unto the party of the second part,the heirs or successors and assigns of the party of the second part

ALL that certain plot, piece or parcel of land,with the buildings and improvements thereon erected,
situate, lying and being in the Town of Southold, County of Suffolk and State of New York, being bounded
and described as follows:
BEGINNING at a monument on the easterly line of Bayview Road about 786 feet southerly along said
easterly line from Pine Neck Road, said point of beginning being the southwesterly corner of land of
Zarzecki and the northwesterly corner of land now or formerly of Southold Development Corporation;from
said point of beginning.
RUNNING along said land of Zarzecki, South 70 degrees 03 minutes 10 seconds East a distance of 190.0
feet;
THENCE along said land now or formerly of Southold Development Corporation,2 courses, as follows: (1)
South 18 degrees 56 minutes 50 seconds West a distance of 100.0 feet;thence
(2)North 70 degrees 03 minutes 10 seconds West a distance of 190.0 feet to said easterly line of Bayview
Road;
THENCE along said easterly line of Bayview Road, North 18 degrees 56 minutes 50 seconds East a
distance of 100.0 feet to the point of beginning.
Being and intended to be the same premises conveyed to the party of the first part by deed dated June 8,

AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose.The word"party"shall be construed as if it read"parties"whenever the
sense of this indenture so requires.
