HomeMy WebLinkAboutCallander, Elizabeth SOUTHOLD TOWN BOARD PUBLIC HEARING July 27, 2021 9:00 AM Present: Supervisor Scott Russell Justice Louisa Evans Councilwoman Jill Doherty Councilman James Dinizio, Jr. Councilman Bob Ghosio, Jr. Councilwoman Sarah Nappa ************ Town Clerk Elizabeth Neville Town Attorney William Duffy This hearing was opened at 9:08 AM COUNCILMAN GHOSIO: NOTICE IS HEREBY GIVEN the Town Board of the Town of Southold will hold a Public Hearing on Tuesday, July 27, 2021 at 9:01AM at the Southold Town Meeting Hall, 53095 Main Road, Southold,New York upon the application of the Coastal Erosion Hazard Board of Review Appeal of Elizabeth Callander which seeks relief from Chapter 111, Section 111-11C and Chapter 111-6 to construct to construct± 105 linear feet of 4" wide wood pile and timber pier of which± 65 N, linear feet is waterward of the apparent/spring high water line, including five associated M ladders, rails, electric and water utilities; construct a± 9' x± 101 ( 90sq.ft.) wide boulder mounded wood platform/dock with a 4' wide x± 7 linear foot long access walkway with rails and three new tie-off piles, waterward of the apparent high water line; with the condition of the use of thru-flow decking on the entire dock; and as depicted on the site plan prepared by Docko, Inc., dated December 12,,2018; within a near shore area in a Coastal Erosion Hazard Area located on property on parcel SCTM# 1000- 3- 2- 6 off 12244 East Main Road, Fishers Island , New York, and directs the Town Clerk to publish notice of such appeal in the Suffolk Times newspaper not less than ten (10) days nor more than thirty (3 0) days prior to such hearing and to notify the applicant by first class mail. I have a copy of the notice of public hearing, it was on the town website, I also have a copy of the announcement in the Suffolk Times. I have the application with the application to the Trustees. And a copy of the notice in the New London Day and that's all I have. KEITH NIELSON: The application before you today has gone through pretty extensive review by all four of the agencies covering Fishers Island, including the Trustees, DEC, Corps of Engineers and Department of State. We are well aware of the 200 square foot limitation on structures in coastal waters. I know that in past dealings, past projects with the Trustees, they have indicated that that 200 square foot ruling was really inclined toward dock facilities in Peconic Bay and not with open coastal waters in Fishers Island. The provision that is difficult Public Hearing-Callander CEA July 27, 2021 page 2 for us to comply with is the 200 square foot limitation because we are balancing construction of a dock facility with terrain and coastal features of each particular site. And as you can see from the drawings we have provided, on sheet two in particular, there are massive amounts of rocks at the site. The first part of the dock facility which would basically use up the 200 square feet is the part that is trying to get over the shoreline limit of rocks and we would barely get past the mean low water line into water that is not useable for any boating purpose. What we have done is, there are two pretty prominent boulders on the site that indicate basically the limit of boulders in the navigable water area and we have put the dock right between them. We have put the little platform on the large boulder just because it is a suitable place for a platform and will not have any adverse impacts on anything and it will be secured through drilled pin connections into the boulder, it will be very tough. We also have that boulder more east of the berthing area which is a problem, we are going to try and split that and remove it as we have shown on sheet three. If you go to sheet three, you will see the pier alignment that we have put together and you will see that in spite of all of the structure, there is only one tiny little place where the boat can actually be tied off and in the area where that slip is located we even have to have one fender pile to keep the boat from hitting that one boulder if we can't remove it. The overall encroachment of this structure is minimal, it barely gets out past the rocks. it is in a slip that can be utilized at anything other than low tide. We do not want the Callendars to tie their boat up there permanently because of the low tide contact issues with bottom sediments, so they will keep a dinghy there, probably a small 10 to 15 foot hard bottom inflatable that they can get out to their boat on a mooring. But this is the only berthing slip that we can arrange. You will see that we have tucked the dock facility in between the two boulders and the eel grass which was marked, carefully marked by a wildlife biologist and we've just made everything fit the best we can. So it is a minimal structure and if we were to go anywhere else on the property, we would end up with a longer pier and definitely intruding into the eel grass. In this case, we have avoided the eel grass entirely. We built right around the perimeter of it. We got into the reasons for the hardship, which I have basically already explained and the other issue is the removability of the dock. These piles, you can see that the visible rocks have been mapped in our survey but there's rocks along the sandy sediments as well along Fishers Island and driving the piles, we have shown a nice, neat orderly progression of piles, a 10 foot(inaudible) facing and five foot lateral separation so we can put the four foot pier in between them but in actuality, the piles frequently go in in somewhat of a staggered pattern because we have to drive them where we can get them between the boulders and to make sure that they are adequately embedded, they are down 10 to 15 feet. They have a bearing capacity of 20 tons and full out resistance of 10 tons and the, in order to make this removable and have those piles taken out, we would gradually destroy the bearing capacity of the very sand they have to be embedded in and make the dock susceptible to storm induced damage. We've done about 50 dock facility projects on Fishers Island and we know, we are well accustomed to the driving and construction conditions that we have to deal with and this is, in our professional judgment, the best configuration that we can make consistent with the permitting standards of all four agencies and the only variance that we have to have is that we cannot make this removable because we would destroy the features of the shore or the sub surface sediments that we are completely dependent on for the stability of the pier. That's why we are asking for the variance. I would be happy to answer any questions that you all might have. COUNCILMAN GHOSIO: This received a Trustees permit? Public Hearing-Callander CEA July 27, 2021 page 3 MR. NEILSON: We did receive a wetlands permit from the Trustees. SUPERVISOR RUSSELL: The eelgrass restoration organization over on Fishers Island, did they have a chance to review it? JUSTICE EVANS: They sent a document to the Trustees. SUPERVISOR RUSSELL: Inaudible. Or the presumption is they've already.... JUSTICE EVANS: Well, the Trustees have already reviewed it. Inaudible. SUPERVISOR RUSSELL: Inaudible. It seems like we are working at cross purposes because (inaudible). JUSTICE EVANS: Inaudible. SUPERVISOR RUSSELL: Inaudible. MR. NEILSON: Would it be appropriate for me to address that? SUPERVISOR RUSSELL: I don't know if the Board wants to hear that. COUNCILWOMAN NAPPA: Yes. MR. NEILSON : Eelgrass,there are eelgrass design standards that were originally created by the National Marine Fishery Service and there are eight of them and they include keeping the pier as high as possible wherever possible and you will see by the profile which is most clearly shown on sheet four, that once we come off the eroding coastal block, we drop down to an elevation where the deck height is six feet above the mean high water surface. It gives us an eight foot clearance above the ground which is one of the National Marine Fishery Service standards. The only place that we go lower than that is out at the berthing end of the pier and we do that because of berthing access safety and so on. They ask us to locate docks clear of eelgrass beds, which we have done, we are on the east side of the east border of the eelgrass, which goes (inaudible) from the boulders. So the eelgrass will be entirely out of the shade impact from noon on in the afternoon. So we have avoided that where possible. They also require through flow decking where possible and so the end of the pier is all through flow decking in order to comply there. They ask that there be no floating docks, so we have not utilized a floating dock in this location, it is a full length fixed pier, so we have followed the National Fishery guidelines completely in this application, the conservancy requests that we follow the same guidelines and avoid eelgrass where possible and we talked with one of the members, I should say a former member, at the time he was a member of the conservancy, David Burnham, and we showed him in detail on the site how we were complying with conservancy guidelines. So we believe that we have complied with all of the printed standards for this project and the intentions of those standards by keeping this dock in this very isolated area. As I said earlier, this is the only area where the dock really would work, so I hope that that satisfies your concerns. Public Hearing-Callander CEA July 27, 2021 page 4 COUNCILWOMAN NAPPA: Inaudible. SUPERVISOR RUSSELL: Yeah, I was just wondering if they reviewed it and said ultimately said yes, you are making the best effort you can and we are comfortable with the (inaudible). That's all I was asking. Because you know, we have the input of the public particularly people that are focused on a very committed program. We had them present to us, they just sort of made their thoughts reflect in it. JUSTICE EVANS: Inaudible. SUPERVISOR RUSSELL: Aware but okay ultimately? COUNCILMAN GHOSIO: Are there any other docks in this area? JUSTICE EVANS: They wanted to make sure what they (inaudible). MR.NEILSON: I can help you with that question about the docks. There is a dock facility at Dougal Young's property, we went through this same design issues and mitigated factors for him, there is a partial dock at formerly Penran's property which is the immediate neighbor to the west. it does not have any decking at this time but there was a dock, we worked on it 20 years ago. This dock for Callander and Jean Calhoun has a dock just to the east of this project, so there are three in the immediate area. And there are about eight docks, if you go around the rest of Chocomont cove, starting at Carrente, about a 1/2 mile or so to the west over to the Firestone boat house and north to Roosevelt at the east, there's about eight or nine rocks in the area. COUNCILMAN GHOSIO: Have any of the docks experienced storm damage in recent years? MR.NEILSON: No (inaudible). We repaired Firestone boat house after hurricane Bob in 1992. And had to rebuild some of the crib supports and actually straighten out some of the framing for the boat house itself. Roosevelt's dock was also damaged somewhat and that was repaired as well. I am not aware of any other damage. Some of the other docks like Calhoun and Spurtle (sp?) were not built at the time and so there was nothing of consequence there, and (inaudible) was damaged during hurricane Bob so that was repaired as well. SUPERVISOR RUSSELL: Just one last question, is this a replacement for a dock that had historically been there? Or this is a brand new dock where there had never been? MR.NEILSON : This is a brand new dock facility. COUNCILMAN DINIZIO: I am interested to find out if anyone here knows (inaudible), why they have a 200 square foot mitigation? COUNCILMAN GHOSIO: The idea, as I recall, is that 200 square foot is removable. Public Hearing-Callander CEA July 27, 2021 page 5 COUNCILWOMAN DOHERTY: That is coastal erosion regulations, the town did not make that up. COUNCILMAN DINIZIO: I am just wondering why, why is that restriction there? You said something about they wanted it removable? COUNCILMAN GHOSIO: Yeah. COUNCILWOMAN DOHERTY: Yeah. COUNCILMAN DINIZIO: Why would they want to make it removable? COUNCILMAN GHOSIO: In case of a storm coming, you would be able to take it down... COUNCILMAN DINIZIO: Because why? COUNCILMAN GHOSIO: Inaudible. There's that and also concern about damage to other docks from the storm. COUNCILWOMAN DOHERTY: Inaudible. This is kind of protected, you are not going to get that full on, you are still going to get the storm....... COUNCILMAN GHOSIO: Coastal erosion doesn't include all of the shoreline, certain areas. COUNCILMAN DINIZIO: Inaudible. I would want to exceed that. What's so great about this dock that(inaudible).... COUNCILWOMAN NAPPA: Geography. COUNCILMAN GHOSIO: Well, there's that and this is a philosophical question, I mean, inaudible. COUNCILWOMAN DOHERTY: Inaudible. The Trustees back then talked about this lot and we basically had no choice but to adopt the code as it is inaudible. JUSTICE EVANS: How much of the shoreline on Fishers Island comes under the coastal erosion hazard act? COUNCILWOMAN DOHERTY: The whole island. COUNCILMAN DINIZIO: My point is, inaudible, I don't think I can recall (inaudible) and now we just keep punching holes in it and for what reason? Inaudible. Yes, I see on the map but it looks like (inaudible) we are just trying to minimize everything here, minimize the damage. This 200 square feet is part of that. Why not just a pole out therewith a pulley system that pulls in the inflatable boat that they can get out(inaudible), get out of that(inaudible). Public Hearing-Callander CEA July 27, 2021 page 6 SUPERVISOR RUSSELL: That's another thing I was thinking. COUNCILMAN GHOSIO: Like propeller wash. COUNCILMAN DINIZIO: Why are we, you know, like I said, punch a hole in that code (inaudible) because I am all for if you can do it, fine, but once you start asking for variances (inaudible). COUNCILWOMAN DOHERTY: I am not thinking as okay, he is doing this many more square feet(inaudible) COUNCILMAN DINIZIO: Yeah but were the rocks placed there? COUNCILWOMAN DOHERTY: They were there. COUNCILMAN DINIZIO: Yeah, so that's the environment. COUNCILWOMAN DOHERTY: That's what I am saying, they are trying to work around the environment to get access to the water and they have their right to apply but they don't have absolute right, have to have that access, so I understand that but to me, I don't, knowing, being a Trustee and going to Fishers Island and dealing with this situation many different times, it's just working with the geography. The coastal erosion hazard is around the whole island because it's an island and no other reason. And when they did that, they didn't take into consideration of like inside the cove and everything else of that island is over here, inside that cove would not be coastal erosion. Inside our coves here are not coastal erosion. Coastal erosion for the bay goes to about the old oyster factory and Spring pond is not coastal erosion. In front of it is, so that's kind of how I look at it, even though it's labeled coastal erosion, if it wasn't an island, it wouldn't be. COUNCILMAN DINIZIO: It has nothing to do with the eelgrass here? COUNCILWOMAN DOHERTY: Right, right. It's more of storm (inaudible) people would build these massive docks and a storm would rip it up and it would damage land and other people's property. That's the main goal. COUNCILMAN DINIZIO: Inaudible. COUNCILWOMAN DOHERTY: And with the flow through decking and everything, it gets the light through so the eelgrass gets the light the whole day and that really works for them. MR. NIELSON: Can I add something? Thank you. I would like to point out that we have abided by all the design standards for eelgrass population even though we had avoided eelgrass in the configuration of this dock but I think it's interesting to note that on the Parente dock which is about 1/2 mile to the west, when we started that project, there were two small areas of eelgrass about 20 feet off shore and we located the pier so that it went between the two eelgrass patches. Five years later after the dock had been finished and the dock was operational,the eelgrass is Public Hearing-Callander CEA July 27, 2021 page 7 now a continuous 20 foot wide band and it runs completely under the dock, right under the through flow decking that we put on and everything. These north south docks get the benefit of the sun in the morning from the east and sunlight in the afternoon from the west. So if Parentes is a suitable example and I think it is, these high docks have demonstrated that they don't have any adverse impact on eelgrass. COUNCILMAN DINIZIO: Thank you. COUNCILWOMAN NAPPA: How far out does the eelgrass go out? Because here it is just showing you know, does it continue on where it is drawn on this, I guess is my question? MR. NIELSON: It does. It goes out about another 200 feet or so and it's a little irregular depending on the bottom contouring and so on but it goes way out. We can't span it. COUNCILWOMAN NAPPA: Okay, that was going to be my question. COUNCILMAN DINIZIO: This is the biggest lot of eelgrass.. JUSTICE EVANS: Well, they are all around Fishers Island... COUNCILMAN DINIZIO: Inaudible. JUSTICE EVANS: And they have a huge (inaudible), there are different areas, it's not one all the way around. Inaudible. COUNCILMAN DINIZIO: It looks like to me that this doesn't affect the eelgrass, if there were eelgrass there you wouldn't be able to build this dock but(inaudible). What I am saying is that eelgrass may grow underneath this dock.... COUNCILWOMAN DOHERTY: Right. Because of the design of the dock. COUNCILMAN DINIZIO: Inaudible. COUNCILWOMAN DOHERTY: Because coastal erosion would state that the towns have to take it and administer it. COUNCILMAN DINIZIO: Inaudible. COUNCILWOMAN DOHERTY: Right. Right. We are the administrators of coastal erosion but we are not the authors of coastal erosion. COUNCILMAN GHOSIO: The Trustees just can't approve it based on the fact it requires some kind of variance (inaudible), we are, as the Town Board (inaudible). Keith, what is the purpose of the 10x9 platform? Public Hearing-Callander CEA July 27, 2021 page 8 MR.NEILSON: It is a passive, recreational platform. It does not have any boat berthing characteristics. It is built entirely on a huge rock, I think the rock weighs on the order of 40 tons and we just took advantage of there would be no adverse, environmental impact and put the platform out there as a point of enjoyment. COUNCILWOMAN NAPPA: A creative way to do something with that rock. MR. NEILSON: I believe our application, the Trustees had a photograph of the rock and it's huge. It's actually flat topped and so it just lends itself to this, like I said, without any adverse impact or encroachment. It's just there and so we just tried to take advantage of that. COUNCILWOMAN DOHERTY: Louisa said what is the height of that rock, the platform? Oh, eight feet, she found it. MR. NEILSON: Right and it is sitting right on top of the rock. The top of the rock is white,,you can see that the black stain line on the rock is down a couple of feet and so the top of the rock is about six feet and we've got the platform sitting right down on top of it. Russell Updated: 7/27/2021 3:28 PM by Lynda Rudder Page 2 TOWN BOARD COASTAL EROSION HAZARD BOARD OF REVIEW TOWN OF SOUTHOLD -------------------------------------------- In the matter of the Application of ELIZABETH CALLANDER FINDINGS AND 12244 East Main Road DETERMINATION Fishers Island, NY SCTM #1000-3-2-6 -------------------------------------------- FINDINGS AND DETERMINATION Based upon the application, documents contained in the Board’s file, site inspections and testimony received at the public hearing held on July 27, 2021, the Town Board finds and determines as follows: ISSUE Keith Neilson PE of Docko Inc. on behalf of Elizabeth Callander has filed an application with the Town Board, as the Coastal Erosion Hazard Board of Review (the “Board”), dated June 8, 2021 requesting the following relief: 1. A reversal of the Board of Trustees May 19, 2021 determination preventing the issuance of a coastal erosion permit in accordance with Chapter 111 of the Town Code. FACTUAL BACKGROUND AND PROCEDURAL HISTORY A. Description of the property and applicants: The property that is the subject of this application is located at Off East End Road, Fishers Island, NY SCTM#1000-3-2-2. The property is currently improved with a single family home, decks and foundation. The property is located in the residential zone. As confirmed by the Board of Trustees, and acknowledged by the applicant, the property where the proposed work is to be performed is located within the Coastal Erosion Hazard Area as established by New York State in 1991. The applicant submitted an application to the Trustees seeking to construct± 105 linear feet of 4" wide wood pile and timber pier of which± 65 N, linear feet is waterward of the apparent/ spring high water line, including five associated M ladders, rails, electric and water utilities; construct a± 9' x± 10 ( 90sq.ft.) wide boulder mounded wood platform/dock with a 4' wide x± 7 linear foot long access walkway with rails and three new tie-off piles, waterward of the apparent high water line; with the condition of the use of thru-flow decking on the entire dock; and as depicted on the site plan prepared by Docko, Inc., dated December 12, 2018; on parcel SCTM# 1000- 3- 2- 6 off 12244 East Main Road, Fishers Island , New York. B. Trustees Procedural History: I. Application The applicant filed an application with the Board of Trustees on February 17, 2021 to construct to construct± 105 linear feet of 4" wide wood pile and timber pier of which± 65 N, linear feet is waterward of the apparent/ spring high water line, including five associated M ladders, rails, electric and water utilities; construct a± 9' x± 10 ( 90sq.ft.) wide boulder mounded wood platform/dock with a 4' wide x± 7 linear foot long access walkway with rails and three new tie-off piles, waterward of the apparent high water line; with the condition of the use of thru-flow decking on the entire dock; and as depicted on the site plan prepared by Docko, Inc., dated December 12, 2018; within a near shore area in a Coastal Erosion Hazard Area located on property on parcel SCTM# 1000- 3- 2- 6 off 12244 East Main Road, Fishers Island , New York. II. Public Hearing: The Trustees held a public hearing on this application on May 19, 2021 at which times all those interested were given the opportunity to speak. Keith Neilson PE on behalf of the applicant addressed the Town Trustees’ concerns with regards to the application. It was described that the proposed structure would be the dock extending out in to the waters of Fishers Island Sound in the Coastal Erosion Area. III. Trustees Determination and Certificate of Compliance. On May 19, 2021 the Trustees issued a determination stating that the proposed construction fell outside the jurisdiction of the Board of Trustees due to the proposed application being located within the designated Coastal Erosion Hazard Area and square footage proposed exceeding 200 square feet, and therefore the Trustees could not issue a permit under the tidal wetlands act denied the application without prejudice, and as such further application would need to be made to the Town Board. IV.The Town Board Proceeding On June 8, 2021, the property owners timely filed an appeal of the Trustee’s determination pursuant to Town Code Chapter111 with the Coastal Erosion Hazard Board of Review (the Board) seeking the reversal of the Trustees denial. The Board held a duly noticed public hearing on July 27, 2021, at which time all interested parties were given the opportunity to present testimony on the application. Keith Neilson PE of Docko Inc. on behalf of the applicant addressed the Town Board’s concerns with regards to the application to construct± 105 linear feet of 4" wide wood pile and timber pier of which± 65 N, linear feet is waterward of the apparent/ spring high water line, including five associated M ladders, rails, electric and water 2 utilities; construct a± 9' x± 10 ( 90sq.ft.) wide boulder mounded wood platform/dock with a 4' wide x± 7 linear foot long access walkway with rails and three new tie-off piles, waterward of the apparent high water line; with the condition of the use of thru-flow decking on the entire dock; and as depicted on the site plan prepared by Docko, Inc., dated December 12, 2018; within a near shore area in a Coastal Erosion Hazard Area located on property on parcel SCTM# 1000- 3- 2- 6 off 12244 East Main Road, Fishers Island , New York. This initial application being made within the Costal Erosion Act as well as the Tidal Wetlands Act. Members of the public had the opportunity to appear and the record was closed on July 27, 2021. APPEAL OF THE TRUSTEE’S DETERMINATION Pursuant to §111-24 the Town Board is designated as the Coastal Erosion Hazard Board of Review and has the authority to “\[h\]ear and decide appeals where it is alleged there is error in any order, requirement, decision or determination made by the Administrator in the enforcement of this chapter.” See, Town Code §111-24 (B). Furthermore, the Coastal Erosion Hazard Board of Review has the authority to “reverse or affirm, wholly or partly, or may modify the order, requirement, decision or determination of the Administrator, including stop or cease-and-desist orders.” See, Town Code §111-25. When considering appeals pursuant to §§ 111-24 & 25, the Board is limited to the record on appeal and the arguments made before the Board of Trustees. In this instance, this Board finds, based upon the record before it, that the applicant has supplied the sufficient information regarding the criteria set forth in §111-9(A-C) of the Town Code to support the granting of a Coastal Erosion Management Permit. CONCLUSION Therefore, in the interests of justice and for the reasons set forth herein, this Board grants the appeal of the Applicant pursuant to Chapter 111 of the Town Code to construct± 105 linear feet of 4" wide wood pile and timber pier of which± 65 N, linear feet is waterward of the apparent/ spring high water line, including five associated M ladders, rails, electric and water utilities; construct a± 9' x± 10 ( 90sq.ft.) wide boulder mounded wood platform/dock with a 4' wide x± 7 linear foot long access walkway with rails and three new tie-off piles, waterward of the apparent high water line; with the condition of the use of thru-flow decking on the entire dock; and as depicted on the site plan prepared by Docko, Inc., dated December 12, 2018; within a near shore area in a Coastal Erosion Hazard Area located on property on parcel SCTM# 1000- 3- 2- 6 off 12244 East Main Road, Fishers Island , New York. It has been decided that the pier would be constructed in the center of the property north from the rock shoreline in waters of Chocomourit Cove and permits have been applied for to the State of New York, both Department of State and Department of Environmental Conservation,the U,S, Army Corps of Engineers, and the Town of Southold. The Town of Southold Board of Trustees has approved the Tidal Wetlands Permit for the construction of this dock facility.Each of these pen-nits has acknowledged the occasional exposure of this site to adverse sea conditions and the susceptibility of the Fishers Island shoreline to erosive and damaging forces, The respective agencies have, during pre-application reviews, accepted the pier design as adequate and appropriate considering these factors, fLariance-Request--, The dock facility is defined as a structure in Chapter 111 of the Town of Southold Code, Coastal Erosion Hazard Areas®The area of the dock facility exceeds!200 SF in order to meet the regulatory and policy requirements of the State, federal and local permit agencies and, therefore, this dock construction activity is not "unregulated" and must conform to the Coastal Erosion Hazard Area, factors for consideration notably, being removable. A variance to Chapter 111 is respectfully requested because of the nature of the project and the demonstrated history of other docks in this area. the structural stability and effectiveness of this dock facility required for the climatic and sea conditions which are experienced at this site. Since the pier exceeds 200 SF it must be removable by code. This requirement for a "removable" structure is contrary to proper -facility design and construction and would be detrimental to the environment and resource conservation. Article 34 of the New York State Environmental Conversation Law, which is the basis for the establishment of the Town of Southold Coastal Erosion Hazard Program has been reviewed in the preparation of this document. It is acknowledged that the basis of the 2008F dock design standard was more suited to the protected waters of the Town's south shore and not Fishers Island and therein was the basis of the hardship. The construction scope of work and method to be utilized in this project are specifically to protect the structure against damage from waves and to preserve existing coastal features, as well as coastal resources, specifically eel grass, which grows around the periphery but not in the area of the pier head. Access and staging considerations are also compatible with these two goals, The barge to conduct work will be relatively light in draft, approximately two to three feet. The water depth will allow the barge to approach within 50 feet of shore,which is the reach of the crane.The barge will not contact the bottom during any portion of the construction, and the barge will be relocated at higher tides to remain clear of the existing eel grass beds in and around the project site. There is no removal of soil or sediment in the proposed scope of work, and there is no alteration of the shoreline proposed. Most of Fisher's Island's waters are recognized as valuable fish habitat.- The driven piles will maintain water flow and circulation, as it compared to the cribs of old. Existing patches of tidal wetlands near the shoreline will be unaflected by construction and usage of the pier and not at all by the actual physical impact of the pile driving. The pier height is being established at about 8 feet above mean low water,for most of its length and has a north-south alignment which will allow sunlight to reach beneath the pier from tho east or west side of the pier during most of the day. In addition, the "Thruflow" decking utilized as the walking surface is perforated as to allow an effectively 60% of Sunlight to reach the water column and 'bottom sediments beneath the pier, based by studies utilized by the NYSDEC during the approval process of"Thruflow"decking. This project will result in no loss of waters as defined in U.S. Army Corps of Engineers General Permit Number , under which this project has been received by the TJ,S. Anny and the project approval is expected. This dock facility represents minimum encroaclunent, into the navigational waters of the State and waters deep enough to minimize bottom impacts due to shading and propeller drive systems yet stopping short of the eelgrass growth areas. 'rho shoreline of Fishers Island Sound has been eroding for decades based on the number of rocks in the shallow inter-tidal zoneand sub-tidal zone,the shoreline historically was out further as much as a hundred feet or more to what is now the northerly limit of the boulders. There are no known endangered species in the project area. No tidal,wetlands vegetation will be disturbed during this,pier construction project or the usage of this facility for boating or recreation. This construction, project is compliant with new policies related to the preservation and enhancement of eel grass beds, provided by the Axiny Corps of Engineers, who's consultation nornially includes the National Marine Fishery Services (NMFS), The pier will be pile supported,with piles in bents or pairs,at I 0-foot intervals."Thruflow2l(slotted plastic)decking will be used for the full length of the pier with a typical elevation of at least 9-feet above the bottom sediments. This decking will have two benefits; allow sunlight to pass through the decking and into the water columri and by providing relief fi-orn hydrostatic (wave) forces to maximize pier resilience and minimize wave uplift forces which have been known to damage piers. There will be no floating dock. Embedded stone in the berithos, is to remain, except for one stone to the east of the berthing slip. This will maintain existing benthic habitat as is. Siructural Considerationy: In accordance with the policies of the National Marine Fisheries Service, piles will be 12 inches in diameter at the point of contact with the water, and no larger and more like 10 inch diameter at the point of embedment, It is anticipated that these:piles will be 12-inch Class B pressure treated. southern yellow pine. The New York State Department of Environmental Conservation conducted an extensive study in 2000 and determined that such piles are recognized as essential to the long- term structural stability of marine structures and has indicated that the environmental impacts of such treated piles are minimal and consistent with DEC environmental policy, The structure will be fastened together with double% inch or single I inch bolts at each pile bent split cap and cross-brace, each of which will be 4x10 timbers. The decking will be supported with 3 x 10 stringers at 16-inch centers as required by the: decking. The outside stringer will be bolted to the piles. Decking will be screwed down with,two screws per stringer, .The strength of each bolted connection of timbers to the pile is in excess of a ton, Therefore, the total uplift force exerted on the decking and the framing should be well within the capacity of each of the bolted coruiections. With regard to structural integrity,the 12-inch piles will be driven to a depth of 10 to 15feet of embedment, with a bearing capacity of 20 tons, and a pull-out resistance of 10 tons for each pile. The deck elevation will keep the bulk of the structure above the wave zone for standard conditions of high tide,plus one-foot storm surge,plus three-foot waves. In cases of severe coastal storms and hurricanes,there are more significant(three foot)surge tides and the deck will be below most of the wave energy.The longstanding nature of nearby structures (Firestone Boat House,Roosevelt dock, Sp6rtle mid Charpentier existing docks)and their survival through notable coastal stories since the 1950s, including Hurricane Donna in 1965,The Blizzard of 78 ,Hurricane Gloria in 1985,, Hurricane Bob and the Halloween Storm(Perfect Storm)in 1992, Hurricane Floyd in 1999, Hurricane Irene in 2011 and Hurricane Sandy in 2012, and five nor'easters in March/April of 2018 give testament to the appropriateness of historic dock building standards. Turbidity will be minimal. The bottom sediments are sandy gravel with stone and rock and the area of contact of the piles is approximately 3/4 of a square foot per pile. This results in a bottom sediment impact area of less than 20 square feet for this structure based on pile contact area. .L11aj,dv1sh2.. .L. Chapter 111 requires that a dock facility' over 200 SF be removable. In order to make a dock removable it must be built of fairly lightweight materials with minimal embedment which can be removed seasonally or in advance of danger, and yet firmly founded and fastened so as to provide stable support even considering berthing forces and incessant rhythmic loading due to wind and wave. Such conditions can be accommodated in protected bays and estuaries off Gardner's Bay, Long Beach Bay and Orient Harbor. Long Island Sound and Fishers Island Sound,however,are not mentioned in Section 111-5 A, and see forces to be reckoned with. Piles for support and their bracing elements are essential components for these more severe,exposures. These piles can be pulled up by significant storm driven waves and so they must be driven deep and therefore they must be tough enough to handle the driving forces of installation, the resistances for deformation, and resistance to pulling out, These very attributes make removal infeasible. Even if it was feasible, repetitive pile driving and extraction, presumedly utilizing jetting to some extent, would decrease the support capability of the sediments and render the structure more likely to be damaged. In order to make the pier less susceptible to damage in severe storm conditions of the surge tide and waves,the pier height will be kept as low as practical and permittable so that these worst case storm conditions will have their most damaging energy over the top of pi rather than stri g the pier directly. To have to make this pier removable would not be e tile er n kin nvironmentalty, physically or economically appropriate; this is the hardship created, by Chapter 111 and therefore,the basis for the requested waiver, I Summary: The emphasis of Chapter 111 is to regulate development activities and to implement standards which will help to minimize and prevent damage to natural Protective physical site features as well as nearby manniade structures from coastal flooding and erosion and to protect natural resources in the area and human lives, Adjacent dock facilities have withstood the test of time and,in the case of the Firestone Boat House -mid Roosevelt dock, pre-existed this chapter by 35 years, The proposed pier faces into, the most ftequent climatic forcesand will continue to do so. The pier will have attributes which will, help to maintain environmental quality in general,and specifically to iuinimize adverse impact potential for eel grass being clear of mapped beds.The Town Trustees have issued the Tidal Wetland permit for this pier construction project acknowledging structure attributes required for the stressful site and sea conditions while preserving and protecting the environmental resources at the site and how the resources will 'lot suffer from the design features and materials specified for use in the construction. We have prepared the variance request based on the factors for consideration in section 111-9: A:The pier construction project is reasonable and necessary for boating access beyond the inter-tidal field of boulders. The structure will be suitably stout and environmentally appropriate in view of current resource protection standards, B: The structure will not cause a measurable increase in erosion along the shore at this property or at adjacent properties. C. The features of alignment and increased height of the approach section, initial pier height and use of"Thruflow" decking will maintain environmental and habitat quality in accordance with current State, Federal acrd Town standards for approval. The use of open grate decking and piles for support will maintain light transinissivity to-the bottom sediments; and will also maintain water flow and circulation. The decking will not focus rainfall runoff in a manner which might induce erosion. It is agreed by the permitting agencies that these features will not significantly degrade or adversely impact the environment and habitat quality of the Sound or Chocomount Cove. This project complies with the provisions of the US Army Corps of Engineers,NY DEC, and NY DOS programmatic standards as well as the requirements of the Town's Tidal Wetlands Law. The dock structure is 265 SF larger than 200 SF but will not be any larger thin necessary, In order to be in compliance with the codified regulations and recommend best management practices in these site conditions the structure cannot be rennoveable. A variance to the provisions of Chapter I 11 is respectfully requested so that the Coastal Erosion Pen-nit can be issued for this project by the Town of Trustees, No public,fwids will be expended in the course of completing this project.
