SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated October 21, 2020 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated November 30, 2020. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. However, the as-built patio is partially at grade and partially raised and the raised section of the patio includes a French drain to contain storm water runoff thereby mitigating the environmental harm to storm water runoff and making the action CONSISTENT with LWRP. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 12,614 square foot waterfront parcel located in an R-40 Zoning District. The parcel runs 108.30 feet along Deep Hole Creek, runs 100 feet along Lupton Point Road (a private road),runs 111.76 feet on the West side and 148.67 feet on the East side. The parcel is improved with a two-story frame house with wood deck, stone patio, frame garage, frame shed/chicken coop, and plastic mesh walk with ramp and floating dock. All is shown on a survey prepared by David H.Fox L.L.S. last revised July 13,2020. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Sections 280-124 and the Building Inspector's August 17, 2020 Notice of Disapproval based on an application for a permit to legalize an "as built" Page 2,December 22,2020 #7444,Tintle SCTM No 1000-115-11-8 addition and alteration to a single-family dwelling; at 1) located less than the code required rear yard setback of 35 feet; located at 1235 Luptons Point Road,(Adj to Deep Hole Creek)Mattituck,NY SCTM No. 1000-115-11-8. RELIEF REQUESTED: The applicant requests a variance to legalize an "as-built" partially raised patio attached to the rear of the dwelling having a distance of 29.7 feet from the rear yard property line. ADDITIONAL INFORMATION: The county tax map shows that the Eastern Property line of the parcel is 120 feet long and extends out past the tie line and the Western Property line is 150 feet long and extends passed the high tie line. The survey of the subject lot notes that the tie line is measured along the approximate H.W.M. (High Water Mark). If the lengths of the property stated on the tax map are used instead of the tie line then the subject raised patio would have a code conforming rear yard setback. The parcel has the benefit of area variance file # 6428 granting approval for additions and alterations from a bulkhead setback of 56.9 feet where Town Code then required a 75-foot bulkhead setback. The applicant also submitted prior comparable ZBA decisions located in the applicant's neighborhood: ZBA File no. 7227, dated January 17, 2019 granting relief for a permit to legalize additions to a dwelling having 42.8 feet rear yard setback instead of the required 50 feet; ZBA file number 1748, on April 19, 1973 granted variance relief for a non- conforming rear yard setback for a parcel on the north side of Lupton Point Road. There are other variances granted to parcels along Lupton Point Road for relief from the code for variances other than rear yard setbacks. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 3,2020 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The parcel is in a residential neighborhood that consists of waterfront homes. The as-built raised patio is not visible from the street. Raised patios are typical in this neighborhood. 2. Town Law $267-b(3)(b)(2). The benefit sought by the applicant or cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Due to the location of the house and the fact that the tie line is an approximate measurement any raised patio in the rear of the house would require the benefit of an area variance. 3. Town Law §267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 15%relief from the code. However, the tie line used to determine the rear yard line is an approximate measurement and can fluctuate. 4. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(30)(5). The difficulty has not been self-created. While The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase, the fact that the rear yard line is an approximate measurement and the county tax map shows the rear yard line passed the tie line the applicant had reason to believe the raised patio was in a code conforming location. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a raised patio while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community.
