The operation as it stands no~ is an hnprovement over the previous operation. The buildings are now in better condition and the property has ~been cleaned up. Several members of the Board have been down there to 1°ok at it, so you know the.condition of the propertyo I Imyself ~n't feel that it makes any appreciable change in the character of the prol~erty. THE CHAIRMAN: IS there anyone else present who wishes to MR. H~LSE= Can you fit all your equil~aent in these buildings? MR. SHCR~EVER~ Probably not. Bu~[the vast majority of it, I could. You take something lake a trai~er, which is over 40 ft,~ long.. MR. HULSE: Well, I mean Just you~eguipment, obviously you would not have buildings to store your ~railerso MR. SCRXEVER~ Excluding the trailers, I would definitely have enough room for all my equipment. THE CHAIRMAN: This equipment is in o~eration most of the time~ MRo SC~EXEVER: Yes, we bring it into service it and fuel it~ then we take it out again. ~R. HULSE: Then about the only ti~e it would be on the premises is in the winter months? MR. SCHRIEVER: Yes~ that's right. Except for the servicing and fueling. The time when we really n~ed the buildings is in the winter. There are about 3 months of tha year during which it is impossible to work. THE CHAIP~N: '~nat percentage of use o~ the equipment is in the Town of Southold and what percentage is ~out side the Town of Southold? MR. SCHRXEVER~ I would say about ~5% is in the Town of Southol~. We do occassionally get a Job in Rocky ~Oint, Wading River~ or Southampton. THE CHAIRMA~: a~e you in. the equipme~t used for? What business MR. SCHR~v~R: ~r main business ~s the excavation, cesspools, and grading for new houses. We also I do,roads, bulkheading, land clearing and grading, and we put in ~i~eways. We like to have small piles on hand, it is the only practical way to store it. THE CHA~l~%%N: I believe we discu~sed the possibility of planting a hedge along the westerly l~ne, extending the hedge that is there now. Screening would be! helpful as far as the neighbors are o~ncerned and we actually have requirements for screening in the Ordinance, MR. SCH~]~U~R: Well, the property is owned by Mr. Tabor, but if you feel it is necessary to have screen/ng~ we will have it, THE CHAX~RAN~ What type of material do you want to store, sand~ gravel, or what~ MR. SCHR/~VER~ NO, we only want t0 store what is not obtainable in the Town of Southold. Screen send, flor example, I have to go to Calverton to get. If I get a call forla patio~ it is a convenience to the people if X have the material °n hand. THE CHAIRMAN, Originally, you aPPlied for e ~hange of zone on your pro~erty across the street. YOu were th/nking of using ~at property as a ~ossible base for your operation, is that correct? MRS. SCHR~VER~ Yes, that's right, we were going to build a new building, but the Town Board denied the change of zone application. THE CHAiRMAN: What was the tmsis ~f thei~ denial? MR. SCHR/EVER~ I really don't knoW. ! can't speak for the Town Board° X don't think the adjoining property owners wanted it. MRS. SCHRIE~: I don't think the]people were against us, ob this parti~ular operation, I th~.nk theylwere a~raid to zone such a large parcel as 9 acres for business. X think ~they were afraid we might sell out and some sort of monstrositywould develop there, Also they didn't want another building,~ When I was going around with the petition they suggested that we use Tabors barn. THE CHAIRMAN: I think the amount Of property zoned for business or industrial use is very 1/mi~ed in Orient. I think it would belfoolish~ to take the 700' of road frontage on Tabor Road and putlmy business on it. I think that road frontage should have been avatiable for retail business, rather than to use it up for lmy type of operation which does not need that access. We would rather be a little out of the way. Of course we wouldn't want tO be way out on Narrow River Road or anyplace like that where We would have trouble getting the trailers in and out. THE CHA/RMAN: Would you list for ithe record the other places that you sought to acquire for this MR. SCHRI~VER: Well, the first place that we sought to acquire was what used to be Ed King's grading b~n, which is in bac~ of his apartments. That property was zoned "B~ Business. X attempted to buy the propertye ~ was offered a contract to buy the property at a prl~e which was quite high due to the f~¢t that it was the only available business property in Orient. !The building on it would have been of no use to me it would have!had to be torn down. THE CHAIRMAn: Wasn't that property re-zonedP MR. SCHRIEVER: Yes. it was re-zoned to "A" on petition of several of the property owners in that area who wanted to block my obtaining the use of the propexty. THE CHAIRMAN: What other locations did you try to obtain? MR. SCHRIEVER: None, not for thisibuSiness. But previous to that X wanted to build a garage for Civil Defense Equipment and the property was zoned "B" Business, but there was opposition to it. THE CHAIRMAN: Were there any otheM places P MRs. SCHRIEVER: You were going to itry to buy the property behind Joe's Garage, but then somebody else bought it. MR. SCHR~EVER~ Well, yes, but tha~' property was very narrow and long. SCHRIEVER for a Variance to the Zoning Ordinance, Article VT, Section - 0 ~or p~rmission to establish woodworking and metal shops, art studio, and apartment in existing building located in this "B-Light" Business Zoning District, at the West Side of Tabor Road, Orient, NY; CountyiTax Map District lO00, Section 18, Block 05, Lot 12. Following deliberations, the board too~ the following action: WHEREAS, a public hearing was held and iconcluded on September 12, 1985 in the Matter of the Application of BAR~BARA D. SCHRIEVER under Appeal No. 3393; and WHEREAS, the board members have personally viewed and are familiar with the premises in question, its present uses, and the surrounding area; and WHEREAS, the board has considered all testimony and documentation submitted concerning this application; and i% is noted for the record that there has been no public opposition; an~ WHEREAS, the board made the following findings of fact: t. By this application, appellant requests variances to permit: (a) a woodworking and metal shop, (b) an alrtist studio; (c) a single-family residential unit [apartment] on! the second floor of an existing building located in a "B-Light" Business Zoning Dis- trict. 2. The premises in question is situate ~long the west side of Tabor Road commencing at a point approximately llB feet south of the Main Road (S.R. 25) containing an areaiof .528 acreage, lot width and frontage along Tabor Road of 123 feet, and average depth of 187.24 feet. Properties to the north and west of this parcel are zoned "A-Residential and Agricultu~tal"; property adjoining this parcel along the south property line are also zoned "B-Light" Business. Properties along the east side of Tabor Road are zoned "A-Residential and Agricu~ltural." 3. The building in question as exists co!ntains an area of 6,903 sq. ft. on the first floor and an area o~ 1,500~ sq. ft. on the second floor. The subject building is shown on the survey as amended August 27, 1985 prepared by Roderick VanTuyl, P.C., to Southold Town Board of Appeals -6- September 26, 1985 Special Meeting (Appeal No. 3393 BARBARA D. SCHRIEVER, decision continued:) be set back 22 feet from the front (easterly) property line along Tabor Road, 15 feet from the southerly side property line along property now or formerly of William Schriever, and 19 feet from the northerly side property line. The plot plan submitted for the record indicates a setback of 56 feet from the rear (westerly) property line along land now or formerly of Tabor. 4. The activities of the woodworking and metal shops are proposed by this application to be limited to small-scale fabricating without heavy manufacturing of machinery or equipment, a mail-order business, office areas, and manufacture of parts for portable saw mills (see brochures on the ~'Sperber" portable sawmill submitted for the record). 5. The artist studio is proposed to be established at the westerly section of the building containing 1,400± sq, ft. of first floor area (50' x 28' recent addition). 6. For the record, it is also noted that a conditional variance was granted under Appeal No. 1260 on June 12, 1969 per- mitting the use of a 5,600 sq. ft. building for storage and repair of contractor's machinery and equipment. Subsequently, this parcel was re-zoned from "A-Residential and Agricultural" to "B-Light" Business in or about 1971. 7. It is further noted that as of this date: (a) the site plan for this project is pending review and action by the Planning Board, and (b) the proposed Master Plan presently under review by the Town Board depicts the subject property to be re-zoned to "B-l" as re-defined therein, for which these requested business uses are compatible, and which prohibits residential use. 8. After investigation and in considering all the facts concerning the use of this property and existing building, the board agrees that the business uses requested by this application are more feasible; however, the information submitted is not sufficient to warrant a granting of a variance for the residential use on the second floor. In considering this appeal, the board finds and determines that: (a) the business uses as proposed are consistent with and will promote the general purposes of the zoning code and maps [and the Master Plan amendments as proposed]; (b) the circum- stances are unique; (c) the business uses applied for will not alter the essential character of the neighborhood; (d) the busi- ness uses applied for will Hot prevent the orderly and reasonable use of this district or adjacent use districts; (e) the safety, health, welfare, comfort, convenience and order of the town will not be adversely affected by the proposed business use and its location; (f) the interests of justice will be served by allowing the variance for the business uses requested, and by denying the variance for the residential-apartment use, as conditionally noted below. Any change of use to a use other thah as gra~nted by this application, either more or less restrictive,lor whether it be "B-Light," "B-l" or any use compatible under ~he proposed Master Plan zoning amendments, or the current zoning!regulations, will require a new site plan application to and review by the Southold Town Planning Board for additional on-site pa~king and site plan approvals (as well as the Board of Appeals if same is deemed necessary). 8. Dear Mr. Rich, Pursuant to your letter dated January 29, 1979, I contacted Judge James Richs' officeland spoke to his secretary who brought me up to date on this matter. It appears, on May 17, 1976, HOward Terry filed a violation complaint with Judge Demarest. Accordingly, Mr. Schreiver was notified to correct the violation, however, I don't believe a criminal summons was issued. Since Judge Rich has taken ove~ Judge Demarest office he would be the logical person to folldw up. Due to the relationship between yourself and Judge Rich, there would be a conflict involved and I have been instructed to file a violation complaint with Judge Surer. I feel,at this time, my witlin~ess'and efforts would be ineffective and I am therfore turning this file over to Mr. Fisher, who has replaced Howard Terry since his retirement. Very truly yours, ~ William Rich III- Enclosure DEPOSITION Date: January 29, 1979 TO: Mr. Rindermann Building Inspector Town of Southold RE: William Schriever's Violation of town zoning laws relating to storage of heavy equipment near a public road In an attempt to assist the Township of Southold in compelling William Schriever to remove and fence in his array of partially dismantled and rusting earth moving equipment located on his property on the southwest corner of Tabor Road and Route 25, Orient, New York, I would like to make the following statement: 1) I have been a resident of Orient sinc~ June 1, 1974. 2) I reside at 1045 Orchard Street, Orient, New York. 3) That for the past five years William $chriever has had partially dismantled machinery stored~on the southwest corner of Tabor Road and Route 25. ~ 4) That much of the equipment is stored within approximately twenty feet of a public road 5) That to the best of my knowledge of thee town zoning laws the storage of this equipment is in violation of such established zoning laws. 6) That the equipment is an eyesore to the community and should be fenced in on the sides and removed from its position in front of the building. 7) On May 26, 1976 I filed a similar deposition with Mr. Moward Terry, Building Inspector of the Town of Southold, resulting in an order from the Town Justice directing the removal of the machinery. 8) Schriever has continued to ignore the requests of the local residents, the BBilding Inspector and the Town Justice. 9) In View of the lack of effectiveness of standard remedies for zoning violations, I suggest, that as Building Inspector for the Town of Southold 1) You refuse to consider any additional building permits by or on behalf of, William Schriever until he has eliminated all zoning violations on the above described property. 2) In the event Sbhriever refuses to move the machinery, you request the Town Justice to erder the machinery be removed by the Town and the all costs r~l ~'~i~'~much.removal be paid by Schrievero STATE OF NEW YORK ) : SS*: COUNTY OF SUFFOLK On the ~ / day of January 1979, befoCe me personally came ~LL,I.~ ~,~C~ IIi , to me known to be the person described in and who executed the foregoing instrument~ and he acknowledged ~hat he executed the same. \ TOWN OF SOUTHOLD '~ OFFICE OF BUILDING INSPECTOR Town Clerk's Office Soufholcl, N. Mr. Schriever was in the office to see me about this violation this week and refuses to do anything about repairing or moving the offensive machines. His statement is ~It can't be done".
