Any revision to the above approved documents identified in item (c) ofthis condition or to the
operations at this site requires prior written approval from the Departi-rient. The permittee shall not add a
facility component that would otherwise quality as an exempt or registered facility, unless the permittee
First receives a modified permit to incorporate the additional component of the operation.
If any of the above documents conflict with any condition of this permit, the permit condition shall
prevail.
3. Mitigation ofAdverse Impacts The Department may impose rriore stringent operating
requirements, if in the Department's sole jUdgment, it is deemed necessary. Upon written notice by the
Department, the permittee shall immediately comply with the more stringent conditions. Ifunacceptable
nuisance or odor conditions occur, the Department reserves the right to decrease the permitted capacity
to a level satisfactory to the Departi-rient.
The Department reserves the right to change the materials that may be accepted at the facility at any
time, Upon written notification by the Department, the permittee shall immediately cease acceptance of
any materials that the Departrnent has deemed unacceptable.
This permit is issued with the expressed understanding by the permittee that the permittee must
immediately, upon notification by the Department, change the quantities of yard waste accepted. at this
facility. Such changes shall be implemented without prior hearing orjudicial review, upon receipt of
written notice from the Department that there exists at or emanating from the facility, odors at magnitude
that, in the sole discretion of the Department, justify such a modification.
4. Authorized Activity The permittee is authorized to operate a solid waste management facility for the
following:
a. Transfer facility receiving up to 5,000 tons per year of construction and demolition (C&D) debris,
25,000 tons per year of municipal solid waste (MSW), and 6,000 tons per year of recyclables.
b. Compost facility receiving up to 18,000 tons per year of yard trimmings consisting of leaves, brush,
tree limbs, stumps, and other vegetative yard trimmings. The annual throughput includes up to 1,000
gallons per week of liquid brewery waste.
5. Unacceptable Wastes The permittee is prohibited firom accepting the following type(s) of waste:
liquid waste, except used oil from do-it--YOUrsel foil changers and liquid brewery waste; hazardous waste,
except for batteries, mercury thermostats, fluorescent light bulbs, e.-waste, and household hazardous
waste collected during a Department approved collection event; medical waste; friable asbestos..
containing waste; industrial waste,-, sewage Sludge; and septage.
,I I he perinittee shall also riot receive any load of NISW which contains source separated recyclables that
have been commingled with MSW.

6.. Waste Handling Requirements Specific to Transfer Activities The permittee shall comply with
the following requircments;
a. All activities for MSW and recyclables, including but not limited to loading, unloading, sorting,
processing, and storage, shall be performed inside the enclosed building. This does not apply to scrap
metals and white goods.
b. Scrap rrictais, white goods, and C&D debris rnay be handled outdoors. E waste shall be stored inside
an enclosed weather proof storage container.
c. At the end of each workday the facility and tipping areas shall be cleaned of any solid waste. A.11
overnight storage of solid waste shall be in its respective storage area.
d. MSW shall not remain at the facility for more than '7 days. Recyclables shall not be at the facility .for
more than 60 days. C&D debris shall not remain onsite for more than 30 days. E-waste shall not rernain
onsite for more than I year.
7. Maximum Quantity Onsite for Transfer Activities The permittee shall not exceed the following
quantities onsite:
a. 800 cubic yards of MSW,
b. 1160 Cubic yards of recyclables and scrap metal, including e-waste.
c. 1800 cubic yards of C&D debris.
d. 300 cubic yards of seashells.
e. 100 cubic yards of tires.
f. 200 cubic yards of animal carcasses decaying in a segregated area contained in mulch.

8. Waste Handling Requirements SpC
Specific to Yard Waste omposting The permittee shall ensure
this activity confon-ns to the following requirements:
a. A maximum of 12 acres of the 17 acre site may be used For composting.,
b. Yard waste shall not be accepted in plastic bags. If a resident transports yard waste to the facility in a
plastic bag, it must be immediately removed from the bag at the proper unloading area. A container must
be available to the residents for discarded bags.
c. Horse rnan.ure may be nn fixed with.the y-aird urirn.n.n.rigs during cornposting. Soil ri-niy also be u[scd for
topsoil production.
d. Windrows shall have rnaximurn dimensions of"10 fled in height, it fieet wide at the top, and 20 fleet
wide at the base. Unless oltierwise approved by the Deparlmeii-it, ffie minirnum separation distance of
windrows sliaH be no less dian S' feet, rneiasured at the t.)ase ofthe windrow.

e If the permittee receives unadulterated wood pallets for use as a bulking agent, these must be inspected
at the tirne of delivery, Any material other than unadulterated wood pallets must be separated at the time
of delivery and sent to a properly authorized disposal facility.
f. The permittee shall take temperature readings ofthe windrows at a frequency to be determined by the
best professional judgment of the facility operator to ensure odors are prevented and a quality product is
produced in an efficient manner, The Department reserves the right to require additional temperature
readings be taken.
I;. Windrows shall be turned on a schedule that is based on the best professional j udgment ofthe facility
operator. This schedule must take into account temperature readings, moisture content, windrow age,
climatic conditions, and minimizing offisite dust and odors.
h. Mature compost shall not remain onsite for more than 24 months,
i. Liquid brewery waste may be mixed with water prior to applying to compost windrows. Liquid
brewery waste must be utilized within the week. of receiving and cannot be used for dust control.
9. Hours of Operation I fours of operation shall not conflict with any local laws or ordinances. The
pen nittee shall limit the hours and days off operations from 7:00 AM to 5-00 PM, seven days per week.
The permittee may request hours of operation be extended on a daily basis to expediate processing of
yard waste due to seasonal increases.
io. Signs The permittee shall post signs showing hours oloperation, and indicating that:hazardous
waste, industrial waste, medical waste, liquid waste, and asbestos waste are prohibited from being
accepted at the facility. The signs shall be located. so that they are visible to any vehicles and/or person
approaching the facility.
11. Waste Control An attendant shall be on duty during all hours of operation, The attendant shall
inspect all vehicles entering the facility, rejecting any loads containing unauthorized material.
12. Control of Nuisance Conditions Odors, dust, insects, vectors, noise, blowing litter and other
potential nuisances shall be adequately controlled at all times. The permittee shall immediately
implement any controls required by the Department including cessation of facility operations. The
following additional requirements apply to yard waste:
Unacceptable odor releases shall be those determined solely by the Department to be
excessive or avoidable. In the event that incoming material creates unacceptable odor
releases, the Department may direct the yard waste that is not in the windrow fileld be
immediately transferred off site to an alternate authorized solid waste management
facility.
Any material onsite which is determined by the Department to be causing unacceptable
odor releases to the surrounding community shall be treated with an oxidant, mixed with
additional bulking agent, or removed to an alternate authorized solid waste management
facility.

01 Fire Protection and Detection The permittee shall maintain tire protection and detection
equipment in accordance with local laws and ordinances.
14. Cessation of Operations The permittee shall verbally notify the Department within 18 hours of any
occurrence ofany event which causes the facility to cease operation for as period of 48 hours or more.
Such an event world include a fire, spill, equipment breakdown, or similar event. A written report shall
be submitted to the Department within 7 days of the event.
15.. Ultimate Disposal of Waste All solid waste passing through the facility must be beneficially used,
or ultimately disposed of at a facility authorized by the Department if located in New York State, or by
the appropriate governmental agency or agencies if in other states, territories, or nations.
16. Unauthorized Waste In the event that any hazardous waste, medical waste, or other regulated
waste not allowed under this permit is accepted at thefficility, the unauthorized waste shall be contained
and properly secured immediately. The perr.nittee shall notify the Department and the Suff'olk County
Department of Health Services within 24 hours of the event. The waste material shall be removed by a
waste transporter authorized under 6 NYCIRR Part 364 to transport Such waste. A written report shall be
Submitted to the Department within 7 days of the event.
17. Small Spill Containment The facility shall keep available at the site equipment and materials
necessary to contain small quantities of chemicals or spills. J'hese materials shall be stored in well
identified accessible storage areas. As as minimurn, the following must be available at all times:

400 tbs, absorbent material (e.g. Speedi.-Dri)
50 tbs. Boric Acid
50 lbs, Sodium Bicarbonate
Assorted broorns, shovels, gloves, masks, and other protective gear
18. Maintenance and Repair ref'Il The pennittee shalt adequately maintain and make repairs to
the facility as necessary. This includes any part of the facility, such as doors to buildings-, odor and dust
controls and equipment, punctures, holes, or other damage to buildings; minimizing the ponding of
stormwater; keeping recharge basins in a free draining condition at all times; and concrete and/ or
asphalt pavement that becomes damaged or worn.
Tfic permittee shall undertake all repairs immediately and have all work completed within one week.
Repairs related to dust or odor controls must be completed within 24 hours. If the permittee is unable to
complete repairs within the specified time outlined by this condition, the permittee shall provide an
acceptable schedule to the Department which shall include a description of the work to be completed and
any controls that will be implemented to ensure the facility remains in compliance with this permit,
inclUding the cessation of all or part of the facility operations.
19.. Comprehensive Recycling Analysis Within respect to MSW, the permittee must not accept waste
from New York State that is generated within a municipality that is not included in a department-
approved comprehensive recycling analysis (CRA) or a department-approved local solid waste
mana(l.lement plan (LSWMP).

20. Recordkeeping Requirements The perrnittee shall rnaintain the following records at the facility for
a minimum of 7 years from the date of creation and be available immediately to the Departryient upon
request:
a. Daily log of solid waste received and tram,sported From the facility which includes:
i. Type, quantity, and origin of the solid waste received, inclUdIng bulking agents for cornposting
operations.
ii. Quantity and destination of all recyclables.
iii. Quantity and destination of`all non-recyclables and residuals transported for disposal.
b. All weight: tickets, hauling receipts, disposal receipts, invoices, tracking documents, etc. to support
entries made into the daily log.
c. The following related to the composting operations:
i. Date of windrow formation and windrow composition ofall windrows constructed. For
windrows containing similar cornposition of rnaterial, one may be chosen as a representative
windrow.,
ii. Temperature readings of windrows with date taken,
iii. Date of windrow turning for each windrow.
iv. Results of compost product sampling.
21. Reporting Requirements The permittee shall comply with the following reporting requirements:
a. Within 60 days of conducting sampling, the permittee shall submit the compost product sampling
analysis results.
b. By March P of each year, the permittee shall submit the annual report on forms prescribed by or
acceptable to the Department for all solid waste management facility operations. The report for the
cornposting activity must include, at a minimum:
i. The type and quantity, by weight and volume, of waste received at the facility,
ii.The quantity, by weight and volume, of total compost produced.
iii.Any monitoring that occurred during the operation.
iv.The quantity, by weight or volume, of compost removed from the facility.
v. The end ofperiod volumes of finished compost and bulking agent stored on.-site.
v. A description cif the end.-product distribution.
c. All reports must be provided to the Region I Office at New York State Department of Environmental
Conservation, Division of Materials Management, 50 Circle Road, SUNY (4� Stony Brook, NY 11790.

h. The environi-riental monitor shall, when present at any of,the permittee's facilities, abide by all of the
permittee's health and safety and operational requirements and policies, if such requirements and
policies exist and provided they are not inconsistent with Department policies and labor mariagement
contracts, and further provided, however, that this shall not be construed as limiting the environmental
monitor's powers as otherwise provided for by law and shall riot result in the environmental monitor
being afforded less protection than otherwise provided to the environmental monitor by State and
l"ederal health and safety requirements.
i. The environmental monitor shall receive frorn the permittee all general and site specific safety training
which is normally given to new facility/site employees for all areas of the facility or site. This training
will be a supplement to the health and safety training that the environmental monitor routinely receives
f'rom the Department.
j. The permittee shall immediately furnish to the environmental monitor any Facility/site health and
safety and operational requirements and policies. Within five (5) days of any revision to the facility/site
health and safety and operational requirements and policies, the permittee shall furnish to the
environmental monitor the health and sa:ilety and operational requirements and policies.
k. The environmental monitor shall be permitted to use environmental monitoring and data collection
devices (e.g., photo ionization detectors, cameras, video recording devices, computers, cell phones, etc.)
deemed necessary by the Department to evaluate and document observed conditions. The permittee may
request the data and images collected frorn areas where confidentiality is a concern be considered
confidential information if appropriate. Copies of the data or images collected from areas where
confidentiality has been determined to be a concern shall be provided to the permittee.

GENERAL CONDITIONS - Apply to AL LAuthorized Permits:
1, Facility Inspection by The Department The permitted site or facility, including relevant records, is
subject to inspection at reasonable hours and intervals by an authorized representative of the Department
of.Environt-riental Conservation (the Department) to determine whether the permittee is complying with
this permit and the ECL. Such representative may order the work suspended pursuant to EIEL 71 0301
and SAPA 401(3).
The permittee shall provide a person to accompany the Department's representative during an inspection
to the permit area when requested by the Department,
A copy of this peri-nit, including all referenced maps, drawings and special conditions, must be available
for inspection by the Department at all times at the project site or facility. ['ailure to produce a copy or
the permit upoi-i request by a Department representative is a violation of this permit.

2. Relationship of this Permit to Other Department Orders and Determinations Unless expressly
provided for by the Department., issuance of this permit does not modify, supersede or rescind any order
Apr determination previously issued by the Department or any of the terms, conditions or requirements
contained in such order or determination.
3. Applications For Permit Renewals, Modifications or Transfers The permittee must submit a
separate written application tel theDepartment :for permit renewal, modification or transfer ofthis
permit., Such application must include any borms or supplemental information the Department requires.
Any renewal, modification or transfer granted by the Department must be in writing. Submission of
applications for permit renewal, modification or transicr are to be submitted to:

4. Submission of Renewal Application The permittee must submit a renewal application at. least 180
days before permit expiration for the following permit authorizations: Solid Waste Management.
5. Permit Modifications, Suspensions and Revocations by the Department The Department
reserves the right tel exercise all available authority to modify, SUspend or revoke this permit. The
grounds for modification, suspension or revocation include:
a. materially false or inaccurate statements in the permit application or supporting papers;
b. failure by the permittee to comply with any terms or conditions of the permit-,
c. exceeding the scope of the project as described in the permit application;
d. newly discovered materiap information or a material change in environmental conditions, relevant
technology or applicable law or regulations since the issuance of the existing permit;
e. noncompliance with previously issued permit conditions, orders of the commissioner, any
provisions of the Environmental Conservation Law or regulations of the Department related to
the permitted activity.
6. Permit Transfer ilermits are transferrable unless specifically prohibited by statute, regulation or
another permit condition. Applications for permit transfer should be submitted prior to actual transfer of
ownership.

NOTIFICATION OF OTHER PERMITTEE OBLIGATIONS
Item A® Permittee Accepts Legal Responsibility and Agrees to Indemnification
The permittee, excepting state or federal agencies, expressly agrees to indemnify and hold harmless the
Department of Environmental Conservation of the State of New York, its representatives, employees,
and agents ("DEC") for all claims, suits, actions, and damages, to the extent attributable to the
permittee's acts oro issions in connection with the permittee's undertaking of activities in connection
with, or operation and maintenance of, the facility or facilities authorized by the permit whether in
compliance or not in compliance with the terms and conditions of the permit. This indemnification does
not extend to any claims, suits, actions, or damages to the extent attributable to DEC's own negligent or
intentional acts oromissions, or to any claims, suits, or actions narning the DEC and arising under
Article 78 of the New York Civil Practice Laws and Rules or any citizen suit or civil rights provision
under federal or state laws.
Item B: Permittee's Contractors to Comply with Permit
The permittee is responsible for informing its independent contractors, employees, agents and assigns of
their responsibility to comply with this permit, including all special conditions while acting as the
permittee's agent with respect to the permitted activities, and such persons shall be subject to the same
sanctions for violations of the Environmental Conservation Law as those prescribed for the permittee.
Item C'® Permittee Responsible for Obtaining Other Required Permits
The permittee is responsible for obtaining any other permits, approvals, lands, easements and rights-of-
way that may be required to carry out the activities that are authorized by this permit.
Item D: No Right to Trespass or Interfere with Riparian Rights
This permit does not convey to the permittee any right to trespass upon the lands or interfere with the
riparian rights of others in order to perform the permitted work nor does it authorize the impairment of
any rights, title, or interest in real or personal property held or vested in a person not a party to the
permit.
