State Environmental Quality Review NEGATIVE DECLARATION Notice of Determination of Non-Significance Project: New additions and alterations to existing facilities for the Mattituck Fire District. Date: September 12,2023 This notice is issued pursuantto Part 617 of the implementing regulations pertaining to Article 8.' (State Environmental Quality Review Act)of the Environmental Conservation Law. The board of Fire Commissioners of the Mattituck Fire District,as lead agency,has determined that the proposed action described below will not have a significant effect on the environment and a Draft Environmental Impact statement will not be prepared. Name of Action: Mattituck Fire District proposed firehouse additions and alterations. SEQR Status: Unlisted Conditioned Negative Declaration:No Description of Action(s): Addition to existing firehouse facility and related alterations and site work located at 1000 Pike 1000 Pike Street, Mattituck,New York 11952 The project includes the relocation of an existing dated wood frame firehouse building on site(which has previously received a building permit),demolition of an existing wood frame residential structure used as a district office and the construction of a new addition to the side of the existing firehouse including at the location occupied-by said structures received and related alterations and site improvements in accordance with the building floor plans,building elevations and related mechanical plans and details prepared by Martin F. Sendlewski,AIA a licensed architect in the State of New York: Reasons Supporting This Determination:The proposed action is not anticipated to result in any adverse environmental impacts based on the following: 1. Commencing on or about November 16,2022,a preliminary meeting was held to determine the. scope of the project.As a result of the meeting subsequent design plans were developed, reviewed and revised at meetings held on February 7,2023.and May 30,202.3..The conceptual plans were developed to determine as to whether the,existing site, if expanded and upgraded, would be sufficient to meet the needs of the fire district. 2. The resultant plans demonstrated that adequate additions and alterations to the existing facilities would be sufficient to.accommodate the needs of the district.. 1 3. On or about July 25,2023,the Board of Fire Commissioners of the Mattituck Fire District issued a Part 1 Short Form Environmental Assessment Form (EAF)providing information. 4. On or about July 25, 2023,the Board of Fire Commissioners of the Mattituck Fire District issued a notice of intent to declare lead agency status pursuant Title 6 NYCRR,Part 617, 617.6(b), (1),resolved to perform coordinated review and to circulate the Short Environmental Assessment form and associated plan. 5. The Town of Southold Town Board,Town of Southold Department of Planning, Town of South Engineering Department, Suffolk County Department of Planning,.Town of Southold Department of Highways; Suffolk.County Department of Health Services Wastewater Management Division,New York State Department of Transportation were determined to be involved and interested agencies Were provided a Short Environmental Assessment Review Form Part 1,site plan,floor plans and elevations,which were sent via US Mail on July 26, 2023. 6. On August 11,2023,the Suffolk County Department of Health Services responded to the referral and noted no objection to the Board of Fire Commissioners of the Mattituck Fire District being lead agent. The Suffolk County Department of Health Services maintains jurisdiction over project as it relates to issuance of required permit for the onsite sanitary systems that will be required as part of this project. 7. On August 17,2023,the Town of Southold Planning Board responded to the referral and noted no objection to the Board of Fire Commissioners of the Mattituck Fire District being lead agent. 8. On September 12,2023,the Board of Fire Commissioners of the Mattituck Fire District declared itself lead agent and declared the action an unlisted action. 9. The board has the necessary powers to investigate the impacts of this Action and to provide a thorough environmental assessment of this action.. 10. None of the involved.or interested agencies given notification objected to the board.of Fire Commissioners assuming Lead Agency status and did not indicate any omissions or requested revisions to the Environmental Assessment Form or the components of the proposed action. 11. The project was evaluated in terms of the responses received from involved and interested agencies and its environmental impacts in areas as set forth in the EAF including but not limited to the following: • Per the Suffolk County Health Department correspondence dated August 11, a permit. application will be submitted for the required permit including the purchase of required sanitary flow credits.from the town.of Southold.. 12. The project was evaluated in terms of the requirements previously noted by the Town of Southold Department of Planning including but not limited to the following: 2. . r • The Fire District shall obtain any required variances from the Southold Zoning Board of Appeals. • The Fire District shall complete site plan review and approval including any required revisions as required by the Town of Southold Planning Board, including but not limited to the following: ➢ Provide parking stall dimensions minimum 9' x 19'. ➢ Provide landscape details with the location and listing of landscaping, buffering and street tree plans,.including type., material, size,.quantity and location.. ➢ Provide erosion&sediment controls. ➢: Provide.signage plans and renderings if applicable. ➢ Provide photometric lighting plan per Town Code 172 Outdoor lighting. • The Fire District shallprepare a Storm Water Pollution Protection Plan(SWPPP)for review and acceptance by the Town of Southold Engineering Department and shall submit the required NOI to the NYSDEC as required for receipt of said permit. • The Fire District shall prepare and submit applications to the NYSDOT for any work to be completed for the replacement of the existing curb cut on NYS Rt. 25. 13. Board of Fire Commissioners of the Mattituck Fire District as Lead Agency under the State Environmental Quality Review Act has reviewed and otherwise undertaken a hard look at this Action, including the short Environmental Assessment Form as well as its component parts and the documents referenced herein, has compared same to the criteria for determining significance as provided in Title 6 NYCRR, part 617, 617.7, and thoroughly analyzed relevant areas of environmental concern and had found that; A. The action will not produce a substantial adverse change in existing air quality,ground or surface water quality or quantity,traffic,or noise levels; a substantial increase in solid waste production,a substantial increase in potential for erosion,flooding, leaching or drainage problems. B.. The action will not involve the removal or destruction of large quantities of vegetation or fauna; substantial interference with the movement of any resident or migratory fish or wildlife species; impacts on a significant habitat area; substantial adverse impacts on a threatened or endangered species of animal or plant, or the habitat of such a species; or other significant adverse impacts to natural resources. C. The action will not result in substantial alterations the existing site and the projects and are considered to be temporary and minor in nature. D. The action will not cause the impairment of the environmental characteristics of a Critical Environmental Area as.designated_pursuant to 6 NYCRR 617.14(g). E. The action will not create a.material conflict.with a community's current plans or goals as officially approved or adopted. F. The.action will not impair the..character or quality, of important historical, archaeological,. architectural, or aesthetic resources;or of existing community or neighborhood-character.:. . 3 r r r G. This action will not cause a major change in the use of either the quantity or type of energy. H. This action will not create a hazard to human health. I. The action will not cause a substantial change in the use of land, including agricultural,open space or recreational resources, or in its capacity to support existing uses. The site is currently in use as a firehouse facility grid will not change. J. The action.will not create a material demand for:other actions that would result in one of the above.consequences.. K. The action will not change two or more elements of the environment,neither of which has a significant impact on the environment, but when considered together result in a substantial adverse impact on the environment. L. Impacts from the action will not combine with impact of other possible independent actions in the vicinity. The lead agency finds that when considered cumulatively such combination will not create a significant adverse impact on the environment. M. The project was evaluated by applying a "hard look" review in accordance with the provisions of SEQR which has resulted in the following findings: 1) The nature and scope of the project is the construction additions and alterations to the existing firehouse facilities for the Mattituck Fire District, a special district which provides emergency and fire protection services to the residents and properties within the district. 2) The function of the land is currently,and will remain firehouse use. 3) The extent of the public interest involved in this project is essential to the extent that the fire district is the primary entity that provides fire protection and emergency response services to the residents and community and the facility is required to provide said services. 4) There is no impact upon legitimate local interest other than that of the fire district. 5) The fire district as a special governmental unit maintains the authority and responsibility for this action as the lead agency. 6) There are no local legislative zoning districts which are applicable to expanding the facilities where they exist. 7) During the design phase of the project,alternatives have been reviewed and after a thorough investigation and hard look at all aspects of the project and the needs of the district,the plans developed represent the most efficient and practical alternative to . providing the.needed.improvements. 8) Notice_of a declaration of the Mattituck Fire District as.Lead Agency and a determination.of negative significance will be forwarded to all involved agencies.. The Board of Fire Commissioners has determined that the fire district will undertake a coordinated review with respect to the proposed addition and alteration to the existing firehouse. At the present time, the approximately 2.28 acre site, located on the south east comer of Pike Street and Wickham Avenue with additional frontage on Main Road SR 25, Suffolk County NY is currently developed and improved as an existing firehouse,the use of which will not change. The fire district has declared its intention to become the lead agency for this project, to make a determination of the type of action, unlisted or otherwise, and to determine if a Negative Declaration regarding same under the State Environmental Quality Review Act'[SEQRA] is appropriate. I am enclosing for your review a site plan, building plans and elevations with respect to the proposed firehouse addition and alteration. Also enclosed is-the proposed Short Environmental Assessment Form Part 1. As the project involves the addition and alteration to an existing firehouse in a predominantly commercial location, it does not appear that the project will have any significant impacts on the environment. As the sole agency with authority to approve 4 and fund this purchase,-the Board of Fire Commissioners is the only,appropriate Lead Agency under SEQRA regulations.
