NEGATIVE DECLARATION OF ENVIRONMENTAL SIGNIFICANCE: WHEREAS, on August 13, 2018 the Southold Town Board of Trustees found the application of CUTCHOGUE 6291, LLC, c/o STEPHANIE GUILPIN, MANAGING MEMBER to be an Unlisted Action Negative Decision pursuant to SEQRA Rules and Regulations. A Short Environmental Assessment Form and a field inspection have been completed by the Board of Trustees; and it is hereby determined that it will not have a significant effect on the environment, and; WHEREAS, the Southold Trustees are familiar with this project having visited the site on August 7, 2018 and having considered Jeffrey T. Butler, P.E., P.C. plans for this project last dated June 8, 2018 showing the proposed revetment, terracing and bluff stabilization, and; WHEREAS, in reviewing the project plans dated June 8, 2018, it has been determined by the Southold Town Board of Trustees that all potentially significant environmental concerns have been addressed as noted herein: • No existing rocks or boulders are to be utilized, moved, or relocated on the beach. • Access to the site for construction will be by barge. • Vegetative, non-structural measures are not capable of stabilizing the erosion of the bluff alone. • Protection of the toe of bluff using hardened structures including rock revetments is necessary. • As time progresses, continued soil loss at the toe of the bluff may lead to complete loss of bluff stability. • A site inspection by the Southold Town Planning Board recognized severe erosion on this property and requested a bluff stabilization/erosion control plan. THEREFORE, on account of the foregoing, the Southold Town Board of Trustees Approve and Authorize the preparation of a Notice of Negative Declaration pursuant to SEQRA for the aforementioned project. Narrative Addressing Chapter 275, Chapter 111, and Local Waterfront Revitalization Program Policy No. 4 for CUTCHOGUE 6291, LLC 6291 OREGON ROAD, CUTCHOGUE,NY SCTM#1000-82-2-3.2 Pursuant to the requirements of the covenanted conditions of approval of the "Clustered Conservation Subdivision of Oregon Landing II," Town Wetland Permit 8411 and Coastal Erosion Management Permits 8411C' were issued in 2014 to authorize implementation of an erosion control and revegetation plan for the face of the bluff. Consistent with those approvals, the bluff face was planted with Cape American beach grass (as was required for a Certificate of Occupancy to be issued for the property), but the authorized bluff terraces were not installed. Since that time, erosion of the bluff toe and bluff face has continued and most of the beach grass plantings have failed and been lost to erosion. A bluff stairway, which was authorized by Wetland Permit 8411, was also not installed due to the expectation that the ongoing bluff erosion would undermine the stairway construction. Therefore, to protect against the installation and subsequent loss of the bluff terraces and stairway, the applicant is proposing to remediate the ongoing bluff erosion with a revised design plan that incorporates toe stabilization and seeks to simultaneously stabilize the toe and face of the bluff with a combination of structural or"hard"toe stabilization and both structural (terraces) and"soft" sand and vegetative bluff face renourishment, all in accordance with the generally accepted eroding bluff stabilization practices recommended by the USDA Natural Resources Conservation Service. Specifically, a stone revetment is proposed to stabilize the toe of the bluff, which will occur first. Then the bluff face can be stabilized with terracing and renourished with sand and planted with native vegetation, including beach grass for groundcover and woody plants such as northern bayberry and beach rose. The existing non-disturbance buffer adjacent to the top of the bluff will be maintained and left undisturbed. Pursuant to principles set forth by Section 275-11(B)(1)(b), the proposed stone revetment is proposed in an area suffering from extreme erosion. Consistent with Section 275- 11(B)(1)(b), Section 111-15, and Policy 4 of the LWRP,the revetment will be installed with a sloped face and angled returns and will be placed along the existing bluff toe to avoid encroaching on the beach seaward of the existing bluff, causing a measurable increase in erosion at the site or adjacent properties, or resulting in any other adverse impacts on adjacent properties or natural coastal processes and resources. Further pursuant to Section 111-15,the purpose of the proposed structure and integrated erosion control remediation plan is to stem the continued denuding and loss of the bluff, which is the property's natural protective feature; and the design is engineered in accordance with generally accepted engineering principles and is likely to control long-term bluff erosion at the site through long-term maintenance and its intended ability to withstand Page 1 of 2 inundation, wave impacts,weathering and other effects of storm conditions for a minimum of 30 years. i The project is further consistent with Policy 4 of the LWRP because the structure is being proposed only where 1) non-structural, vegetative means alone have already been demonstrated to be in sufficient at stemming the advanced and ongoing bottom-up bluff erosion at this site; 2)the natural protective feature, i.e., the bluff, cannot be effectively enhanced without effective stabilization at its toe, as evidenced by the short-term loss of the recently planted beach grass; 3) a hard structure is the only design consideration that can practicably and effectively provide such toe stabilization; 4) the proposed structure has been limited to the minimal scale necessary to effectively stem the erosional trend and is based on sound engineering practices; 5)vegetative restoration and enhancement is and will remain part of the long-term remediation plan design; and 6)there will be no significant direct or indirect costs incurred by the public as a result of the project. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ❑Yes ❑ No ® Not Applicable Narrative Addressing Chapter 275, Chapter 111, and Local Waterfront Revitalization Program Policy No.4 for CUTCHOGUE 6291,LLC 6291 OREGON ROAD, CUTCHOGUE, NY SCTM#1000-82-2-3.2 Pursuant to the requirements of the covenanted conditions of approval of the "Clustered Conservation Subdivision of Oregon Landing II," Town Wetland Permit 8411 and Coastal Erosion Management Permits 8411C were issued in 2014 to authorize implementation of an erosion control and revegetation plan for the face of the bluff. Consistent with those approvals, the bluff face was planted with Cape American beach grass (as was required for a Certificate of Occupancy to be issued for the property), but the authorized bluff terraces were not installed. Since that time, erosion of the bluff toe and bluff face has continued and most of the beach grass plantings have failed and been lost to erosion. A bluff stairway, which was authorized by Wetland Permit 8411, was also not installed due to the expectation that the ongoing bluff erosion would undermine the stairway construction. Therefore,to protect against the installation and subsequent loss of the bluff terraces and stairway, the applicant is proposing to remediate the ongoing bluff erosion with a revised design plan that incorporates toe stabilization and seeks to simultaneously stabilize the toe and face of the bluff with a combination of structural or"hard"toe stabilization and both structural (terraces) and"soft" sand and vegetative bluff face renourishment, all in accordance with the generally accepted eroding bluff stabilization practices recommended by the USDA Natural Resources Conservation Service. Specifically, a stone revetment is proposed to stabilize the toe of the bluff, which will occur first. Then the bluff face can be stabilized with terracing and renourished with sand and planted with native vegetation, including beach grass for groundcover and woody plants such as northern bayberry and beach rose. The existing non-disturbance buffer adjacent to the top of the bluff will be maintained and left undisturbed. Pursuant to principles set forth by Section 275-11(13)(1)(b), the proposed stone revetment is proposed in an area suffering from extreme erosion. Consistent with Section 275- 11(13)(1)(b), Section 111-15, and Policy 4 of the LWRP,the revetment will be installed with a sloped face and angled returns and will be placed along the existing bluff toe to avoid encroaching on the beach seaward of the existing bluff, causing a measurable increase in erosion at the site or adjacent properties, or resulting in any other adverse impacts on adjacent properties or natural coastal processes and resources. Further pursuant to Section 111-15, the purpose of the proposed structure and integrated erosion control remediation plan is to stem the continued denuding and loss of the bluff, which is the property's natural protective feature; and the design is engineered in accordance with generally accepted engineering principles and is likely to control long-term bluff erosion at the site through long-term maintenance and its intended ability to withstand Page 1 of 2 inundation, wave impacts, weathering and other effects of storm conditions for a minimum of 30 years. The project is further consistent with Policy 4 of the LWRP because the structure is being proposed only where 1)non-structural, vegetative means alone have already been demonstrated to be in sufficient at stemming the advanced and ongoing bottom-up bluff erosion at this site; 2)the natural protective feature, i.e., the bluff, cannot be effectively enhanced without effective stabilization at its toe, as evidenced by the short-term loss of the recently planted beach grass; 3) a hard structure is the only design consideration that can practicably and effectively provide such toe stabilization; 4)the proposed structure has been limited to the minimal scale necessary to effectively stem the erosional trend and is based on sound engineering practices; 5) vegetative restoration and enhancement is and will remain part of the long-term remediation plan design; and 6) there will be no significant direct or indirect costs incurred by the public as a result of the project. Ultimately,the goal of the project is to stabilize,restore, and enhance the natural protective feature of the property for the purpose of minimizing the loss of structures and natural resources from erosion, which is consistent with the relevant permit standards set forth in Chapters 275 and 111 and with the goals of Policy 4 of the LWRP.
