SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated March 29, 2021 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject, 34,022 square feet, .781 acre, non-conforming, rectangular- shaped parcel, located in the B Zoning District measures 194.54 feet along Middle Road (County Route 48), then runs south 182.89 feet along Paul Lane(a private road),then runs west 195.50 feet along a commercially developed property to the south, then returns north 166.96 feet along the same commercially developed parcel, back to Middle Road. The site is developed with a one-story masonry structure (retail) measuring approximately 31.9 feet by 20.1 feet with concrete walk and handicap ramp, a canopy over concrete columns covering three gas pump platforms, substantial paving, air pump station, a vacuum station, fuel sign and small storage shed and a `temporary' storage container (approximately 40 feet in length) as shown on the survey prepared by Ramzan Alli, Licensed Land Surveyor,NY Land Surveyor PC and dated February 10, 2021. BASIS OF APPLICATION: Request for Variances from Article XIX, Section 280-85D(7) and Section 280-87A; and the Building Inspector's March 10, 2021 Notice of Disapproval based on an application for a permit to replace three (3) existing roof signs and one (1) existing freestanding sign; at 1) four(4) signs proposed to be internally lit, which is not permitted;a sign may only be lit from an external source;2)freestanding sign is more than the maximum size permitted 24 sq. ft. feet in area; 3) freestanding sign is more than the maximum height permitted 15 feet above the ground; located at: 32400 County Road 48,Peconic,NY. SCTM No. 1000-74-4-7.1. RELIEF REQUESTED: The applicant requests five variances to replace three(3)previously existing,non-permitted, internally lit roof signs and one (1), previously existing, non-permitted, internally lit free-standing sign. The three roof signs, each approximately 36 inches in diameter are located individually on the west, north and east facade of the roof canopy structure covering the two fueling stations. Each sign is internally lit and illustrates the brand logo. Page 2,June 3,2021 #7494,Leon Petroleum,BP Peconic SCTM No. 1000-74-4-7.1 Internally lit signs are not permitted by Code. Furthermore, the applicant proposes to replace the one free-standing sign, also internally lit and not permitted by Code, and measuring approximately 99 square feet and 22.7 feet in height where the code limits signage to a maximum of 24 square feet with a maximum height of 15 feet. As part of the free-standing sign upgrade the applicant proposes to include a digital display `price change cabinet' along with branding logo, all internally lit where the code limits such improvements to external lighting only. ADDITIONAL INFORMATION: No member of the public or immediate neighbor spoke in favor of or against this application. The application was adjourned to the May 20,2021 Special Meeting, in order to allow the applicant and Town of Southold Zoning Board of Appeals staff time to gather additional information, and again adjourned to the June 3,2021 Public Hearing at which time it was closed. While the application was comprehensive, including a multi-page permit pack (including site plan, canopy visuals and main ID/signage) and included substantial information on the site and the proposed upgrading of the signage including updated logo/branding and conversion of the internal lighting to LED, the applicant's agent did not illustrate the history and initial authorization of the sign placement, including internal lighting. The applicant was not able to illustrate that a Certificate of Occupancy exists for any of the improvements they are seeking relief to alter. The public hearing was adjourned to allow the applicant time to research the file further. Town Zoning Board of Appeals staff was also asked to research the file. The applicant provided the following information as part of their request for relief: • Articles of Organization of Leon Petroleum, LLC • Zoning Board of Appeals decision#3696SE dated December 26, 1986 granting permission to establish self-service gasoline sales on the two(2)existing pump islands(platforms)on the westerly portion of the subject premises, not including the single island on the east dispensing kerosene and diesel fuel. • Certificate of Occupancy#Z-19137 dated June 12, 1990 covering a retail service station. • Certificate of Occupancy #35362 dated December 27, 2011 covering the replacement of four(4) gas tanks as applied for. On June 1, 2021,the ZBA Staff received an email from the applicant's representative informing the Board that her client didn't have any further testimony and weren't able to find any additional documents that would adequately respond to the Board's inquiries. Prior to the May 20, 2021 Special Hearing, Town Zoning Board of Appeals staff located the following information, which was shared with the applicant: Southold Town Planning Board Resolutions granting approval for site plan on April 1, 1985, and then an amended site plan on August 25, 1986. Neither approved site plan depicted any descriptions of signage other than the location of the freestanding sign. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 6, 2021 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law§267-b(3)(b)(1). Grant of the variances will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject parcel is located in a mixed-use area bordering a four- Page 3,June 3,2021 #7494,Leon Petroleum,BP Peconic SCTM No. 1000-74-4-7.1 lane highway;in the immediate vicinity are private residences, commercial business including landscape/contractors' yard, a large and well used community park, and agricultural fields, including farms where the development rights have been sold. Signage along the North Road/Middle Road while common for businesses tends to be discrete in nature and if lit, external not internal lighting is provided. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method feasible for the applicant to pursue, other than an area variance. The applicant can comply with Town Code and install compliant signage. 3. Town Law X267-b(3)(b)(3). The variances requested herein are mathematically substantial, representing 100% relief from the code relative to four internally light signs, 312.5% relief from the code relative to the size of the free- standing sign and 60%relief from the code relative to the height of the free-standing sign. 4. Town Law&267-b(3)(b)(4). Evidence has been submitted to suggest that a variance in this community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and meet Town of Southold Planning Board site plan requirements. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6.Town Law X267-b. Grant of the requested relief is not the minimum action necessary and adequate to enable the applicant to enjoy the benefit of updated signage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Weisman(Chairperson), seconded by Member Planamento, and duly carried,to DENY as applied for. Vote of the Board: Ayes: Members Weisman(Chairperson),Acampora, Dantes, Lehnert, and Planamento(5-0). This is an application for a Special Exception as permitted by Article VII, Section 100-70(B) , Subsections 4 and 5 of the Zoning Code for a partial self-service gasoline, kerosene and diesel pumping station. 2. The premises in question is located in the "B-1" General Business Zoning District, containing a total lot area of 34,029 sq. q ft. with 194.54 ft. frontage along the south side of Middle Road (a/k/a C.R. 48) , Peconic. 3. For the record it is noted that conditional approval was granted by the Southold Town Planning Board August 25, 1986 con- cerning the Site Plan, and conditional Temporary Certificate of Occupancy No. Z15158 and Building Permit No. 14696Z were issued concerning these premises. 6. It is also noted for the record that it is the understanding of this Board that the service building will be used for office and sales area incidental to this gasoline service station and will not be operated as a separate business use or entity. By letter dated December 23, 1986, the Town is assured that no foodstuffs requiring a food-service permit from the County Health Department will be offered for sale. 7. It shall be understood further that this project must comply with those conditions set by the Board of Appeals June 29, 1972 under Application No. 1584 for the construction of a gasoline service station, including but not limited to items (b) , (c) and (f) thereof: (b) Vehicle lifts or pits, dismantled automobiles, and all parts or supplies shall be located within a building; (c) All service or repair of motor vehicles other than such minor servicing as change of tires or sale of gasoline and oil , shall be conducted in a building; (f) No motor vehicle sales, used car lots, gasoline services or repair shops, or similar businesses, are to be located within 300 feet of a church, public school . . . or within 300 feet of any residence district. In considering this application, the board also finds and determines: (a) the use requested will not prevent the orderly and reasonable use of adjacent properties or of properties in adjacent use districts, (b) the use will not adversely affect the safety, welfare, comfort, convenience or order of the town; (c) the use is in harmony with and will promote the general purposes and intent of zoning. The board has also considered subsections [a] through [1] of Article XII, Section 100-121 (C)[2] of the Zoning Code in making this determination. Accordingly, on motion by Mr. Douglass, seconded by Mr. Goeh- ringer, it was RESOLVED, to GRANT a Special Exception in the Matter of (CONTINUED ON PAGE THREE) Page 3 - Appl . (Mobil) SIS County Road 48, 1017' w/ Peconic Lane, Peconic SCTM# 1000-74-4-7.1 Dear Mr. Moore: The Planning Board has inspected the above referenced site and finds that it cannot recommend the issuance of a Certificate of Occupancy. The following items need to be addressed: 1 . The amended site plan showing the redesigned curbing adjacent to the westerly border of the site has not been submitted. 2. The canopy exceeds the specified height. As a consequence, the lights are not properly shielded. Light shields must be installed. (An 8" deep metal shield should be wrapped around the perimeterof the canopy next to the lights. The metal should match the color and texture of the canopy closely.) 3. None of the many signs on the property have proper permits. Only one sign was shown on the site plan. 4. The site does not comply with all of the terms of the Special Exception granted by the Zoning Board of Appeals on March 5, 1987; specifically that self-service kerosene or diesel pumps, are not permitted. Upon receipt of an amended site plan and a notification that items 2 through 4 have been addressed, the site will be reinspected.
