No debris is permitted in wetlands and/or protected buffer areas. 8. No Disturbance to Vegetated Tidal Wetlands There shall be no disturbance to vegetated tidal wetlands or protected buffer areas as a result of the permitted activities. 9. Storage of Equipment, Materials The storage of construction equipment and materials shall be confined within the project work area and/or upland areas greater than 75 linear feet from the tidal wetland boundary. 10. Clean Fill Only All fill shall consist of clean sand, gravel, or soil (not asphalt, slag, flyash, broken concrete or demolition.debris). 11. No Beach Excavation For Fill No excavation of the beach is authorized for the purpose of obtaining fill or stone materials. 12. Backfilling All peripheral berms, cofferdams, rock revetments, seawalls, gabions, bulkheads or other approved shoreline stabilization structures shall be completed prior to placement of any fill material behind such structures. 13. No Equipment below Apparent High Water Equipment operation below (seaward) apparent high water is strictly prohibited. 14. Plant Beach Grass American Beach Grass must be planted 12 inches on center on all restored seaward beach slopes. 18 inch centers may be used on landward slopes and level grades. The permittee shall maintain plantings at a minimum survival rate of at least 85% for a period no less than 5 years. 15. SCTMf144-1-20 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are suggested: Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 2. Avoid reconstruction of structures, other than structures that are part of a water- dependent use, damaged by 50% or more of their value in coastal hazard areas. The principal structure is residential and not water-dependent. It is recommended that the Board require the relocation of the principal structure landward of the CEHA. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas may be warranted for: a. structures which functionally require a location on the coast or in coastal waters. The residential structure does not require a coastal location. b. water-dependent uses which cannot avoid exposure to hazards. The residential use of the property is not water dependent. c. sites where relocation of an existing structure is not practical. As discussed above it is recommended that the Board require that the structure be relocated seaward of the CEHA. Use hard structural erosion protection measures for control of erosion only where: The proposed hard structural erosion protection measures are: a. limited to the minimum scale necessary b. based on sound engineering practices The proposed design of the stone wall would deflectJfunnel wave enerqy to the un-armored property to the west and potential increased floodin,q and erosion on that property. It is recommended that the desi,qn of the stone wall be re- evaluated to reduce adverse impacts to adjacent properties. Please verify the location of the sanitary system. Further, require that the action complies with Chapter 236; Stromwater Management Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
