That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. And the project site, where the applicant has operated since 1946, previously served as a brickyard from the late 1800s until shortly after the Hurricane of 1938, which breached the outer spit of land along the exterior limits of the applicant's underwater lands and allowed formation of an inlet channel and interior basin for marina operations. Since that time, this spit lining the mouth of the'marina basin has served as a protective breakwater for the marina, buffering the basin and surrounding marina lands and facilities from the flooding and erosion impacts of storms. However, faced with rising sea level and increasing storm frequency and intensity, the breakwater has been slowly eroding and subsiding for the past several decades, a process that was accelerated and exacerbated by Superstorm Sandy in 2012. As a result, a land mass that was once elevated enough to drive on is now substantially submerged at high tide; and more active and chronic erosion is now occurring along the edges of the marina's upland facilities.' If left unabated, the continued erosion and subsidence of the outside breakwater and resulting erosional losses inside the basin and adjacent lands will jeopardize the continued safe operations and use of the property as a marina and safe harbor for the public. Therefore, the applicant has been left with no choice but to seek permission to employ a remediation effort designed to restore, enhance, and stabilize the breakwater at the mouth of the basin that has historically provided flood and erosion protection for the marina. Specifically, as the existing breakwater is currently heavily laden with stone and contains swaths of high marsh plants where the spit is not yet entirely submerged at high tide, the project proposes to employ hard stabilization and"living shorelines" methodology, by 1) increasing the height of the breakwater by up to 4 feet with natural fill material to be planted with approximately 11,000, sf of native, salt-tolerant vegetation; 2) stabilizing the north/leeward side of the raised breakwater with stone rip-rap on the face of the breakwater and a low-sill bulkhead constructed inside the basin, seaward of the breakwater, to create a platform for the establishment of approximately 5,200 sf of Spartina alterniflora and Spartinaap tens; and 3) stabilizing the south/windward side of the raised breakwater with larger stone toe armor. By designing for its long term protection to ensure that the marina can continue to safely function as one of Southold's oldest water-dependent uses, thereby ensuring the marina's future availability to the public as a site for safe harbor and access to Mill Creek and Shelter Island Sound, the project is consistent with LW" Policies 9 and 10. The project is also consistent with the permitting standards of Chapter 275, Wetlands, and with Policies 4, 5, and 6 of the LW", as a strictly non-structural approach is not viable in the face of continued sea level rise and the natural erosion and subsidence of the breakwater. But by using living shorelines methodology combined with the renourishment and hard stabilization, the project would result in the planting of 16,200 sf of native wetland'and salt-tolerant vegetation, far exceeding the existing and steadily decreasing vegetative coverage of the breakwater. Both the stone rip-rap and the larger stone armor have been designed to the minimum scale necessary to stabilize the elevated and revegetated spit of land. And in addition to erosion control, the created intertidal marsh enabled by the low-sill bulkhead, which will be submerged at least 12 inches below mean high tide, will enhance the breakwater's wetland functions and values, such as marine food production, habitat, and water quality. Therefore, the hard stabilization components, combined with the living shoreline elements of the 11 P-age r r proposed project, will 1) restore and enhance the breakwater's ability to protect the marina against the adverse impacts of flooding and erosion; and 2) protect the quality of surface waters and the quality and functions of the surrounding ecosystem, all without adversely affecting natural coastal processes or natural resources, including the tidal waters and wetlands of Mill Creek. And the project site, where the applicant has operated since 1946, previously served as a brickyard from the late 1800s until shortly after the Hurricane of 1938, which breached the outer spit of land along the exterior limits of the applicant's underwater lands and allowed formation of an inlet channel and interior basin for marina operations. Since that time, this spit lining the mouth of the marina basin has served as a protective breakwater for the marina, buffering the basin and surrounding marina lands and facilities from the flooding and erosion impacts of storms. However, faced with rising sea level and increasing storm frequency and intensity, the'breakwater has been slowly eroding and subsiding for the past several decades, a process that was accelerated and exacerbated by Superstorm Sandy in 2012. As a result, a land mass that was once elevated enough to drive on is now substantially submerged at high tide; and more active and chronic erosion is now occurring along the edges of the marina's upland facilities. If left unabated, the continued erosion and subsidence of the outside breakwater and resulting erosional losses inside the basin and adjacent lands will jeopardize the continued safe operations and use of the property as a marina and safe harbor for the public. Therefore, the applicant has been left with no choice but to seek permission to employ a remediation effort designed to restore, enhance, and stabilize the breakwater at the mouth of the basin that has historically provided flood and erosion protection for the marina. Specifically, as the existing breakwater is currently heavily laden with stone and contains swaths of high marsh plants where the spit is not yet entirely submerged at high tide, the project proposes to employ hard stabilization and "living shorelines" methodology, by 1) increasing the height of the breakwater by up to 4 feet with natural fill material to be planted with approximately 11,000 sf of native, salt-tolerant vegetation; 2) stabilizing the north/leeward side of the raised breakwater with stone rip-rap on the face of the breakwater and a low-sill bulkhead constructed inside the basin, seaward of the breakwater, to create a platform for the establishment of approximately 5,200 sf of Spartina alterniflora and Martina patens; and 3) stabilizing the south/windward side of the raised breakwater with larger stone toe armor. By designing for its long term protection to ensure that the marina can continue to safely function as one of Southold's oldest water-dependent uses, thereby ensuring the marina's future availability to the public as a site for safe harbor and access to Mill Creek and Shelter Island Sound, the project is consistent with LWRP Policies 9 and 10. The project is also consistent with the permitting standards of Chapter 275, Wetlands, and with Policies 4, 5, and 6 of the LWRP, as a strictly non-structural approach is not viable in the face of continued sea level rise and the natural erosion and subsidence of the breakwater. But by using living shorelines methodology combined with the renourishment and hard stabilization, the project would result in the planting of 16,200 sf of native wetland and salt-tolerant vegetation, far exceeding the existing and steadily decreasing vegetative coverage of the breakwater. Both the stone rip-rap and the . larger stone armor have been designed to the minimum scale necessary to stabilize the elevated and revegetated spit of land. And in addition to erosion control;,the created intertidal marsh enabled by the low-sill bulkhead, which will be submerged at least 12 inches below mean high tide, will enhance the breakwater's wetland functions and values, such as marine food production, habitat, and water quality. Therefore, the hard stabilization components, combined with the living shoreline elements of the I Page proposed project, will 1) restore and enhance the breakwater's ability to protect the marina against the adverse impacts of flooding and erosion; and 2) protect the quality of surface waters and the quality and functions of the surrounding ecosystem, all without adversely affecting natural coastal processes or natural resources,including the tidal waters and wetlands of Mill Creek. It should also be noted that a preliminary version of the restoration plan submitted herein had been granted approval for future construction grant assistance by the Governor's Office of Storm Recovery pursuant to the NY Rising Small Business Recovery Program following Superstorm Sandy, but the limited time allowed for extensive hydrographic surveying, engineering design, and permit acquisition prevented the grant from being closed and secured.
