SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION:The relief,permit,or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a 14 506 sq. ft. parcel located in an R-40 Zoning District. The parcel has a frontage on Sterling Road of 70.00 ft,then runs northwest for 159.23 feet to the rear property line where it turns east for 123.41 feet before returning 150.00 feet south to Sterling Road. The property is unimproved as shown on Survey prepared by John Metzger, L.S dated August 20, 2012. BASIS OF APPLICATION: Request for Variances from Article XXIII, Section 280-124;and the Building Inspector's February 12, 2021 Notice of Disapproval based on an application for a permit to construct a new single-family dwelling; at 1) located less than the code required front yard setback of 35 feet; 2)more than the code permitted maximum lot coverage of 20%; located at: 1375 Sterling Road, Cutchogue, NY. SCTM No. 1000-104-2-24. RELIEF REQUESTED: The applicant requests variances to construct a new dwelling with a front yard setback of 20.2 ft where a 35 ft minimum is required and with a total lot coverage of 20.68% where a maximum lot coverage of 20% is permitted. Page 2,May 20,2021 #7491,Melly SCTM No. 104-2-24 ADDITIONAL INFORMATION: Testimony from the owners was taken at the hearing regarding the proposed lot coverage of the house. The property is unimproved, but due to a paper road on its west side, it becomes a corner lot with two front yards. The Zoning Board of Appeals granted the owners a waiver of merger on October 9, 1997, Appeal No. 4508; and again, on December 6, 2012, Appeal #6603, as the result of the lands merged due to estate planning. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 6,2021 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the requested relief for the front yard setback will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed residence is situated on a lot with two front yards, with one of them being on a paper road that does not exist outside of the legal status. The neighborhood consists of similar sized single-family dwellings, and this proposed dwelling would be of the same size as the surrounding properties. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant or cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance.The front yard setback relief sought is from a paper road that has its status on the tax map only, it appears as a neighboring side yard. If the paper road was not there, there would be no need for the front yard setback variance. 3. Town Law&267-b(3)(b)(3). The variance granted herein for front yard setback relief is mathematically substantial, representing 42%relief from the code. However,the variance sought is from a paper road that exists in its legal status only. If not for the adjacent paper road, the proposed residence would meet the setback requirements. The variance requested for lot coverage represents 3.4%. from the code. However, the applicant has the option to make slight revisions to the design of the proposed new dwelling in order to reduce the lot coverage from 20. 68% in order to conform to the maximum 20% lot coverage permitted by code. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law&267-b. Grant of the variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a single-family dwelling while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Page 3,May 20,2021 #7491,Melly SCTM No. 104-2-24 RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Lehnert,seconded by Member Dantes, and duly carried,to 1. DENY the variance for total lot coverage of 20.68 %; and 2. GRANT the variance for a reduction of the front yard setback to the proposed 20.2 ft where a minimum of 35 ft is required. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant shall submit two original site plans and architectural plans reflecting the approved improvements having no more than 20% lot coverage. 2. The proposed covered patios shall remain unenclosed and unhabitable space. Before applLing for a building permit, the applicant or agent must submit to the Board of Appeals for approval andfiling, two sets of the final site plan, architectural plan, and recalculation of lot coverage conforming to the alternative relief granted herein. The ZBA will forward one set of approved, stamped drawings to the Building Department. Failure to follow this procedure may result in the delay or denial of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. In the event that this is an approval subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 1, 2012, at which time written and oral evidence were presented. Pursuant to § 280-11 the Applicant has submitted documentation,to the satisfaction of the Board that these lots were merged consequent to estate planning by the owners. There have been no transfers of ownership outside the family since the time merger was effected. Melly)to son(Joseph M.Melly)subject to a life estate of the father in 2010, for estate planning purposes, thereby effectuating the re-merger. By physical inspection, the lot consists of mature trees and there is no evidence of any structural improvements to the vacant parcel. (3) The proposed waiver and recognition will not create an adverse impact on the physical or environmental conditions in the neighborhood or district because any dwelling that could be constructed on the unimproved lot would be small and in keeping with the neighborhood homes due to current zoning regulations. In addition, the neighborhood is almost built out and the vacant lot is one of the few that remains unimproved. The topography of the vacant parcel is relatively level. It appears that the lot would not require any fill or contour changes.
