TERMS AND CONDITIONS The Permittee James Weeden residing at 1175 Bridge Lane, Cutchogue,New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: 1. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months,which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 11. No right to trespass or interfere with riparian rights. JAMES-WEEDEN 1175 BRIDGE LANE, CUTCHOGUE SCTM# 1000-118-2-16.1 Dear Ms. Costello: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, June 16, 2021 regarding the above matter: WHEREAS, Costello Marine Contracting Corp., on behalf of JAMES WEEDEN applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated April 22, 2021, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed construction of a 178'± of 1.5 to 2 ton rock revetment landward of the tidal wetlands boundary line; be found Inconsistent with the LWRP, and, WHEREAS, the LWRP Coordinator issued a recommendation that the proposed action to install 12" diameter fiber coir logs at base of bank; establish and perpetually maintain a 10' wide non-turf buffer along the landward edge of the rock revetment; vegetate buffer area with Cape American beach grass; and replant any disturbed plantings in the wetland area; be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the Board of Trustees has furthered the Local Waterfront Revitalization Program policy to the greatest extent possible through the imposition of the following Best Management Practice requirements: Trustee field inspection revealed additional erosion at site thereby necessitating the proposed rock revetment; and, 2 WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on June 16, 2021, at which time all interested persons were given an opportunity to be heard, and, --W--HEREASthe-Board_members_haue_personalty-viewed_and-ar_e_familiar_with_the premises in question and the-surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268 of the Southold Town Code, and, RESOLVED, that the Board of Trustees APPROVES the application of JAMES WEEDEN to construct 178'± of 1.5 to 2 ton rock revetment landward of the tidal wetlands boundary line; install 12" diameter fiber coir logs at base of bank; establish and perpetually maintain a 10' wide non-turf buffer along the landward-edge of the rock revetment; vegetate buffer area with Cape American beach grass; and replant any disturbed plantings in the wetland area; and as depicted on the site plan prepared by Costello Marine Contracting Corp., last dated August 15, 2018 and stamped approved on June 16, 2021. NEGATIVE DECLARATION OF ENVIRONMENTAL SIGNIFICANCE: WHEREAS, the Southold Town Board of Trustees are familiar with this project having visited the site on June 8, 2021, and having considered the survey of property by Peconic Surveyors, P.C. dated August 7, 1995, and having considered the plans for this proposed project submitted by Costello Marine Contacting Corp. dated August 15, 2018 at the Trustee's June 14, 2021 work session, and WHEREAS, on June 16, 2021 the Southold Town Board of Trustees declared itself Lead Agency pursuant to S.E.Q.R.A., and WHEREAS, on June 16, 2021 the Southold Town Board of Trustees classified the application as an unlisted action under S.E.Q.R.A., and WHEREAS, in reviewing project�plans submitted by Costello-Marine Contacting Corp. dated August 15, 2018 it has been determined by the Board of Trustees that all potentially significant environmental concerns have been addressed as noted herein: • Vegetative, non-structural measures are not capable of stabilizing the erosion of the bank alone. • Protection of the toe of bank using hardened structures including rock revetment is necessary. • As time progresses, continued soil loss at the toe of the bank may lead to habitat degradation and bank instability. • A site inspection by the Southold Town Board of Trustees recognized erosion on this property and the need for a bank stabilization/erosion control plan. THEREFORE, according to the foregoing, the Southold Town Board of Trustees Approve and Authorize the preparation of a Notice of Negative Declaration pursuant to SEQRA for the aforementioned project. The rate of erosion does not appear severe enough to warrant a rock revetment as the only practical design to control erosion.
