Moore, Esq. on behalf of FORDHAM-HOUSE LLC c/o DENIS BOUBOULIS applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated August 18, 2017, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the proposed application be found Inconsistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the LWRP Coordinator recommended that the proposed application to establish a 50' wide non-disturbance buffer be found Consistent with the LWRP, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on June 16, 2021, at which time all interested persons were given an opportunity to be heard, and, J WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation-submitted - - - concerning this application, and, WHEREAS, the Board has determined that the structure, as applied for does not comply with the standards set forth in Southold Town Code Chapter 275 – no permits were obtained for the work performed; and WHEREAS, the Board has determined that the request, as applied for, will have a detrimental effect upon the health, safety and general welfare of the people of the town, and, BE IT FURTHER RESOLVED that the Board of Trustees DENIES WITHOUT PREJUDICE based on no action the application of FORDHAM HOUSE LLC c/o DENIS BOUBOULIS to install a ±1,,167sq.ft. on-grade paver patio along the seaward side of the dwelling; extend existing westerly 15' long by 10' high by 12" thick concrete and stone veneer retaining wall an additional 35' seaward for a total length of 50' beginning at the left rear corner of existing dwelling; at seaward end of westerly retaining wall, install a 28' long, varying height'concrete and stone veneer retaining wall parallel with the dwelling; along easterly side of property,-extend existing 3' high natural stone retaining wall an additional ±45' seaward; approximately 15' seaward of proposed 28' long parallel-retaining wall, install a ±3',high by ±45' long'retaining wall situated approximately 1' landward of established -50' wide non-disturbance buffer; and to install a generator pad, generator, and buried gas tank for the.generator; and as depicted on the'survey preparetl by Kenneth M., Woychuk Land Surveying, PLLC, last dated July 27, 2018. As this case will be re-scheduled shortly,I wanted to take this opportunity to refresh your recollection of the facts of this case and attempt to move it forward with the enclosed plan. We have a pending application for retaining walls, an on-grade patio,dry wells and propane gas tank within 100' from top of bluff. I asked my client to prepare a detailed landscape plan with the proposed retaining wall. The retaining wall is necessary to maintain the grade of the property and control soil erosion caused by stormwater run-off from the easterly property. The Trustees,at the last public hearing in 2019,stated that the entire rear yard is a"bluff'. I submitted the following documents to refute this conclusion. The application is for the rear yard ad'acent to the top of the bluff and not on the "bluff'. The top of the bluff has been documented since 1975 and has not changed. I submit to you the following which has been submitted as part of the record: 1. The subject parcel appears as a lot on the"Map of Pebble Beach Farms"; a major subdivision approved by the Town of Southold and filed at the Office of the Suffolk County Clerk in 1975 as File Map Number 6266. The top of bluff is noted on the map. FD E C E E �? J7_ UN 1 7 2021 Southold Town Board of Trustees 2. A survey was prepared showing the revised top/crest of bluff. This line was delineated by En-Consultants Inc.on December 02,2008. All subsequent applications have relied on this line. 3. In July 22,2009,permit number 7139,the Trustees reviewed an application to constrict a house, deck and pool on the subject property. The Trustees approved the applications subject to recording of a covenant designating a 50' non-disturbance buffer measured 50' from the"Top of the Bluff'as depicted on the revised survey last dated August 21,2009. This line is seaward of the Coastal Erosion Hazard Line,a line designated and mapped by the State of New York. The site conditions have not changed. 4. In 2014 an application to the Zoning Board of Appeals was filed as Appeal #6725. This application was for the construction of a new modular dwelling. The variance was approved for a setback from the top of bluff of 61.5 feet,24% lot coverage,a"patio on grade"and a second floor rear/seaward deck was permitted as long as it remained"open to the sky". This plan showed the retaining walls and the house. The"crest of bluff' and 50' non-disturbance buffer showed on these plans. 5. Trustees issue a letter of no jurisdiction on June 9,2014-the measurement of the Crest of the Bluff a.k.a"Top of the bluff' did not change. The Covenants for the 50' non-disturbance line was already recorded(permit from 2009). After construction,when the improvements and grading were needed within the Trustee's jurisdiction,then the owner would return for this permit. 6. The house was constructed: Building Permit#39270 dated 10/15/2014 was issued by the building Department The crest of bluff is shown on the plans The hay bale line was placed at the 50' non-disturbance line. A Silt fence was placed around the constriction. 7. A permit application to complete the rear yard improvements is pending. The Crest/Top of the Bluff has been documented by multiple exhibits: a. the filed map b. prior Trustee's permits C. Zoning Board of Appeals hearings d. The Building Department. This line has not changed, and the applicant's plans and construction have been based on multiple prior permits. Once a building permit and Board decisions have been issued,the owner's rights to rely on these decisions has"Vested". The above applications show the number of years and financial investment made to the property. In reliance on all of the above permits, the house was started in 2014. The modular home was quickly placed on the property and the owner has invested more than$1.7 million dollars. Once the owner's rights have vested no definition change is applicable to this application. D rE C E � V El JUN 17 2021 Southold Town Board of Trustees Even if the Board could apply the 2017 wetland code,the Bluff definition does not apply to the development of the subject property. BLUFF Land presenting with a precipitous or steeply sloped face adjoining a beach or a body of water.For the purposes of this chapter, a precipitous or steeply sloped face shall be a face with a slope of 20%or greater and a height of greater than 20 feet between the toe of the bluff and the top of the bluff. [Amended 5-9-2017 by L.L.No. 8-2017] BLUFF LINE The landward limit of a bluff that is 25 feet landward of the receding edge or,in those cases where there is no discernible line of active erosion,25 feet landward of the point of inflection on the top of the bluff.The point of inflection is that point along the top of the bluff where the trend of the land slope changes to begin its descent to the shoreline. The bluff remains facing the Long Island Sound,as the line identified and delineated by En-Consultants in 2007. That line is where the"precipitous or steeply sloped face adjoins a beach or a body of water" The bluff,as delineated by En-Consultants is consistent with the current definition of a"Bluff'. The side of the parcel which adjoin the Homeowner's Association property are not a bluff because(1)They do not face the adjoining beach or body of water and (2)The slope must be BOTH more than 20%AND a height greater than 20 feet. The side yards do not have a"toe",do not face the Long Island Sound and the height of the side yard slopes are less than a 20' height. A"Bluff'requires that the two conditions must be met,therefore,the land does not meet the definition of a `Bluff'. My client has been seeking a wetland permit for the rear yard for over three years. The years of delay continue to cause damage to my client's property and prevent him from obtaining his Certificate of Occupancy for a completed house. We have a pending application for retaining walls, an on-grade patio, dry wells and propane gas tank within 100' from top of bluff. The Trustees, at the last public hearing, stated that the entire rear yard is a "bluff'. 1 am submitting the following documents to refute this conclusion. The application if for the rear yard adjacent to the top of the bluff and not on the "bluff'. The top of the bluff has been documented since 1975 and has not change. I ask you make the following part of the record: 1. The parcel 4140 appears as a lot on the "Map of Pebble Beach Farms" a major subdivision approved by the Town of Southold and filed at the Office of the Suffolk County Clerk in 1975 as File Map Number 6266. The top of Bluff is noted on the snap. 2. A survey was prepared showing the revised top/crest of bluff. This line was delineated by En-Consultants Inc. on December 02, 2008. All subsequent applications have relied on this line. 3. In July 2009 the Trustees reviewed an application to construct a hci s deck and pool on the subject property. The Trustees approved the applications subject to recording of a covenant designating a 50' non-disturbance buffer measured 50' fi•om the "Top of the Bluff"; this line is seaward of the Coastal Erosion Hazard Line, a line designated and mapped by the State of New York. The site conditions have not changed. 4. In 2014 an application to the Zoning Board of Appeals was filed as Appoj I 46725. This application was for the construction of a new modular dwelling. The variance was approved for a setback from the top of bluff of 61.5 feet, 24% lot coverage, the first-floor deck was denied, but replaced by a "patio on grade" and a second floor rear/seaward deck was permitted as long as it remained "open to the sky". This plan showed the retaining walls and the house. The deck was denied but a patio was approved. The "crest of bluff" and 50' non-disturbance buffer showed on these plans. 5. Trustees issue a letter of no jurisdiction on June 9, 2014-the measurement of the Crest of the Bluff a.k.a "Top of the bluff' did not change. The Covenants for the 50' non-disturbance line was already recorded (permit from 2009). After construction, when the improvements and grading were needed within the Trustee's jurisdiction, then the owner would return for this permits. 6. .The,house was,constructed:-Buildin .Permit-#39270._dated-1.0/1.5/2014_.was issued by the building Department. The crest of bluff remained on the plans The"hay bale line wa`s placed at the 50' nori=disturbance line. A Silt fenee was placed around the construction. 7. A permit application to complete the rear yard improvements is pending. The Crest/Top of the Bluff has been documented by multiple exhibits: a. the filed map , b. prior Trustee's permits C. Zoning Board of Appeals hearings d. The Building Department. This line has not changed, and the applicant's plans and construction have been based on multiple prior permits. Once a building permit and Board decisions have been issued, the owner's rights to rely on these decisions has "Vested". The above applications show the number of years and financial investment made to the property. In reliance on all of the above permits, the house was started in 2014. The modular home was quickly placed on the property and the owner has:invested more than 1.7 million dollars on this property. Once the owner's rights have vested no definition change is applicable to this application. Even if the Board could apply the 2017 wetland code, the Bluff definition does not apply to the development of the subject property. BLUFF Land presenting with a precipitous or steeply sloped face adjoining a beach or a body of water. For the purposes of this chapter, a precipitous or steeply sloped face shall be a face with a slope of 20% or greater and a height of greater than 20 feet between the toe of the bluff and the top of the bluff. [Amended 5-9-2017 by L.L. No. 8-20171 BLUFF-LINE ! �-- --- APR ® 9 2019 L --- -- 1 -own The landward limit of a bluff that is 25 feet landward of the receding edge or, in those cases where there is no discernible line of active erosion, 25 feet landward of the point of inflection on the top of the bluff. The point of inflection is that point along the top of the bluff where the trend of the land slope changes to begin its descent to the shoreline. The bluff remains facing the Long Island Sound, as the line identified and delineated by En-Consultants in 2007. That line is where the "precipitous or steeply sloped face,adioins:a beach,or-a-body of watex". The bluff, as delis( by En-Consultants is`consistent with the cur'r'ent definition of a "Bluff'. The sides of the parcel which adjoin the I-lomeowner's are not a bluff because 1. They do not face the adjoining beach or body of water and 2. The slope must be BOTH more than 20% (yes- there is a 25% slope in the land) AND a height greater°#fan 20 feet. The side yards do not have a "toe", do not face the Long Island Sound and the height of the side yard slopes is less than a 20' height. A "Bluff' equxes that the two conditions must be met, therefore, the land does not meet the definition of a `Bluff'. My client has been seeking a wetland permit for the rear yard for ovftwo years. We will meet the Board at the next field inspection. I am always optimistic that we can find a reasonable solution, however, if this matter cannot be worked out, my client will have no further options then to seek relief from a Court. We accessed the property over a narrow trail cut through the brush in a manner that extended from the road to the top of bluff. In addition, survey stakes were provided to indicate the, proposed location of the new residence.. Please consider the following information: 1. Existing Covenants filed with the County for this subdivision prohibited the construction of any portion of a dwelling that would be less than one hundred(100)feet from the top of bluff.This Top of Bluff is a natural protective feature and the structural integrity of property located immediately behind the top of bluff should be protected. Due to the fact that original C&R's have already established this setback, it is recommended that we remain consistent, and continue to require this setback from top of bluff. (Please Note: the ZBA should also address whether or not the cantilevered second floor deck should be part of this setback) 2. Previously issued Trustee Permits for this site have expired. However, in addition to the setback noted above,the said Trustees Permit also required a fifty(50)foot Non-Disturbance Buffer located immediately adjacent to and running parallel with the top of bluff. The establishment of a 50' non-disturbance buffer is recommended to protect the integrity of the existing bluff. 3. Any soil disturbance that would direct stormwater runoff over the top of bluff would not be permitted by Town Code and could destabilize the bluff itself. Existing conditions and/or site contouring does not currently allow or direct surface runoff in this direction. Therefore, it is recommended that substantial grade changes (over 12" +i-) not be allowed within the 100' setback area between the proposed new structure and the existing bluff line 4. The site,plan provided indicates the location of a new dwelling where the existing grade at the northwesterly corner would be at elev.35.5'. The opposite side or the northeasterly corner of this dwelling will be near the 51' contour. If the finish first floor is located at orabove this 51'. elevation,the distance to grade will be in excess of twelve(12')feet. If the first floor is 12 feet or more above grade at any point,the NYS Building Code would considerthe lower basement level to be a"story'. There is an existing encroachment along the easterly property line that consists of fill,topsoil, lawn area and what could even be some portions of the chain link fencing associated with the adjacent residence. In addition,there is a 6'diameter plastic drainage pipe extending out into the property currently under review. This pipe appears to be connected to a leader extending down from the adjacent roof.
