Cutchogue, NY 11935 RE: STEPHENSON RD., ORIENT SCTM#17-1-2.2 Dear Mr. Edson: The Board of Trustees took the following action during its Regular Meeting held on Wed., September 21, 2005 regarding the above matter: WHEREAS, LEWIS L. EDSON applied to the Southold Town Board of Trustees for a permit under the provisions of the Wetland Ordinance under Chapter 97 of the Town Wetland Code and Chapter 37 of the Town Code of the Town of Southold, application dated August 30, 2005, and WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, at the meeting held on September 21, 2005 the Board of Trustees advised the applicant that a sanitary,system is not allowed under Chapter 37 in a BEACH area, under 37-15D and, that Chapter 37 would not allow a permit to be granted for this portion of the project, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on September 21, 2005, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, r 2 WHEREAS, this application is for a sanitary system within the Coastal Erosion Hazard Area, as defined in Chapter 37, and, WHEREAS, under Chapter 37, sanitary systems are not permitted within the Coastal Erosion Hazard Area, and, WHEREAS, the proposed sanitary system is to be installed in the BEACH area adjacent to Long Island Sound, and, WHEREAS, under Chapter 37-15D "All development is prohibited on beaches unless specifically provided for by this Chapter" and, WHEREAS, a sanitary system in a BEACH area is not specifically provided for under Chapter 37, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, NOW THEREFORE BE IT RESOLVED, that the Board of Trustees DENY WITHOUT PREJUDICE the application of LEWIS EDSON to install a sanitary system within the Coastal Erosion Hazard Area because of the above reasons and determinations, BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency, with may also have an application pending for the same or similar project. The property is found on CEHA Map 18 of 49 maps that cover the CEHA jurisdiction in the Town of Southold. Coastal Erosion Management Regulations (6 NYCRR Part 505) subpart 505.10 lists the criteria for appeals of erosion hazard areas. As stated in 6 NYCRR Part 505.10(e), The sole acceptable basis for an erosion hazard area designation appeal is technical information indicating that: (1) the long-term average annual rate of shoreline recession was incorrectly established; or (2) the subject area was erroneously identified as a natural protective feature area. The appeal challenges the determination of the subject area as a natural protective feature since there are no long-term average annual rates of shoreline recession established for this area. After visiting the site, it is apparent that the subject area was erroneously identified and that the CEHA line needed to be moved to reflect the appropriate landward limit of the natural protective feature. The property located to the east of your lot contains a bluff for which the CEHA line is placed accordingly. The property to the west contains a beach as the most landward natural protective feature. Your property transitions from the low lying beach area located to the west on up to the beginning of a bluff that continues along the shore to the east. The mapped CEHA line that traversed your property picked up an inland feature that is not considered a bluff. The new line represents the appropriate setback for a beach,the most landward natural protective feature found on the property. The fronting beach contains an area of debris with intermittent and sparse vegetation that is temporary in nature. Towards the back of the beach is the line of permanently established vegetation from which a 100 foot setback has J� 7 been used for the placement of the revised CEHA line. The CEHA line is now properly located per the definition of beach as found in town code and as per 6 NYCRR Part 505.2(c). This line follows the setback for the beach until it picks up the bluff setback to the east. Enclosed is a copy of the new CEHA map 18 of 49 for the Town of Southold.
