That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months,which is considered to be the estimated time required to complete the work involved,but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required,upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. Moore, Esq. 51020 Main Road Southold, NY 11971 RE: MARTHA STEVENS LIVING TRUST c/o IRIS BIKEL, TRUSTEE 2563 LAUREL WAY, MATTITUCK SCTM# 1000-121-4-15 Dear Mrs. Moore: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, June 19, 2019 regarding the above matter: WHEREAS, Patricia C. Moore, Esq., on behalf of MARTHA STEVENS LIVING TRUST c/o IRIS BIKEL, TRUSTEE applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated April 9, 2019, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policies 6.1, 6.3 and 9.3 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: non-toxic materials and thru flow decking are used for any future repairs or replacement of the dock; and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application June 19, 2019, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, 2 WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees APPROVE the application of MARTHA STEVENS LIVING TRUST c/o IRIS BIKEL, TRUSTEE for the existing 27.3'x8.7' fixed dock with 4.6'x8.6' steps on each side of fixed dock; existing 2'x6.7' beach stairs; existing 17' long retaining wall; existing 3.9' landscape steps to 7.6' wood landings along 3.3'x8' stairs to a 4.0'x5.8' stoop to 7.8'x22.1' screened porch; existing multiple wood landings of variable lengths together with a handrail; existing 22.5'x22.5' dwelling with a 3.5'x3.5' outdoor shower; existing 5'x20' retaining wall; existing front entrance with a 4.1'x5.2' landing to steps:and a 7.9'x7.0' platform and step to grade; and for the existing 8.1'x6.2' shed; with the condition:that non-toxic materials and thru flow decking are used for any future repairs or replacement'of the dock; and as depicted on the survey prepared by Michael W. SCTM#: 1000-121-4-15 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with LWRP Policies 6.1, 6.3 and 9.3 therefore, INCONSISTENT with the LWRP. 6.1. Protect and restore ecological quality throughout the Town of Southold. Although the ecological complexes and individual habitats of Southold continue to support large assemblages of plants and animals, over time, human activity has fragmented, or otherwise impaired many of the significant habitats. The impacts that generally result from the construction of fixed dock structures include: Vegetation (Physical Loss) • Structure placement • Construction practices (jetting) • Chronic shading Wildlife (Physical and Functional loss) 0 Loss and/or impairment of habitat • Disruption of habits and migration patterns (structure and activity) • Introduction of harmful contaminants (treated woods) The materials of the dock have not been identified; the use of treated materials capable of leaching pesticides in the waterbody should be prohibited. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. Town records indicate that the structures were constructed without Southold Board of Trustees review or issuance of a Wetland Permit. 9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold. Limit grants, leases, easements, permits or lesser interest in lands underwater in accordance with an assessment of potential adverse impacts of the proposed use, structure, or facility on public interest in public lands under water. Note the survey references a 10' wide easement to the water body. The dock is located very close to the easement area. In the event the action is approved, require a vegetated, non-turf buffer landward of the wetland to preserve water quality.
