June 15, 2021 Board of Town Trustees Town of Southold Mr. Goldsmith, President Mr. Domino, Vice President Re: TR-9757 I appreciate your consideration with respect to my request to increase the width of my fixed dock platform to 6'-0" .After presenting my approved plans to 3 different marine contractors, each had multiple recommendations for the project. Consistently, each contractor identified that increasing the width would add to the stability to the structure and provide a safer platform for entering and exiting my boat. As my wife and I are both architects, sometimes we are cursed with the inability to stop designing projects that are still on paper. We have given special consideration to the materials, design and the effect on the waterfront. We intent to use as many sustainable materials as we can in an environmentally friendly way. This has resulted in slight dimensional changes to 2 sections of the approved design. In the attached drawing(s) we are also requesting that the Gangway be increased in length and the upper catwalk be reduced. The increased gangway will allow us to pass over the wetlands without pilings as well as provide higher clearence. The total length of the structure will remain the same and will not extend past the approved position. In this process of acquiring the necessary permits,Trustee Domino clearly explained the importance that the physical dock constructed match the permit to the letter. This was not the case with the dock that came with the house I acquired. We are insisting that the contractor follow the drawings and project description precisely. Thus we feel it best to address these issues before ording materials and commissioning the project. I respectively request the Trustees approve these slight but positive adjustments to our permit. I am available to answer any questions or concerns you may have. I discovered that the original data, as provided by my consultant in my first application from 2019 was inaccurate. As I also mentioned, I have re-staked the position of the Pier to match the drawings Dated October 20, 2020. 1 have provided these attached photos to show that I have followed your recommendations and relocated the new dock to a position closer to shore and in better alignment with other floaters north of our property. I trust that this meets and exceeds your requested adjustments and allows the board to move forward with an approval of my application. Sincerely Ken Quigley .. As per the comments and concerns voiced by the Board during the Zoom Meeting I agreed to re-position the Dock by the 9'-0" identified by Trustee Williams. I have studied various documents that effect our design. After review of photos of extreme low tides and available water depths in and around the proposed Dock, I have decided to move the Dock Position an additional T-0" to a total of 14'-0" closer to the shoreline and place the proposed dock nearly in line with other docks to the North of our property. In addition to the Board's re-position suggestion, I added a "Project Benchmark"to the Plans which locates the current floating dock position and allows the Marine Contractor to properly position new dock construction in the approved position. Dimensions are also provided. I trust that this meets and exceeds your requested adjustments and allows the board to move forward with an approval of my application. Located: 2245 Little Peconic Bay Lane, Southold. SCTM# 1000-90-1-16 S.E.Q.R.A. NEGATIVE DECLARATION OF ENVIRONMENTAL SIGNIFICANCE: WHEREAS, the Southold Town Board of Trustees are familiar with this project having visited the site on October 7, 2020, and having considered the hydrographic map of property by Robert H. Fox dated January 22, 2019, and having considered the plans for this proposed project submitted by Kenneth Quigley dated September 18, 2020 at the Trustee's October 9, 2020 work session, and WHEREAS, on October 14, 2020 the Southold Town Board ofTrustees d clared-itself — Lead Agency pursuant to S.E.Q.R.A.; and, Page 1 of 2 WHEREAS, on October 14, 2020 the Southold Town Board of Trustees classified the application as an unlisted action pursuant to S.E.Q.R.A.; and, WHEREAS, in reviewing project plans submitted by Kenneth Quigley dated September 18, 2020 it has been determined by the Board of Trustees that all potentially significant environmental concerns have been addressed as noted herein: • Navigation: The proposed dock meets standards and does not extend beyond 1/3 across the water body. Depths for the dock terminus are within Town Trustees, New York State Department of Environmental Conservation and United States Army Corps. of Engineers guidelines and there is no recognized Federal/New York State/Town navigation channel in the immediate vicinity of the proposed structure. • Scope: The proposed dock is comparable to docks on neighboring properties in an area where docks historically are used for commercial and recreational purposes • Scope in relation to the riparian rights of shell fishers: The plan allows a standard fixed catwalk design that will not impede access for those seeking shellfish and crustacea in season. • Scope in relation to view shed: The seaward end of the proposed dock will not extend appreciably beyond existing docks. As such the perspective will not be discernibly different from the existing view. • Environmental upkeep: The dock design projects a usual lifespan of 30 years with limited pile replacement so as to minimize disturbance of the bottom THEREFORE, according to the foregoing, the Southold Town Board of Trustees Approve and Authorize the preparation of a Notice of Negative Declaration pursuant to SEQRA for the aforementioned project. Bredemeyer Domino G. Goldsmith Krupski ✓G. Williams Other OIL otut- October 8, 2020 Board of Town Trustees Town of Southold Mr. Goldsmith, President Mr. Domino, Vice President I appreciate your consideration with respect to the site visit and evaluation of the proposed dock configuration that I have submitted. During your site visit, I replied to your first question regarding the staking and what each line of stakes represent; the inner stakes represented the waterside corners of the Fixed Dock and the outer 2 stakes represented the position of the tie off pilings. With regard to your question/comment about the positioning of the dock and the "possible" need to have the dock re-positioned landward to align with other docks on our body of water, I did some checking and measuring. The attached blowup of the Key Plan shown on my application drawing has been created to show the relative position at a larger scale. Within the computer graphics program, I created a trace line of the shoreline and then copied this trace line horizontally to the 2 existing docks north of our proposed dock(sheet 1). As you and the other trustees can see, the distance from the shoreline is equal to the other docks. Our shoreline is not a straight line and trying to maintain all docks align (as is suggested in the code)would re-position our proposed dock into shallower water(Sheet 2). There is no question that maintaining the greatest water depth at the boat position is essential for the lake. I respectively request that we leave the position of the dock as shown on the plans as it would provide the deepest water possible, maintains equal shoreline to dock distances of adjacent docks and has no impact on clearances for waterway boating. Further, an AJD, a proffered individual permit(and all terms and conditions contained therein), or individual permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331. If, during an administrative appeal, it becomes appropriate to make an official determination whether geographic jurisdiction exists over aquatic resources in the review area, or to provide an official delineation of jurisdictional aquatic resources in the review area, the Corps will provide an AJD to accomplish that result, as soon as is practicable. This PJD finds that there "may be"waters of the U.S. and/or that there "may be"navigable waters of the U.S. on the subject review area, and identifies all aquatic features in the review area that could be affected by the proposed activity, based on the following information: SUPPORTING DATA. Please advise if there is a cutoff of resubmission to maintain the tentative trustee meeting date for this application. Note: During Covid I applied and, received approval and have been sent permits for the drawings dated 12/3. by ACE and DEC. Reducing sizes and providing information as requested should not be a problem. I'll resubmit to agency's as necessary once final trustee approval is granted. I've reapplied for this dock, believing I was following Trustee Domino's comments from our First denial in 2019. Upon review I was told by dock contractor that the a narrower fixed dock might not be as stable in the 90degree configuration. He suggested rotating orientation or adding a stabilizing corner. Dock size Drawn was based on stability. I will review town code again tonight. If possible please provide code reference for fixed dock size so I can get length, width and configuration correct. Kayak launch will be eliminated as it is not required. I would have taken the opportunity to discuss with trustees during a standard work session. I presume that is no longer possible due to COVID. Is it possible to speak to Trustee Domino or another trustee via telephone to clear up a question or two so I can produce an acceptable design once and for all?
