Box 1179 Southold,NY 11971 Re: John and Lori McDonald,Wetlands Permit No.94 Dear Mr. Domino: On May 15,2019,the above referenced permit was issued for the construction of a new swimming pool, pool patio, dwelling addition, and associated driveway reconfiguration. Since then, however, changes have been made to the approved site plan in response to requests made by the New York State Department of Environmental Conservation, which allowed for a slightly larger swimming pool within the approved patio area but reduced the overall patio area and increased the overall wetland setbacks to the proposed pool and patio. Specifically, the following changes have been made to the site plan: 1) The area of the pool patio, including the pool coping, has been decreased by 1,004 sf from 1,734 to 730 sf; and the patio area adjacent to the north side of the house has been replaced with a stepping stone path. 2) The wetland setback to the proposed patio has been increased by approximately 10 feet from 64 to 74 feet. 3) The pool dimensions have been modified from 20' x 30' to 18' x 34',thus increasing the pool area within the approved patio footprint by 12 sf from 600 to 612 sf, and the pool now includes a spa within its footprint. 4) The pool's setback to the westerly wetland boundary has been decreased by 18 inches from 76.5 to 75 feet but increased to the easterly wetland boundary by approximately 5 feet from 75 to 80 feet. As a result of these plan changes, we are requesting that the permit be administratively amended in accordance with the site plan prepared by Samuels & Steelman Architects, last dated October 28, 2019, copies of which are attached to the enclosed application for administrative amendment. In your letter, you request a de minimus approval to install a 20 ft. by 30 ft. swimming pool located 20 feet from the front property line instead of the granted relief of a 16 ft. by 36 ft. swimming pool located 12 feet from the front property line. You indicate that the pool will be 24 sq. ft. larger than the approved pool, but will be located 8 feet further away from the property line, and thus decreasing the degree of front yard setback relief. Based upon the information provided, I have determined your request is de minimus in nature because the front yard variance relief granted in the 2007 decision (#6028) will become less non-conforming by creating a greater setback from the front property line and the proposed improvement upholds the intent of the original ZBA decision. Please be advised that all conditions set forth in Appeal No. 6028 will still apply. Contact our office if you have any further questions or concerns. I will instruct the office to send a copy of this letter and your request to the Building Department. PROPERTY FACTS/DESCRIPTION: The subject property is a 1.22-acre parcel located along the south side of Cedar Point Drive East in Southold. The property is improved with a two-story frame house and the lot is surrounded by:water on three sides, as shown on the April 25, 2005 survey prepared by John C. Ehlers, Land Surveyor. BASIS OF APPLICATION: Request)for a Variance under Section 280-15C, based on the Building Inspector's February 20, 2007 Notice of Disapproval concerning a proposed 16' x 36' swimming pool and related equipment in a front yard with a setback less than the 50' minimum code-required setback from the front lot line. SUFFOLK COUNTY ADMINISTRATIIVE CODE: This application has been referred as required under the .Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning reply dated ,May 2, 2007 states that the application is considered a matter for local determination as there appears to be no significant countywide or inter-community impact. I TOWN CODE CHAPTER 268 LWRP DIETERMINAYION: Upon referral by this Department, a reply letter dated May 14, 2007 was received conforming a determination of consistency under Chapter 268 Waterfront Consistency Review of the Town of Southold Code and Local Waterfront Revitalization Program (LWRP) standards. The proposed 16'x 36' swimming pool will be +/ 85 feet from the wetlands as shown on the survey revised -6-18-2006 by John C. Ehlers. The Board agrees that this application is consistent with the LWRP standards. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 31, 2007, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: 1 Page 2—June 14,2007 ' ZB File No.6028 —Leo Alessi CTM No.92-1-3 i I I AREA VARIANCE RELIEF REQUESTED: The applicant wishes to construct a 36' x 16' pool on the north side of the applicant's properly with a 12 ft. setback, as angled at its closest point from the front lot line adjacent to Cedar Point brive East,a paper road extension (dead end)at the waterfront. Code Section 280-15C allows an adcessory building/structure in a front yard of a waterfront 53,244 square foot parcel when the setback is not less than 50 feet from the front lot line. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The house sits on a 53,244 square foot parcel which contains gentle slopes adjacent to Fairhaven Inlet leaving a relatively small area to put any other structures. The proposed pool is on one of the few yard areas that are level and that will not interfere with the wetlands. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue because there is no other location on the property for the placement of a pool that would not require similar or different variance relief. The property is also surrounded on three sides by water and is a difficult lot toy build on. 3. The variance granted herein is not substantial. With the additional coverage of the lot by a swimming pool, the lot coverage will;be only 6% based on a total lot size of 53,244 square feet. I 4. The difficulty has'not been self-created. The property is surrounded on three sides and this is the only location in which to place a pool. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physI ical or environmental conditions in the neighborhood. 6. Grant of the requested relief is'[ the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory swimming pool, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267,713, motion was offered by Member Oliva, seconded by Member Goehringer,-and duly carried, to GRANT the variance as applied for,as shown on the survey y prepared by John C. Ehlers, Land Surveyor dated April 25, 2005, revised June 28, 2006, and the 4/13/2007 schematic drawing prepared by Suffolk Environmental Consulting, Inc. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the; zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Statement of the effect, if any, on the wetlands and tidal waters of the town that may result by reason of such proposed operations (use attachments if appropriate): The project consists of the construction of a similarly sized(20'x 30'versus 16'x 36')inground swimming pool in a similar location to that which was approved pursuant to expired Town Wetlands Permit No. 6901,as amended in February 2007. As proposed, the pool and surrounding on-grade pool terrace will be set back at least 75 and 64 feet from wetlands, respectively, thus exceeding the 50'wetlands setback required for pools and related structures pursuant to Section 275-3(D)(1)(a)(5)of the Wetlands Law of the Town of Southold. Also proposed are two minor dwelling additions that do not encroach further upon the existing dwelling's;wetland setbacks and affect lot coverage minimally. In total, the project increases Town-defined lot coverage only to 11 percent. As project mitigation,a pool drywell is proposed to capture pool backwash;two additional storm drainage drywell's are proposed to capture and recharge roof runoff;and a temporary project limiting silt fence will be set in place between the work site and the surrounding tidal wetlands to control and contain site disturbance and potential runoff during construction. And although the existing driveway must be reconfigured to make room for the proposed pool, thus resulting in a 5'reduction in wetland setback to the driveway on the west side of the property, the driveway will continue to consist of pervious gravel. Therefore, the project will not result in the physical loss, degradation,or functional loss of ecological components or otherwise adversely impact the adjacent tidal wetlands or surface waters of Fairhaven Inlet or Cedar Harbor. • r' 617.20 Appendix B Short Environmental Assessment Form Instructions for Completing Part I-Project Information. The applicant or project sponsor is responsible for the completion of Part 1.Responses become part of the application for approval or funding, are subject to public review, and may be subject to further verification.
