated May 16, 2002 for a four-bedroom B&B. The current owners propose to continue the operation of the property as a four- bedroom Bed & Breakfast. The applicant provided a parking plan illustrating the required six (6) parking spaces, on site, including one (1) per B&B guestroom plus two (2) for owner/resident use and a floor plan illustrating the four guest bedrooms along with the three retained for owner's private use. Substantiating a seven bedroom home the owner provided copy of a Suffolk County Department of Health Services approval for a 7-bedroom residence, under permit #R10-01-0259, dated April 18, 2016. Additionally, the applicant included Zoning Board of Appeals decision #1510 dated March 16, 1972 authorizing the subdivision of the original property (which ran to the corner of South Harbor Lane) and creating a new lot (now residentially developed and to the immediate east of the subject parcel). The applicant provided the following documents to illustrate residency: • Bargain and Sale Deed for the purchase of the property dated January 29, 2021 • STAR Registration from the NYS Department of Taxation and Finance dated April 1,2021 • Individual NYS Driving Licenses registered to 47100 Route 25, Southold NY 11971 • Copy of a PSEG utility bill for service to 47100 Main Road, Southold NY 11971 A farm to the east of the subject property offered commentary, dated June 30, 2021, requesting that the applicant adhere to the Town of Southold Code, Chapter 172, in relation to exterior lighting law(a.k.a. Dark Skies compliance). During the public hearing the applicant offered to remove recently installed colored `landscape lighting' in compliance with the Code and neighbor's request. One member of the Zoning Board of Appeals performed an interior inspection of the premises. No immediate neighbor or member of the public spoke in favor of or against this application, other than the farmer to the east,reminding the applicant of their responsibility to adhere to the Town lighting code. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on July 1,2021 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, and upon review of the code requirements set forth pursuant to Article III, Section 280-13B(14) to establish an Accessory Bed and Breakfast, the Board finds that the applicant complies with the requirements for the reasons noted below: 1. Mark Hoffinan and John Pierce, the applicants herein, are the owners of the property, 47100 NYS.Route 25 aka Main Road, Southold NY 11971. It is improved with a single-family residence, built prior to zoning and contains seven (7) bedrooms as shown on the survey prepared by Michael J. Salice, LSA, Salice Land Surveying dated December 14, 2020. The owners/applicants will continue to occupy same as their principal residence while the Accessory Bed and Breakfast facility is managed and operated.The applicants have submitted the following proof that the subject premises is their principal dwelling: utility bills, driver's license, and STAR Exemption. 2. The owner/applicant submitted the following documents to confirm the principal occupancy of the dwelling: utility bills, driver's license and STAR Exemption. 3. The applicants plans comply with the on-site parking requirements and provide for 6 parking spaces, Page 3,July 15,2021 #7507, Hoffman/Pierce—Bed& Breakfast SCTM No. 1000-69-6-11 two for the principal single-family use and one(1)for each of the four Accessory Bed and Breakfast bedrooms. 4. The applicants comply with the requirements of a dwelling unit as defined in Section 280-4 of the Zoning Code 5. The Accessory Bed and Breakfast, as applied for, is reasonable in relation to the District in which it is located,adjacent use districts, and nearby and adjacent residential uses. 6. The Special Exception is accessory to the principal use and will not prevent the orderly and reasonable use of adjacent properties. 7. This accessory Bed and Breakfast will not prevent the orderly and reasonable uses proposed or existing in adjacent use districts. 8. No evidence has been submitted to show that the safety, health, welfare, comfort, convenience or the order of the town will not be adversely affected. 9. This zoning use is authorized by the Zoning Code through the Zoning Board of Appeals as noted herein, and issuance of a Certificate of Occupancy from the Building Inspector is required by code before an Accessory use may be occupied. 10. No adverse conditions were found after considering items listed under Section 280-142 and 280-143 of the Southold Town Zoning Code. 11. Submission of a Certificate of Compliance or similar document will be necessary for issuance by the Building Inspector certifying that the premises conforms to Chapter 280 of the Zoning Code for an Accessory Bed and Breakfast use. RESOLUTION OF THE BOARD: In considering all of the above factors,motion was offered by Member Planamento, seconded by Member Dantes and duly carried to GRANT the Special Exception permit for an Accessory Bed and Breakfast for 4 guest bedrooms rooms with an occupancy of no more than 8 transient guests, 2 per bedroom, to be used only in conjunction with the applicant's-owner's residence,as applied for and shown on a survey with hand-drawn parking plans and floor plans received on April 7,2021. SUBJECT TO THE FOLLOWING CONDITIONS: 1. This Special Exception Permit requires an operating permit and inspection by a Building Inspector from the Building Department that must be renewed annually. It is the applicant's responsibility to contact the Building Department each year to schedule the required inspection. Failure to do so may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. 2. This Special Exception permit cannot be transferred to new owners. 3. Per applicant's testimony,all exterior non-compliant `landscape lighting' will be removed and all exterior lighting will be in compliance with Town Code Chapter 172 (including lights installed prior to owner/applicant's purchase)prior to issuance of the annually renewed Bed& Breakfast permit. 4. A conspicuous sign shall be placed along the driveway, and regularly maintained, indicating that B&B guests shall not back out onto S.R. 25/Main Road. Any deviation from the survey, site plan and/or architectural drawings, cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. In the event that this is a special permit subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. Any violations of the conditions, occupancy or other requirements described herein, may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception permit as granted herein. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. As the owner of a neighboring farm and all of us living in close proximity to the Custer Institute Planetarium, I have no objection to this petition but it should be granted contingent on the owners coming into compliance with Southold Town Code Chapter 172 (Exterior Lighting). The new owners have uplit their entire property with blue lights. As per Chapter 172,the uplighting of buildings,walls, trees, fences, foliage and signs is illegal within the Town of Southold. Blue light is particularly bad as insects are attracted to this color, luring nocturnal pollinators from pollinating my farm's berries (insects cannot see the red/orange/yellow part of the spectrum hence why bug lightbulbs are yellow). To be a good neighbor and comply with Southold Town Code,we also ask that all exterior lights (even the ones installed before July 20 10) be fully shielded (zero uplight) fixtures with lightbulbs rated at 2700 Kelvin (warm white) or less. Shields must be installed on all motion detector lights to prevent visible glare and light trespass on adjacent properties.
