SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated March 29, 2021 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject, non-conforming, 3,989.89 square feet, .092 acre, rectangular- shaped parcel located in the R40 Residential Zoning District measures 57 feet along Village Lane,then runs west 70 feet along a residentially developed lot to the south,then runs north 57 feet along a residentially developed lot to the west and returns 70 feet along the same residential lot. The parcel is improved with a one-and one-half story,wood- frame house with wood front porch and entry steps, an existing rear porch, concrete stoop, concrete walkway and concrete driveway as shown on the survey prepared by Ralph Heil,Licensed Land Surveyor and dated December 28, 2020. BASIS OF APPLICATION: Request for Variances from Article XXIII, Section 280-124; and the Building Inspector's February 24,2021 Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing single-family dwelling; at 1)located less than the code required rear yard setback of 35 feet; 2) more than the code permitted maximum lot coverage of 20%; located at: 130 Village Lane, Orient, NY. SCTM No. 1000-18-5-6. RELIEF REQUESTED: The applicant requests variances for alterations and additions for the renovation and restoration of an existing single-family residence including the conversion of an existing 107 square feet rear porch, measuring 7.7 feet by 14 feet, into habitable living space along with the extension of the house,"squaring it off',by an addition measuring 7 feet by 7.7 feet of additional living space. As a result of the addition, existing lot coverage will increase from 25.35%to 26.72% where the Code limits such improvements to 20% and the required rear yard setback of 35 feet will be maintained at a pre-existing 21 feet setback. Page 2,June 17,2021 #7497,Ramone SCTM No. 1000-18-5-6 ADDITIONAL INFORMATION: The subject property is listed on the Southold Town, New York State and National Registers of historic places; as such the proposed construction is subject to Historic Preservation Commission approval, pursuant to Section 170 of the Southold Town Code. Town of Southold Historic Preservation Commission Resolution#10.22.20.1, Certificate of Appropriateness, dated October 22, 2020 was submitted by the applicant. The subject residence is in need of repair and restoration for the occupants' comfort and to ensure it will be preserved for the benefit of the community. An earlier application for a substantial renovation and expansion was denied in 2010 by the Historic Preservation Commission. Several neighbors wrote letters of support prior to the public hearing. No other neighbors or members of the public spoke in favor of or against this application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 3,2021 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood,and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Village Lane is a north/south town road leading to the Peconic Bay from Main Road/Route 25. It is narrow and was developed prior to current zoning with most properties developed in the late 18"or early 19th century on small,irregular lots. Once a`fishing village',where residents relied on the sea, today it is a listed historic place with homes and commercial properties lovingly maintained to ensure preservation of the areas regional, cultural and architectural heritage. The applicant has designed a project that is respectful to the historic attributes of the house and will not substantially increase the degree of non-conformity. The project has been reviewed by the Southold Historic Preservation Committee, which approved a Certificate of Appropriateness on October 22, 2020,Resolution#10.22.20.1. 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. The existing lot is highly constrained due to its size and the existing single-family residence is similarly constrained by its historic nature, which is subject to the regulation of the Town's Landmarks Preservation Code. As such,it is not possible to create additional living space by construction a second story addition. This means the proposed location of the addition is the minimum needed to convert the existing porch into habitable space as it will square off the western and southern elevations to create architectural unity with the rest of the house. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial,representing 40%relief from the code relative to the reduced rear-yard setback and 33.6% relief from the allowable lot coverage. However, the proposed addition will be no closer to the rear property line than the existing western portion of the house which is currently situated at 21 feet from the rear property line. Similarly,the lot coverage variance is the minimum needed to square off the rear portion of the house. The difference between the pre-existing lot coverage of 25.35% and the proposed lot coverage of 26.72%is 1.37%,which represents the addition of approximately 61 square feet of footprint for added habitable living space. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law&267-b(3)(b)(5). The difficulty has not been self-created. The structure was built prior to zoning and was in the applicant's family ownership since prior to the establishment of the Code. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of alterations and additions to a single-family home consisting of the conversion of a rear-porch measuring 7.7 feet by 14 feet into habitable living space, along with an expansion of the house by 7 feet by 7.7 feet in order to`square it off'while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13,motion was offered by Member Planamento,seconded by Member Weisman(Chairperson), and duly carried,to GRANT the variances as applied for, and shown on the survey prepared by Ralph Heil, Licensed Land Surveyor and dated December 28, 2020 and the Architectural Drawings labeled Al & A2 (Floor Plans and Elevation Plan) prepared by Frederick R. Weber,Registered Architect last revised October 1,2020. SUBJECT TO THE FOLLOWING CONDITION: Condition for Possible Demolition, if applicable 1. Prior to receiving a building permit,the owner(s)of the subject property cited herein must sign a statement acknowledging: a. That the applicant(s) have read this determination and understand the limits of the variance relief granted herein; b. That the applicant(s)will immediately contact the Building Department if a demolition, as defined by Section 280-4 of the Town Code,' occurs during construction, or any construction undertaken in any other way exceeds the scope of the approvals granted herein, or the issued building permit; c. That the applicants are aware that the Zoning Board of Appeals retains jurisdiction until the issuance of the Certificate of Occupancy and has the right, after a public hearing,to modify, suspend or revoke such approvals or any term or condition thereof or to impose thereon one or more new conditions,pursuant to Article XXV, Section 280-141 of the Town Code. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appealsfailure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. NOTE: Section 280-4 of the Town Code defines"Demolition"as any removal of a structure or portion thereof,where the total cost of the reconstruction of the structure or portion thereof exceeds 50%of the market value of the existing structure before the start of removal. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Applicant has designed a project that is respectful of the historic attributes of the house and will not increase the degree of nonconformity. The project has been reviewed by the Southold Historic Preservation Committee,which approved a Certificate of Appropriateness on October 30,2020. See Exhibit A to this Rider. 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: The benefit sought by the applicant,which is to have additional living space in order to make the residence more livable by modern standards cannot be achieved by any other method other than an area variance. The existing lot is highly constrained due to its size, and the existing single-family residence is similarly constrained by its historic nature,which is subject to the regulation of the Town's Landmarks Preservation Code. As such, it is not possible to create additional living space by constructing a second story addition. This means that the proposed location of the addition is the minimum needed to convert the existing porch into habitable space as it will square off the western and southern elevations to create architectural unity with rest of the house. 3. The amount of relief requested is not substantial because: As stated above,the relief requested for the rear yard variance is not substantial because it is the minimum needed and the proposed addition will be no closer to the rear property line than the existing western portion of the house which is current situated 21.0 feet from the rear property line. Similarly,the lot coverage variance is not substantial and is the minimum needed to square off the rear portion of the house. The different between the pre-existing lots coverage of 26.35 %and proposed lot coverage of 26.72%is 1.37%,which represents the addition of approximately 55 square feet to existing lot coverage. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: As a Type II action pursuant to SEQRA,the requested variances if granted, are not expected to have any adverse environmental impacts on their neighborhood or district. Moreover,approval of the project by the Historic Preservation Committee ensures that there will be no deleterious impacts on the physical or cultural values of the neighborhood and the historic district. The 1974 SPLIA ISociety for the Preservation of L.1. Antiquities,survey indicates a narrow entranceway; wide floor boards upstairs; a non-working fireplace with an arm for pots in the kitchen; and original woodwork around the fireplace and door jambs. • The property is significant within the context of other properties in the Orient Historic District which together reflect the growth of the early village from a farming and fishing community to a prominent year round and summer residential district. • The property, although altered over the years to be relevant for its time, remains a fine example of a simple workman's home. It adds diversity to the Village Lane streetscape. • 130 Village Lane anchors the entrance to the Orient National Historic District. There are few examples of this type and size home left in Orient. Its demolition would significantly change the character of Village Lane. Item (3) The landmark is of such old and unusual or uncommon design, texture and material that it could not be reproduced or be reproduced only with great difficulty. • Although not historically significant because of its design, its type-,a small, rather plain and unadorned workman's or fisherman's home of the mid-19th century—makes it an important contributor to the overall streetscape and history of Village Lane. Granted, it could be reproduced without great difficulty. It should be noted here that the owners'original application was to considerably increase the size of the house,thus significantly altering the streetscape as the visitor enters the historic district. Zoning 130 Village Lane is a registered landmark property and a contributing element of the Orient National Historic District. As such, it significantly contributes to the general historic ambience and attractiveness of not only Orient village, but also the entire Town, especially as visitors arrive from the East off the ferry. Item (5) Retention of the landmark will help promote the general welfare by maintaining and increasing real estate values and encourage interest in local history and architecture. • Properties in Orient, especially in the historic district, continue to be sought after as both year round and summer homes. Even in the current depressed real estate market, prices in Orient have generally not decreased and some have even increased over non-historic properties. Visitors continue to visit the museums of the Oysterponds Historical Society and patronize their programs on Orient history.As a registered landmark, 130 Village Lane contributes to the overall attractiveness of the hamlet that draws new home owners and visitors to the area. • The official policy of the Landmark Preservation Commission is to not permit demolition of a landmark structure unless there is no prudent alternative. The Commission cannot allow a registered landmark to be demolished under circumstances where the structure can be renovated and altered to accommodate the needs of an applicant. • The Commission notes that there is a design altemative(See Town of Southold Landmarks Preservation Commission (LPC) Handbook, Part 11: Design Guidelines for Appropriate Design in the Historic Context)and that the owners can accomplish their goals without demolishing this historic structure.
