DEBORAH PENNEY,residing at 160 Sailors Needle Road, Mattituck,New York
11952, party of the first part,
and
DEBORAH L. PENNEY, residing at 160 Sailors Needle Road, Mattituck, New
York 11952, as Trustee of THE DEBORAH L. PENNEY REVOCABLE
TRUST, parry of the second part.
WITNESSETH,that the party of the first part, in consideration of Ten Dollars and
other valuable consideration paid by the party of the second part,does hereby grant
and release unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever, in ALL that certain piece or parcel of real
property, with the buildings and improvements thereon erected, situate, lying and
being in the Village of Mattituck, in the Town of Southold, County of Suffolk and
State of New York, known as lot number 9 on a certain map entitled, "Map of Salt
TAX Lake Village, Mattituck, Long Island prepared by Otto H. Van Tuyl, C.E., filed in
DESIGNATION the Suffolk County Clerk's Office on May 10, 1940 as Map No. 1310. Together
with all the right, title and interest of the party of the first part in and to the road in
Dist.: 1000 front of said premises to the center line thereof. Together with a 1/54th interest of,
in and to so much of lots 27 and 28 on"Map of Property of Lida Bartley,Mattituck,
Sec.: 144.00 L.I.", which map was filed in the Suffolk County Clerk's Office on July 27, 1922
Blk,:05.00 under number 770,as are included in the extension of Old Salt Road from the North
line of Salt Lake Village to Salt Lake Lane (sometimes called Rochelle Place),
Lot: 026.000 subject to a right of way of the owners of numbered lots on the Map of Salt Lake
Village and others over the same and together with a right of way over Salt Lake
Lane (sometimes called Rochelle Place)to Bay Avenue. Together with the right of
ingress and egress between said lot and Salt Lake Lane (sometimes called Rochelle
Place)over the roads and extension on said map,and subject to the right of ingress
and egress granted or that may hereafter be granted, to other owners of numbered
lots on said map, and together with a right of way over the path as shown on said
map from Old Salt Road to Salt Lake Village Beach and to the use of said beach in
common with other lot owners for bathing and boating. Together with an easement
to use The Commons, yacht basin, the Village dock and boat landing and the two
paths leading thereto from the flagpole circle, subject to the use of the same in
common by any or all owners of numbered lots shown on said map and others'to
whom the same may be granted. Reserving to the former grantor, Frank Richards,
the easterly half of the private boat landing in front of said lot, together with an
easement of ingress and egress over the westerly half of said dock to the Village
dock and boating landing as shown on said map. Subject to such easements as have
heretofore been granted to the Long Island Lighting Company and to the New York
Telephone Company, to lay gas mains, electric conduits, erect poles and stretch
wires and cables thereon over the roads shown on said map on Salt Lake Village to
provide public utility serve to owners and tenants. Subject to the following
covenants and restrictions,which have been imposed upon the numbered lots shown
on Map of Salt Lake Village: It is hereby stated by and agreed between the parties
hereto that it is and shall continue to be the plan and intention of the parties hereto
that the property shown on the Map of Salt Lake Village aforesaid shall be used and
occupied for residential purposes only and so developed as to enhance the benefits
and pleasure resulting from that use, and to that end and purpose, it is hereby
covenanted and agreed: (1) that there shall be erected upon such lots, none other
than the buildings for residential use which shall be not more than one and one-half
stories in height, and one-story garages and other out buildings to be used in
connection with such residences; (2) that no house, garage or other out buildings
shall be erected on any such lot within 25 feet of the street front, bay front or side
lines of an adjoining lot on said map;(3)that no business nor commerce of any kind
shall be conducted upon said lots nor any of them, nor on the adjoining beach or
water ways; (4) that each lot owner by the acceptance of a deed of conveyance
covenants and agrees to share, in like proportions as the number of lots by him
owned is to the total number of lots on said map, in the proper upkeep and repair of
the roads,paths,village dock and boat landing, such contributions not to exceed the
sums of$2.00 per month per lot during the term of such ownership, and to be paid
to the party of the first part or its assigns; and (5) that these covenants and
agreements shall run with the land and be binding upon each and all present and
future owners of numbered lots shown on said map.
Said premises known as 160 Sailors Needle Road,Mattituck,New York 11952.
BEING AND INTENDED TO BE the same premises conveyed to the party of the
first part by Deed dated April 22, 1987 and recorded in the Suffolk County Clerk's
Office on June 3, 1987 in Liber 10333 at Page 120.
Together with the appurtenances and all the estate and rights of the party of the first
part in and to said premises;
To have and to hold the premises herein granted unto the party of the second part,
the heirs or successors and assigns of the party of the second part forever.
And the party of the first part covenants that the party of the first part has not done
or suffered anything whereby the said premises have been encumbered in any way
whatever,except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law,
covenants that the party of the first part will receive the consideration for this
conveyance and will hold the right to receive such consideration as a trust fund to
be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part
of the total of the same for any other purpose.
