Dear Mr. Goldsmith:
The above referenced permit authorizing construction activities within 100 feet of the top of
bluff for purposes of constructing a single-family dwelling and swimming pool located at least
100 feet from the top of bluff was issued on July 3, 2019, and later amended on November 13,
2019, to reflect changes to the design and footprint of the approved dwelling and appurtenances.
As the dwelling design has again been modified, resulting in a substantially reduced building
footprint(4,827 sf total/8.9%lot coverage in place of the previously proposed 8,340 sf/1-5.3% lot
coverage), I am writing to again request an administrative amendment to reflect the most
recently revised site plan prepared by Kenneth M. Woychuk, last dated December 14, 2020,
three(3) copies of which are enclosed herewith.
The modified site plan now depicts work reflected by the following project description:

Findings: The project meets all the requirements for issuance of an Administrative
Permit set forth in Chapter 275 of the Southold Town Code. The issuance of an
Administrative Permit allows for the operations as indicated on the survey prepared by
Kenneth M. Woychuk, Land Surveying, PLLC, last dated June 29, 2019 and stamped
approved on August 14, 2019.
Special Conditions: None.
Inspections: Final Inspection.
If the proposed activities do not meet the requirements for issuance of an Administrative

vacant parcel an approximately 3,411sf, 2-story, single-family dwelling with approximately 1,518sf
waterside deck with steps, 1,632sf pool deck, 61 s spa, and 680 sf swimming pool, all located at
least 100 feet from crest of bluff, install drinking water well and drainage system of leaders, gutters
and drywells; and clear up to 50 feet from crest of bluff. Located: 500 Castle Hill Road, Cutchogue.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is CONSISTENT with the LWRP policies and therefore CONSISTENT with the
LWRP provided the following is considered to further policies 5 and 6.
1. Require the installation of an I/A OWTS.
Note that a 1981 Covenant and Restriction on the property prevents grading and clearing of
vegetation (excluding necessary maintenance) within 50' of the top edge of the bluff.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

The proposed development of the subject property has been designed to conform to the 100'bluff setback requirement
pursuant to Town Code Sections 280-116(A)(1)and 275-3(D)(1)(b). And to mitigate the proposed clearing,disturbance,
and development of the presently vacant land: 1)all clearing,grading,and ground disturbance is limited to a distance of
50 feet from the top of bluff,2)a drainage system of leaders,gutters,and drywells is proposed to collect and recharge roof
runoff from the new dwelling;3)additional drywells are provided to contain potential site runoff associated with the
proposed pervious gravel driveway,which shall be located more than 100 feet from the crest of bluff and outside Chapter
275 jurisdiction;4)a project limiting fencing will be installed to control and contain site disturbance during construction,
and 5)the sanitary system is proposed on the landward side of the new dwelling and well outside Chapter 275 jurisdiction,
at least 175 feet from the top of bluff and 275 feet from the surface waters of Long Island Sound. And the bluff is
protected from erosion by an existing retaining wall constructed pursuant to Town Wetlands Permit No.4525 and Coastal
Erosion Management Permit No.72-1-1.10,issued in September 1995. Thus,as designed with the incorporated
mitigation,the project will protect groundwater quality and supply and will not adversely impact the quality or function of
the surrounding ecosystem,adjacent surface water quality,or integrity of the adjacent bluff.

The proposed development of the subject property has been designed to conform to the 100'bluff
setback requirement pursuant to Town Code Sections 280-116(A)(1) and 275-3(D)(1)(b). And
to mitigate the proposed clearing, disturbance, and development of the presently vacant land: 1)
all clearing, grading, and ground disturbance is limited to a distance of 50 feet from the top of
bluff, 2) a drainage system of leaders, gutters, and drywells is proposed to collect and recharge
roof runoff from the new dwelling; 3) additional drywells are provided to contain potential site
runoff associated with the proposed pervious gravel driveway, which shall be located more than
100 feet from the crest of bluff and outside Chapter 275 jurisdiction; 4) a project limiting fencing
will be installed to control and contain site disturbance during construction; and 5) the sanitary
system is proposed on the landward side of the new dwelling and well outside Chapter 275
jurisdiction, at least 175 feet from the top of bluff and 275 feet from the surface waters of Long
Island Sound. And the bluff is protected from erosion by an existing retaining wall constructed
pursuant to Town Wetlands Permit No. 4525 and Coastal Erosion Management Permit No. 72-1-
1.10, issued in September 1995. Thus, as designed with the incorporated mitigation, the project
will protect groundwater quality and supply and will not adversely impact the quality or function
of the surrounding ecosystem, adjacent surface water quality, or integrity of the adjacent bluff.
The project will thus be consistent with Policies 4, 5, and 6 of the LWRP.
