Main Rd. &Youngs Ave.) Southold, NY 11971 Telephone: 631 765-1938 • �O cDUNT`�,� LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Glenn Goldsmith, President Town of Southold Board of Trustees From: Mark Terry, AICP LWRP Coordinator Date: October 6, 2020 Re: LWRP Coastal Consistency Review of 40200 MAIN, LLC (ORIENT BY THE SEA), c/o RWN MANAGEMENT, LLC SCTM# 1000-15-9-8.1 Inter-Science Research Associates on behalf of 40200 MAIN, LLC (ORIENT BY THE SEA); c/o RWN MANAGEMENT, LLC requests an Amendment to Wetland Permit#9582 and Coastal Erosion Permit#9582C to reconfigure the proposed dingy dock assembly located on the south side of the restaurant by installing a fixed pier catwalk assembly consisting of a 4'x15' ramp down to a 4'x100' fixed pier catwalk; two (2) 3'x16' fixed finger piers; and the relocation of the existing 6'x20' floating dock in lieu of the originally proposed two (2) 4'x20' ramps down to a 4'x60' floating dock; and to widen the existing inlet from 34' wide to 45' wide in order to provide safer access in and out of the basin by relocating the bulkhead on the west side by 11' to the west of its current location in lieu of removing and replacing the west bulkheading in-place. Located: 40200 Route 25, Orient. SCTM# 1000-15-9-8.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the LWRP policies and therefore CONSISTENT with the LWRP. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list,policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant_ beneficial and adverse effects upon the coastal area(which includes all of Southold Town 3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be exi)lainM in detail, listing both supporting and non- supporting facts. The amendment request includes modifying the proposed dock arrangement on the south side of the restaurant. The original permit approval was issued for a 4'wide by 60' long floating dock with two 4'x 20' ramps down. The new proposed dock will consist of a 4'x 15'ramp down;4'x 1 00'fixed pier catwalk;two-3'x 16'fixed finger piers; and the relocation of the existing 6'x 20' floating dock. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space,makes efficient use of infrastructure, makes beneficial use of a coastal location,and minimizes adverse effects of development. See LWRP Section III—Policies; Page 2 for evaluation criteria. RI•V I Yes ❑ No ❑ Not Applicable A primary component of the desired development pattern is to encourage water dependent uses to concentrate in existing locations of maritime activity. As per this recommendation of the LWRP, the applicant is proposing to upgrade the existing marina facility to provide safe conditions for the restaurant patrons, commercial and recreational clients at the marina. The continued use of the property as a marina and restaurant will help to further encourage the boating environment which is a historic use on this property and the neighboring lots. This use will help reinforce the traditional land use pattern of the Town of Southold which enhances the character of the community. Protect and preserve historic and archaeological resources of the Town of Southold. Historically the marina has contained the charter fleet including the"North Fork Captains Association". The owner will continue the historic location of the charter fleet which draws numerous patrons to the area for the majority of the year. Enhance visual quality and protect scenic resources throughout the Town of Southold. The improvements to the property will help to visually improve the visual aspects of the property. The improvements include upgrading the existing marina facilities and renovating the existing restaurant. Proposed application is for an amendment to the previously issued permit. The requested changes are minor in nature. Attach additional sheets if necessary NATURAL COAST POLICIES Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion. See LWRP Section III—Policies Pages 8 through 16 for evaluation criteria © Yes ❑ No ❑ Not Applicable The property is improved with bulkheads along the basin and shoreline along Gardiner's Bay. These shore hardening structures are necessary to maintain the marina facility. As such the continued maintenance of the bulkheads and other marine facilities are necessary for the continued use. The improved and upgraded facilities will provide additional safe conditions for the patrons of the restaurant and the marina. The property is located next to the Plum Island Ferry and the Cross Sound Ferry terminals,the improved shoreline structures are necessary in order to provide additional support and safe conditions for these other properties. The proposed widening of the narrow inlet will improve the safe passage of vessels through the inlet promoting the safety of humans and the bulkhead. Attach additional sheets if necessary Policy 5. The nearest pump out facility is located in Greenport, almost 7 miles away. The installation of the pump out facility at the site will dramatically increase the water quality in the area. Protect and restore the quality and function of the Town of Southold ecosystems including Significant Coastal Fish and Wildlife Habitats and wetlands. Yes No Not Applicable The proposed project will not impact Gardiner's Bay or its ecosystem, as the proposed work will be confined within the existing man made boat basin. The project will adhere to the required construction and dredging requirements as mandated by the State and Federal Government. The proposed pump out facilities will help to improve the water quality in the area by providing facilities for boat discharge waste. The proposed improvements and upgrades to the facility will help to further enhance the publics enjoyment of the waterfront and water dependent uses in the Town of Southold. The marina and restaurant uses are compatible uses for this property. The continued use of the marina facilities by the local charter fleet will provide public resources for the Town of Southold. Proposed application is for an amendment to the previously issued permit. The requested changes are minor in nature. Widening of the inlet will improve public access to the facility from the water.
