SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated March 29, 2021 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject, 34,484 square feet, .791 acre, non-conforming, rectangular- shaped parcel, located in the LB Zoning District measures 201.82 feet along Main Road (State Highway 25), then runs south 185.95 feet along Marratooka Lane,then runs west 200 feet along two residentially developed lots to the south, then returns north 158.89 feet along Sunset Avenue back to Main Road. The site is developed with a one- story masonry structure (retail) measuring approximately 46 feet by 27.8 feet with concrete walk, a canopy over concrete columns, measuring approximately 57.7 feet by 28.7 feet, covering two gas pump platforms, substantial paving, air pump station, a vacuum station, digital fuel sign and a diesel fuel pump station as shown on the survey prepared by Ramzan Alli,Licensed Land Surveyor,NY Land Surveyor PC and dated February 10,2021. BASIS OF APPLICATION: Request for Variances from Article XIX, Section 280-85D(7) and Section 280-87A; and the Building Inspector's March 10, 2021 Notice of Disapproval based on an application for a permit to replace three (3) existing roof signs and one(1) existing freestanding sign; at 1) four(4) signs proposed to be internally lit, which is not permitted;a sign may only be lit from an external source;2)freestanding sign is more than the maximum size permitted of 24 sq. ft. feet in area; 3) freestanding sign is more than the maximum height permitted of 15 feet above the ground; located at: 16900 NYS Route 25,Mattituck,NY. SCTM No. 1000-115-3-9. RELIEF REQUESTED: The applicant requests five variances to replace three(3)previously existing,non-permitted, internally lit roof signs and one (1), previously existing, non-permitted, internally lit free-standing sign. The three roof signs, each approximately 36 inches in diameter are located individually on the west, north and east facade of the roof canopy structure covering the two fueling stations. Each sign is internally lit and illustrates the brand logo. Page 2,June 3,2021 #7493,Leon Petroleum,BP Mattituck SCTM No. 1000-115-3-9 Internally lit signs are not permitted by Code. Furthermore, the applicant proposes to replace the one free-standing sign, also internally lit and not permitted by Code, and measuring approximately 62 square feet and 18.7 feet in height where the code limits signage to a maximum of 24 square feet with a maximum height of 15 feet. As part of the free-standing sign upgrade the applicant proposes to include a digital display `price change cabinet' along with branding logo, all internally lit where the code limits such improvements to being lit externally. ADDITIONAL INFORMATION: No member of the public or immediate neighbor spoke in favor of or against this application. The application was closed during the May 6, 2021 Public Hearing. However, the file was re-opened during that session in order to gather additional information from the applicant and adjourned to the May 20, 2021 Special Meeting and again adjourned to the June 3, 2021 Public Hearing at which time it was closed. While the application was comprehensive, including a multi-page permit pack (including site plan, canopy visuals and main ID/signage) and included substantial information on the site and the proposed upgrading of the signage including updated logo/branding and conversion of the internal lighting to LED, the applicant's agent did not illustrate the history and initial authorization of the sign placement, including internal lighting. The public hearing was adjourned to allow the applicant time to research the file further. Town Zoning Board of Appeals staff was also asked to research the files in the Town's records. The applicant provided the following information as part of their request for relief. • Articles of Organization of Leon Petroleum, LLC • Zoning Board of Appeals decision#1040 dated January 12, 1967 denying an application to retain a pole sign 5 feet from Main Road. • Zoning Board of Appeals decision#1958 dated October 3, 1974 granting Special Exception relief allowing used car sales and the placement of a second sign at the site. • Certificate of Occupancy(non-conforming premises)#Z-14455 dated May 30, 1986 covering a wood-frame building with gas pump in front. • Zoning Board of Appeals decision #3633SE dated May 13, 1987 denying an application to permit self- service dispensing of gasoline and clearly illustrates various improvements requiring Town of Southold Planning Board site plan approval and also illustrating the abandonment of the original building. • Zoning Board of Appeals decision#3636 dated May 19, 1987 denying an interpretation of"retail shopping center" and clearly illustrates various improvements requiring Town of Southold Planning Board site plan approval including lighting and signage among other improvements. • Certificate of Occupancy#35839 dated July 23, 2012 covering a canopy for an existing gasoline station as applied for. Prior to the May 20, 2021 Special Hearing, Town Zoning Board of Appeals staff located the following information, which was shared with the applicant: • A stipulation agreement dated 1989 resulting from an Article 78 proceeding that states site plan approval is required. • Town of Southold Planning Department expired site plan from 1992 for the property known as • file#1000-115-3-9 On June 1,2021,the ZBA Staff received an email from the applicant's representative informing the Board that her client didn't have any further testimony and weren't able to find any additional documents that would adequately respond to the Board's inquiries. Page 3,June 3,2021 #7493,Leon Petroleum,BP Mattituck SCTM No. 1000-115-3-9 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 6, 2021 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variances will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject parcel is operating without site plan approval by the Town of Southold Planning Board and is operating adjacent to a residential area and is located opposite agricultural fields which have been preserved via the Town of Southold Land Preservation program. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method feasible for the applicant to pursue, other than an area variance. The applicant can comply with Town Code, install compliant signage as a benefit of meeting the obligations of a functioning business in the community and by fulfilling their obligation to complete site plan review and receive a Certificate of Occupancy illustrating all improvements on the parcel. 3. Town Law 4267-b(3)(b)(3). The variances requested herein are mathematically substantial,representing 100% relief from the code relative to four internally light signs, 158% relief from the code relative to the size of the free- standing sign and 24.6% relief from the code relative to the height of the free-standing sign. 4. Town Law 4267-b(3)(b)(4). Evidence has been submitted to suggest that a variance in this community will have an adverse impact on the physical or environmental conditions in the neighborhood.The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and meet Town of Southold Planning Board site plan requirements. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. Since 1992 the applicant is aware of the obligation to complete Town of Southold Planning Board site plan review. Furthermore,the applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6.Town Law 4267-b. Grant of the requested relief is not the minimum action necessary and adequate to enable the applicant to enjoy the benefit of updated signage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. For the record, the following historical information concerning the premises and previous construction is noted upon information and belief: (a) During 1956, the premises was improved with an one-story frame building set back 21 feet from the northerly front property line [along the Main Road] and 71± feet from the easterly front property line [along Marratooka Lane], as more particularly shown by survey prepared by Otto W. VanTuyl & Son surveyed June 8, 1956. Although there is no gasoline pump shown on this 1956 survey, it is the Board's understanding that that building was used as a gasoline sales office and minor vehicle repairs, and that one gasoline pump or island existed to the north of that building. (b) Some time subsequent to 1957, the building was removed, and another building was placed as more particularly shown on the June 15, 1970 Survey prepared by VanTuyl & Son which shows setbacks from the northerly front property line at 60 feet and from the easterly front property line at 40 feet. The record is unclear as to whether or not this building was constructed under a building permit and approval by any other town departments. Town records do show that the subject premises during 1970 was zoned "A" Residential and Agricultural , and that a gasoline-service station was not listed as a "permitted use" [except in the "B-1" Business Zone District] since April 1957; (c) On or about June 7, 1965, the Zoning Ordinance provisions for the "B-1" Business District were amended to require a Special Exception approval by the Board of Appeals for a building or premises to be used as a gasoline service station or public garage [Section 420-2]; (d) On or about November 23, 1971 , the Zoning Maps were amended to include the rezoning of this property from "A" Residential-Agricultural to "B-1" General Business, and including the requirement for Site-Plan approval by the Planning Board in addition to Special Exception approval by the Board of Appeals, etc. (e) No town approvals have been found during the above time periods for the newly located building and/or site as existed since its change in 1986 to the present time. No. 3633 same date hereof]. 10. location of a glass-enclosed telephone booth at the most northeasterly corner of the premises near the Main Road; 11 . placement of new ground signs at the most northeasterly corner of the premises near the Main Road. 5. Also noted for the record is a Certificate of Occupancy for Nonconforming Premises #Z14455 dated May 30, 1986 which appears to have been based on the June 8, 1956 Survey of Otto W. Article VI , Section 100-62 of the Zoning Code reads as follows: 100-62. Retail Shopping Centers. Notwithstanding any other provisions of this Article, a building or a combination of buildings containing retail stores, mercantile establishments, offices, banks and financial institutions, commonly known as shopping centers, may be erected or altered in the B Business District, subject, however, to the following requirements: A. Approval of site development plans by the Planning Board in accordance with Article XIII hereof. B. The lot area shall be not less than one (1) acre and the lot width shall be not less than one hundred fifty (150) feet. C. At least twenty-five percent (25%) of the lot area shall be landscaped with grass and plantings. D. . The required front yards shall be not less than thirty-five (25) feet, except that where the property is in the vicinity is partly built up with permanent buildings and an average setback line has been established, no building shall project beyond the line of the average setback so established. E. The required side yards shall be not less than twenty-five (25) feet. F. The required rear yard shall be not less than twenty-five (25) feet. G. Parking shall be provided in off-street parking areas which shall provide one (1) parking space, three hundred fifty (350) square feet in area, for each one hundred (100) square feet of sales floor area or office floor area in each buildings. No. 3618 for premises now or formerly of Sukru Ilgin. i MAR 17 2021 1 Under consideration before the Board at that time was an { area variance for approval of a convenience store for the sale of packaged and non-food items (withou`t food preparation or on-premises food services) , in conjunction with the existing gasoline station with minimal floor area for retail sales (less than 700 sq. ft. ). In that application an interpretation was not requested, and �Q 3 a conditional variance was granted for the small-scale 9iv retail sales area and further required that the use be related, "accessory and incidental to the existing gasoline station use." There is no interpretation of record by this Board determining any retail use to be an accessory use to a gasoline station. 10.
