SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated March 12, 2021 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION:The relief,permit,or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject, non-conforming 31,078 square feet, .75-acre, rectangular lot located in the R40 residential zoning district measures 121.27 feet along Main Road — S.R.25A then runs north 297.03 feet along a residentially developed lot to the west, then runs 78.15 feet east along a residentially developed lot to the north, then returns 298.16 feet along a third, undeveloped, residential lot to the east. The site is improved with a two story, wood frame single family residence with covered front porch, a rear stone patio with trellis over, and inground pool with stone patio surround, a small shed,a frame building with attached frame deck, substantial and extensive asphalt paved parking and driveway,a front paver walk leading to Main Road and extensive fencing as shown on the survey prepared by John T. Metzger, surveyor, Peconic Surveyors, P.C. and dated May 30, 2019, updated November 4, 2020 to illustrate parking spaces. BASIS OF APPLICATION:The applicants request a Special Exception pursuant to Article III,Section280- 13B, subsection 14 of the Zoning Code,to operate a Bed and Breakfast within their existing single-family dwelling,accessory and incidental to their principal residential occupancy under the Building Department's Certificate of Occupancy Z-28573 dated July 8, 2002. The applicant proposes four (4) bedrooms for lodging and serving of breakfast to eight(8) B & B casual, transient roomers consisting of 3 independent bedrooms and one bedroom suite containing a second bedroom, accessed via a bathroom. A two family dwelling is not recognized in R-40 Zoning District. The single-family dwelling was converted from a two- Page 2,May 20,2021 #7489SE,Dellaportas SCTM No. 1000-31-3-21 family dwelling through additions and alterations by removing a second kitchen on the second floor under Certificate of Occupancy No.: Z28572 dated 07/08/2002.The two family residence is not recognized in the R-40 zone. ADDITIONAL INFORMATION: The applicant provided floor plans illustrating owner and guest areas prepared by Robert 1. Brown, Architect,P.C. and dated February 19, 2021. The subject property has in the past operated as a B&B under the following ZBA decision's: #5997 issued March 13, 2007 Permitting three (3) guest rooms for lodging and serving of breakfast to six(6)casual,transient roomers. #5206 issued December 13, 2002 Permitting two (2) guest rooms for lodging and serving of breakfast to four(4)casual,transient roomers. The subject property was developed prior to 1957; improvements are covered by the following Certificates Of Occupancy: #Z-28573 issued July 8, 2002 Pre Existing Certificate of Occupancy for a dwelling built prior to April 9, 1957 including a one family dwelling with accessory storage shed (replacing Pre-C of 0 Z-19824 dated April 2, 1991) consisting of 5 rooms on the first floor and 4 rooms on the second floor with 2 bathrooms and 2 open porches. #Z-41497 issued October 3, 2020 Accessory in-ground swimming pool fenced to code as applied for. The subject property is listed on the historic building/places inventory by the Southold Town Landmark's Preservation Commission. It is also listed on the Society for Preservation of Long Island Antiquities (SPLIA) list. While not the subject of this application,the applicant is in process of converting an existing shed previously used as habitable space consisting of a living room with exterior deck, full kitchen,full bath and one bedroom to a pool house with outdoor shower. A notice of Disapproval, dated July 2, 2018,was issued to the property owner indicating"the proposed construction constitutes a second dwelling unit in the accessory building". Town of Southold-Building Department/Fire Marshal offered commentary dated March 30, 2021 based upon their interior inspection of the premises on March 29,2021 indicating: • The room labeled "Bedroom 6" on the floor plan provided with the application cannot be used as a guest room. This room does not have access to proper egress as required by the building code. Egress through an intervening bathroom is not permitted. • The room labeled"Bedroom 4"on the floor plan provided with the application was found to contain a full bathroom. It appears this bathroom was constructed without a permit. The subject property was inspected by a member of the Zoning Board of Appeals on Friday,April 30,2021. The applicant and their agent were present during the site inspection. In support of their application the applicant provided the following documents to illustrate their residency: 9 Copy of a NYS Department of Motor Vehicles Interim License Page 3,May 20, 2021 #7489SE,Dellaportas SCTM No. 1000-31-3-21 • Suffolk County Deed L12941 p124 • An affidavit of residency • Copy of a State of New York Department of Taxation and Finance 2020 STAR Credit refund check • Copy of a NYS Vehicle Registration • Copy of a Citizens One Mortgage statement During the public hearing the applicant offered to `remove' bedroom #6 from the application, thereby altering their request from four(4)guest rooms to three(3)guestrooms and indicated that they will use the room labeled as"bedroom#6"for storage. Additionally,the applicant offered to file an `as built' building permit to legalize the bathroom associated with bedroom #4 and will obtain a building permit for the conversion of the existing shed (used without a permit as habitable space)to a pool house. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 6, 2021 at which time written and oral evidence were presented.Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood,and other evidence,and upon review of the code requirements set forth pursuant to Article III, Section 280-13B(14) to establish an Accessory Bed and Breakfast, the Board finds that the applicant complies with the requirements for the reasons noted below: 1. Argyris Dellaportas, the applicant herein, is the owner of the property located at 9625 Route 25 (AKA Main Road) East Marion, NY SCTM #1000-31-3-21. It is improved with a single-family residence as shown on the survey prepared by John T. Metzger, surveyor,Peconic Surveyors,P.C. and dated May 30, 2019, updated November 4, 2020. The owner will continue to occupy same as their principal residence while the Accessory Bed and Breakfast facility is managed and operated. 2. The owner/applicant submitted the following documents as proof that the subject premises is their principal dwelling: driver's license, vehicle registration, STAR Exemption and an avadavat of residency. 3. The applicant's plans comply with the on-site parking requirements and provide for greater than five (5) parking spaces, two for the principal single-family use and one (1) for each of the Accessory Bed and Breakfast bedroom(s) 4. The applicant complies with the requirements of a dwelling unit as defined in Section 280-4 of the Zoning Code 5. The Accessory Bed and Breakfast, as applied for, is reasonable in relation to the District in which it is located, adjacent use districts, and nearby and adjacent residential uses. 6. The Special Exception is accessory to the principal use and will not prevent the orderly and reasonable use of adjacent properties. 7. This accessory Bed and Breakfast will not prevent the orderly and reasonable uses proposed or existing in adjacent use districts. 8. No evidence has been submitted to show that the safety, health, welfare, comfort, convenience or the order of the town will not be adversely affected. 9. This zoning use is authorized by the Zoning Code through the Zoning Board of Appeals as noted herein,and issuance of a Certificate of Occupancy from the Building Inspector is required by code before an Accessory use may be occupied. 10. No adverse conditions were found after considering items listed under Section 280-142 and 280- 143 of the Southold Town Zoning Code. 11. Submission of a Certificate of Compliance or similar document will be necessary for issuance by the Building Inspector certifying that the premises conforms to Chapter 280 of the Zoning Code for an Accessory Bed and Breakfast use. Page 4,May 20, 2021 #7489SE, Dellaportas SCTM No. 1000-31-3-21 RESOLUTION OF THE BOARD:In considering all of the above factors,motion was offered by Member Planamento,seconded by Member Acampora, and duly carried to GRANT the Special Exception permit for an Accessory Bed and Breakfast for three(3)guest bedrooms as Amended, to be used only in conjunction with the applicants-owners residence, and shown on the survey prepared by John T. Metzger, surveyor, Peconic Surveyors, P.C. and dated May 30, 2019, updated November 4,2020 and on the floor plans prepared by Robert I. Brown,Architect,P.C. and dated February 19, 2021. SUBJECT TO THE FOLLOWING CONDITIONS: 1. This Special Exception Permit requires an operating permit and inspection by a Building Inspector from the Building Department that must be renewed annually.It is the applicant's responsibility to contact the Building Department each year to schedule the required inspection.Failure to do so may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. 2. This Special Exception permit cannot be transferred to new owners. 3. The applicants must certify annually by affidavit or other proof that they remain the sole owners/shareholders of the subject premises. In the event of transfer of ownership to an LLC or if other shareholders are added to the LLC, the Zoning Board of Appeals shall hold a hearing to determine if the special exception should be rescinded based on the fact that the property is no longer a principal residence. 4. The applicant is to obtain an updated Certificate of Occupancy for the single-family residence including but not limited to the `as built' bathroom located in bedroom #4 and the bedroom labeled#6 reverted back to storage. This Certificate of Occupancy is to clearly illustrate the actual number of bedrooms and bathrooms contained in the residence. A copy shall be provided to the Zoning Board of Appeals prior to the issuance of the B&B permit. 5. The applicant must legalize the use of the shed either as `storage' or properly convert it to a pool house, in compliance with Chapter 280-4, Definitions (Cabana/pool house), within 12 months of the issuance of the B&B permit. Failure to comply with this condition may nullify the issuance of the B&B permit. 6. A sign is to be placed in a conspicuous and visible location that there shall be no backing out of cars onto Route 25/Main Road from the subject property. 7. A sign shall be placed along the driveway facing the exit indicating"No Left Turn". 8. A flexible/roll ladder is to be visibly located in each guest bedroom for emergency purposes and properly installed. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. In the event that this is a special permit subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. Any violations of the conditions, occupancy or other requirements described herein, may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception permit as granted herein. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. The owners had converted an existing one-story frame building with an existing bathroom to a pool house. The Town of Southold did not have a record of the existing structure, other than on a pre-co and old surveys. The building Department requested a permit since the building had been renovated. I needed plans and a new survey. After months waiting for John Ehlers to update the existing survey, we changed surveyors. We retained Peconic Surveyors. In May 2019 Rob Brown provided plans of the pool house. I personally went to file the building permit for the conversion. Upon my attempt to file for the building permit,I was advised by Mr. Verity that the Building Department did not have records of the existing bathroom. I started the process to obtain Health Department for the 1/2 bath in the pool house. I ordered a revised survey with the sanitary from Peconic Surveyors. I thereafter filed an application with the Health Department on January 15, 2020. Upon their review,the Health Department requested floor plans of the entire house. Due to COVID-19, it took some time for the plans to be prepared. On October 15, 20201 submitted the floor plans of the entire house and the revisions to the survey requested by the Health Department. I have monitored the Health Department portal and called the Health Department,we are waiting for the approval to replace the existing functional cesspool and connect the pool house and house to a new system. Since the date of my last communication, one year ago, we obtained Health Department approval for the existing sanitary system, subject to recording of C&Rs for the "drivable covers" of the sanitary system. We have been working to satisfy this condition in order to get the survey with a green stamp which the Building Department requires. We have been delayed in recording the HD covenants. The County of Suffolk requires a current title policy (not older than 15 days from issuance) which takes them over 30 days to review resulting in a constant expiration of the title policy. This however, has not been our only obstacle. The Covenants require "consent of the mortgage holder". This consent usually takes several weeks to obtain from the lender. In this case the lender is Federal Savings & Loan-MFRS but is serviced by Citizen's Bank. After many months assuring us that the lender consent was being processed, Citizens advised that they cannot sign the consent and we must contact Federal Savings & Loan. We have been trying to obtain a contact to a department at Federal Savings & Loan. Once we obtain the consent of the lender, we must record the C&Rs with the County.
