c.The work covered by this application may not be commenced before issuance of Building Permit.
d.Upon approval of this application,the Building Inspector will issue a Building Permit to the applicant.Such a pen-nit
shall be kept on the premises available for inspection throughout the work.
c.No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f.Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date.If no zoning amendments or other regulations affecting the
property have been enacted in the interim,the Building Inspector may authorize,in writing,the extension of the permit for an
addition six months.Thereafter,a new permit shall be required.

in the early 1900's. The cottages previously aroused employees of the Sage family brick factory, and after the
brickyard closed,they were rented as seasonal cottages. In 2000,a real estate coo'perativc,Breezy Shores Community
Inc. was established, and shares were of"f"ered as an ownership interest in the Cooperative. The cottage at issue in
this application is ,known as Cottage f/ 161 , as shown on a survey prepared by Toward W'. Young, L.S. dated
December 12, 2013 and a Site Plan of Breezy Shores, showing proposed improvements of 17 ski. ft, prepared by

community will have an adverse impact on the physical or environmental conditions in the neighborhood. The
applicant must comply with Chapter 236 of the`fown's Storm Water Management Code.
5. "Gown Law26?-1z I b The difficulty has been self-created since the applicant purchased the parcel after
the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the
limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of°purchase. However,to
the extent that a seasonal structure such as this one periodically requires some degree of recons ction and/or
alterations to continue the safe use of the structure,the need for variance relief is not self-created, but is created by
Zoning Code that now prohibits an existing use and activities that at one time were not prohibited.

Dear Mr. Uellendahl:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, April 14, 2021 regarding the above matter:
WHEREAS, Frank Uellendahl, R.A. on behalf of PETER & VALERIE SAKAS applied to
the Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated March 9, 2021, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, in accordance with Chapter 268, said application was found to be Exempt
from the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on April 14, 2021, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of PETER & VALERIE
SAKAS to construct a 5'0"x3'5" addition to the existing 577sq.ft. seasonal cottage;
replace windows; existing 17"x48" steps into the sunroom will be removed and the new
entry will be relocated to the north wall of the sunroom with a 36"x50" landing with
12"x50" entry steps; and raise the sunroom roof and extend 5'0" to create a dormer and
to cover new landing and steps; with the condition of gutters to leaders to drywells; and
as depicted on the site plan prepared by Frank W. Uellendahl, Registered Architect,
received on March 9, 2021, and stamped approved on April 14, 2021.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of$50.00 per inspection. (See attached schedule.)
