RELIEF REQUESTED: The applicant requests a variance to construct an accessory garage in the front yard where code requires that accessory structures be located in the rear yard. - AMENDED SURVEY: During the hearing on March 5, 2020, the applicant was asked to move the location of the proposed accessory garage farther away from the road by creating a larger front yard setback. The applicant, on June 30,2020, submitted a new survey increasing ffefront yard setback om a ormgina y proposefeet o feet from the front property line,thereby mitigating the visual impact of the proposed front yard location. On August 10,2020, the applicant submitted a survey prephred by Harold F. firanchon,Jr.,L.S. last revised August 5; 2020 depicting a proposed,garage setback 32 feet from the front yard property line and 10 -fest from ffie side-yard property-Rine, measuring 1'8 feet-X 22 feet-and showing a row of evergreen plantings.Again on.August 19, 2020, the applicant submitted a revised survey, last revised August-1.9,2020,-depicting the location J of'dry wells. ADDITIONAL INFORMATION: On August 19, 1980, a prior owner was granted relief pursuant to NYS Town Law 280-a for access to a town road. The-applicant's representative submitted comparable prior variances granted by the Board of Appeals for accessory structures in a front yard in the subject neighborhood: #6424,November 16,2010, 1060 North View Drive,alternative reliefwas granted with conditions for an art studio located in the front yard. #7031, March 16, 2017, 370 Sound View Drive; a variance for an in-ground swimming pool located in the front yard was granted. 47035, March 16, 2017, 1315 Hillcrest Drive, a'variance for an as built pergola located in the front yard was granted. #7083, October 5, 2017, 455 North View Drive, variances for construction of a pool house and,in-ground swimming pool located in'the front yard was granted. FINDINGS OF FACT/RgASQNS:FOR BOARD A _N: - -The Zoning Board of Appeals held a public hearing on this application on March 5,2020 and July 9,2020,at which time written-and oral evidence were presented. Based upon all testimony,-documentation,personal inspection of i the property,and surrounding neighborhood,and'other evidence,the Zoning Board finds the following facts to be true and relevant:and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variance relief as applied for and shown on the amended survey will not produce an,undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single-family homes. North View drive is a private road and the applicant's house is the f last property on the end of the road. Only one other property owner would drive past the garage to get to their house. There are accessory garages in the front yards on lots across the street from the applicant's lot, Moreover, i while the proposed garage is located 32 feet from the front yard line the road itself is located an additional 24 feet from the applicant's property making the garage setback close to 56 feet from the edge of the pavement. 2. Town Law§2.67-b(3)(b)(2)? The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant could attach*the garage to the house or build an accessory garage in a conforming rear yard location. However,the parcel is very slopped,becoming higher toward the rear of the property, so the applicant would have-to build retaining walls and excavate substantially in order to build the garage and the driveway entering the garage, if located in a conforming rear yard. 3. Town Law $267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 100% relief from the code. However, the applicant's parcel is located at the dead end of a privateround-is no visit le to public view, and there are other accessory structures in the neighborhood that have also received relief for a non- ' conforming front yard location. i I i . s I Page 3,August 20,2020 #7379, Solutions East SCTM No. 1000-13-3-1 4. Town Law &267-bQ)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 6267-bQ(b)(Q. The difficulty has been self-created. The applicant removed the existing garage when it renovated the house. Further,the applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law $267-b. Grant the relief as applied for and shown on the amended survey last revised August 5, 2020 is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory garage in the front yard while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes, seconded by Member Planamento, and duly carried,to GRANT the variance relief as applied for wand shown on the amended survey prepared by Harold F. Tranchon,Jr. P.C,Land Surveyor;last revised August 19,2020 SUBJECT TO THETOLLOWING CONi3ITION: 1. The applicant must submit revised architectural drawings for the proposed 16 feet by 22 feet accessory garage as shown on'the amended survey cited above Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, -or demolitions, are not authorized under this application when involving nonconformities under the zoning code.
