The Agricultural Advisory Committee meeting was called to order on February 3, 2021 at 7:07 pm in
the Southold Town Hall meeting hall.
Next Meeting(s):

The next regular AAC meeting will be on Wednesday, March 3, 2021 at 7:00 pm in the Southold
Town Hall meeting hall and via Zoom.
The 02/17/21 meeting will be canceled because of Spring Break.
Minutes and Administration:

Motion to approve to minutes dated January 21, Made by Karen Rivara., Seconded by Doug Cooper,
ALL approved.
Peddlers Code:
Discussion on changes to the Peddlers Code to sell flowers.
The flowers would be purchased from local farms only and sold out of a truck as bouquets.
Any change to the peddler’s code would not be just for the one person, it would open up
opportunities for others to due the same.
The change to the code would be for only raw products to be sold, nothing processed.
The change can also include mariculture or aquaculture products, also only grown on the north
fork.
Sarah Nappa will write up the changes that are being proposed and present it to the board.
Chapter 70:
Chapter 70 is ready to be presented. All of the changes that have been discussed have been
made.
Tom would like to speak to the Supervisor before going any further. He will send out an email
to the Supervisor and Sarah Nappa with the proposed changes.
The committee also feels that Sam McCullough should be informed of the progress.

Review of Planning Board Referrals:
A discussion was had on the referral given to the committee by the planning board regarding a
Barn at 1750 Sterling Lane.
The owners are asking to replace an existing barn at 1300 square feet with a barn of 4800’
square feet. The new barn will only be 20’ from the property line on the western lot line which
would require a variance from the ZBA.
Jim Glover is recusing himself from the recommendation because of his property’s proximity to
the site.
The barn would be to close to the road, could block the right of way when loading and
unloading.
After reviewing the referral more thoroughly the committee is not recommending this be
approved, but that it should follow the code and be built 60 feet off of the property line.
Tom will send out a letter stating the committees’ recommendations.
Easement Language Discussion:
The committee continued its discussion regarding the standard easement that the town (T.E.)
gave and the easement that was given to Harbes (H.E.)
Mark stated that the H.E. does reference water rights while the T.E. does not. It would be a
good idea to add some language to the T.E. about the water rights. Take the language from
the H.E. and add to Article 3 of T.E. and take out the last 2 sentences of 3.08 on the T.E.
Section 10.E on the H.E. talks about solar. Currently no solar farms allowed on Southold
Town Property
Section 10F in the H.E and Section 3.05 in the T.E. – Should be changed to refer to Town
Code, because this can be updated in the future.
Section 4.08 of the T.E - further restrictions – The easement should not allow the owner to the
right off piece by piece. Once you sell rights, that’s it. No piecemealing.
Section 7.02 of the T.E. – Add to the statement that – Any such amendment/changes shall
also be to the benefit of agriculture.
Jim suggests that we start with the H.E. format and then incorporate what we want to keep out
of the T.E. because their format is easier to understand. Or maybe going back to the 2006
version of the T.E. that was also easier to read then the current one.
Doug would like to get the changes down on paper as soon as possible to present to the
board.
Page 4 of the T.E. has the easement definition and refers to Chapter 70. This is the only place
in the entire easement where Chapter 70 is referred to.
The T.E. where it refers to Dumping and signs should not define it, but instead should state
refer to Town Code, because the code can updated over time. Utilities and mining should also
state refer to Town Code.

Aquaculture Program Update:
The SCALP program hearing did not end with a conclusion. The committee has asked for
another month before they come to a decision.
The legislation voted to close the hearing, but they may reopen it because of language they
want to change. It they change a lot of the language then it will have to go back to a public
hearing.
The committee makeup is in question, but they should require the committee to have a local
bayman and a shellfish farmer on the committee.
Tom will invite Al Krupski to the next Agricultural Advisory Committee meeting to give more
insight into what is happening.
