BARGAIN AND SALE DEED with Covenant against Grantor's Acts
THIS INDENTURE, made the 81h day of March 2021, delivered the 12th day of
March, 2021 BETWEEN
BAYSHORE ROAD, LLC., 3345 Bayshore Road, Greenport, NY 11944, party
of the first part and
STERLING BRENT REAL ESTATE LTD, 74 Broadway, Amityville, NY
11701, party of the second part.
WITNESSETH, that the party of the first part in consideration of ten dollars and
other valuable consideration paid by the party of the second part, does hereby grant and
release unto the party of the second part, the heirs or successors and assigns of the party
of the second part, forever,
ALL that certain plot, piece or parcel of land, with the buildings and
improvements thereon erected, situate, lying and being in the
(see attached schedule "A")
Being the same premises described in the deed to the parties of the first part herein
dated October 7, 2002 and recorded August 8, 2018 in Liber 12973 page 20 in the
Office of the County Clerk, County of Suffolk, State of New York.

TOGETHER with all right, title and interest, if any, of the party of the first part
of, in and to any streets and roads abutting the above described premises to the center
lines thereof; TOGETHER with the appurtenances and all the estate and rights of the
party of the first part in and to said premises; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the heirs or successors and assigns of the
party of the second part forever.
AND the party of the first part covenants that the party of the first part has not
done or suffered anything whereby the said premises have been encumbered in any way
whatsoever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law,
covenants that the party of the first part will receive the consideration for this conveyance
and will hold the right to receive such consideration as a trust fund to be applied first for
the purpose of paying the cost of the improvement and will apply same first to the
payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of
this indenture so requires.

ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Town of Southold, County of Suffolk and State of
New York, known and designated as part of Lots 58 and 59 on a certain map entitled "Map
of Wickham Park Lots" formerly owned by Westfield City Realty Corporation, located at
Arshamomoque, Town of Southold, Suffolk County, New York, surveyed July 13, 1927 by
Otto Van Tuyl, Engineer and Surveyor of Greenport, New York and filed in the Office of the
Clerk of Suffolk County, September 28, 1927, as Map No. 644 which said lots are more
particularly bounded and described as follows:
BEGINNING at a point on the easterly side of Bayshore Road distant 930.64 feet northerly
from the corner formed by the intersection of the easterly side of Bayshore Road with the
northerly side of Island View Lane, said beginning point also being where the division line
between lots 59 and 60 intersects the easterly side of Bayshore Road;
RUNNING THENCE North 23 degrees 51 minutes 00 seconds West along the easterly side
of Bayshore Road 100.00 feet to the division line between lots 57 and 58;
RUNNING THENCE North 66 degrees 09 minutes 00 seconds East along said division line
153.51 feet to the tie line along the apparent high water mark on 4/26/2018 of the Peconic
Bay;
RUNNING THENCE South 17 degrees 14 minutes 09 seconds East 100.69 feet along the
apparent high water mark on 4/26/2018 of the Peconic Bay to the division line between lots
