Eiring,residing at 4077 Main Bayview Road, Southold, New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: 1. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Thomas Eiring located at 4077 Main Bayview Road, Southold. Summary Statement In brief, we do not believe the Zoning Board of Appeals should grant the variance. Given the project site's proximity to wetlands adjacent to West Creek and its heavily m constrained building area, any level of site development is highly likely to negatively and permanently impact the wetland areas and in turn the Creek. The construction of even a modest house, coupled with its required clearing, access, septic system, and long-term human activity throughout the property will undoubtedly cause negative impacts. IImpacts to Wetlands&West Creels Scientific evidence points to the inevitability of sea-level rise and the occurrence of increasingly drastic storm events which jeopardize near shore areas structures and infrastructure. The site is within several FEMA flood zones which indicate probability of future flooding at some point. Unequivocal support for wetlands preservation is also clearly supported by the Town of Southold's recently P p adopted Southold Town Comprehensive Plan - a document that after ten years of review, and unanimous approval by the Town Board, should stand as a guide for all future land-use decisions. With regard to wetlands protection, the Comprehensive Plan makes clear that: "adjacent lands that provide buffers to wetlands must be maintained and enhanced. These buffers are necessary to ensure long-term viability of the Town's wetlands" (pagel8). Additionally, Goose Creek remains an Impaired Waterbody according to the New York State Department of Environmental Conservation and the Town of Southold and The Peconic Estuary Program maintain ongoing efforts to revitalize this specific area and the greater Peconic Estuary system in general. Although the site provides buildable land area, the proposal should be scrutinized and potentially modified given its sensitive environmental location and the context of several real issues described above. Additionally, I call attention to the applicant's "Reason for Appeal" (August 18, 2020). It was noted an answer"No" to whether the alleged difficulty is self-created, stating that there is less building area due to "encroaching wetlands." Firstly, the fact that wetlands have been encroaching on the property speaks directly to the environmental sensitive nature of the property and its natural ability to change overtime. The growing nature of a healthy wetland system is Gllp'I what helps protect near shore areas from sea-level rise and storm surge events. This reiterates the serious implications of building on parcels like these. Secondly, we argue that the hardship is self created given the size of the house and amenities proposed onsite. If the proposal was scaled back, is there truly a need for a i II variance? The Zoning Board of Appeals might suggest modifying the house size and/ or amenities including a two car garage. This could potentially eliminate the need for the variance while maintaining the appropriate setbacks to wetlands. Conclusion The construction of new homes on vacant, waterfront parcels adjacent to impaired waterways will continue to jeopardize efforts to revitalize and conserve wetland areas and the nearby ground and surface water resources. Also please see the attached letter of opposition addressed to the Town of Southold Zoning Board of Appeals regarding the area variance that was granted for this application. Group for the East End remains concerned that given the site's proximity to wetlands adjacent to Goose Creek and its heavily constrained building area, that any level of site development on this property will negatively impact the wetlands and water quality in Goose Creek. Unequivocal support of wetlands preservation is clear in the adopted, Southold Town Comprehensive Plan. The Town of Southold Trustees can and should require additional environmental safeguards above and beyond what the ZBA and New York State Department of Environmental Conservation have concluded in their respective permits. It is ultimately the Trustees responsibility to protect and restore its shared water resources throughout the Town. If the Trustees are not inclined to deny the wetland permit, we strongly advocate that the following measures be conditioned in the approval: 1) Increase the size of the 40-foot non-disturbance buffer to the maximum extent practicable 2) Prohibit the use of fertilizers, pesticides and herbicides on the entire property 3) Require the use of native vegetation in revegetation or landscape plans Thank you for reviewing our comments. Concrete Leachate During construction,no wet or fresh concrete or leachate shall be allowed to ; escape into any wetlands or waters of New York State,nor shall washings from ready-mixed concrete trucks,mixers,or other devices be allowed to enter any wetland or waters. Only watertight or waterproof forms shall be used. Wet concrete shall not be poured to displace water within the forms. 13. Driveway/Parking Area of Pervious Material Driveway and parking areas shall be constructed of NYSDEC-approved pervious materials. 14. The applicant submitted a revised survey increasing a 20 feet wide Non-Turf Buffer to 40 feet, per DEC request, landward of the tidal wetlands on November 25, 2020. The applicant's agent provided a Certificate of Appointment of Executor from the Surrogates Court of the State of New York, dated September 15,2014, indicating Stephen Gutleber as the fiduciary appointed. The applicant included undated architectural plans for the proposed residence designed and stamped by Vincent Benic, R.A., labeled A-101, A=102 and A-201 through A-203. Additionally, the applicant proposes to install a Suffolk County Board of Health approved Innovative Advanced (IIA)wastewater treatment system and will hook- up at the applicant's expense, the residence located at 4235 Main Bayview Road, Southold NY (Dooley) SCTM: 1000-78-2-17,to public water in order to facilitate sanitary system placement on the subject lot. While the subject parcel is 40,012 square feet in size the upland,buildable area is limited to 17,282 square feet with an allowable lot coverage of 20%. The applicant proposes a house, attached garage and front and rear decks for a total of 16,9% lot coverage. Prior relief was granted by this Board under appeal #1815 dated June 7, 1973 which allowed for the creation of the subject lot along with the 15 feet wide right of way,creating site access. The applicant's agent, on October 2, 2020 submitted copy of ZBA decision #7322 illustrating relief granted for a reduced front yard setback in support of this application. No member of the public or an immediate neighbor spoke in favor of or against this application. FINDINGS OF FACTI REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 1,2020 and December 3,2020 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 5267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. While the subject parcel has an address on Main Bayview Road, the proposed residence is located down an unimproved, dirt and RCA composite right of way and is not clearly visible from the paved roadway. Area homes vary in condition, age, size and placement on their respective lots. The proposed 35 feet front yard setback is from the rear lot line of the adjacent parcel which fronts on Main Bayview Road and owns the right of way, allowing access to the subject property. The proposed house is approximately 200 feet from Main Bayview Road. 2. Town Law 5267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. While the applicant could conform to the Code required front yard setback and construct the residence an additional 15 feet back, in response to the NYS DEC request to increase a non-turf buffer between the building area and the flagged wetlands, the proposed residence needs to be pushed forward,therefore the need for relief and a reduced front yard setback. 3. Town Law 5267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 30%relief from the code. However, the front yard setback is calculated on lot size and not buildable area. As a result, the Page 3,December 22,2020 #7427,Estate of Thomas Eiring SCTM No. 1000-78-2-18.4 required front yard setback is greater than what would be permitted if the setback was calculated against the buildable lot area, in which case,this application would be compliant and would not require relief from the Code 4. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 5267-1b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 5267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a single-family residential dwelling with garage and decks with a reduced front yard setback of 35 feet while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Planamento, seconded by Member Acampora, and duly carried,to GRANT the variance as applied for and shown on the unstamped survey prepared by Howard W. Young, L.S., last revised November 24, 2020 and the undated architectural plans, received August 18, 2020 for the proposed residence prepared by Vincent Benic,R.A., Iabeled A-101,A-102 and A-201 through A-203.
