En-Consultants on behalf of ISLE OF CEDARS, LLC requests a Wetland Permit and a Coastal
Erosion Permit to remove and replace in-place existing ±73' timber groin with low-profile vinyl groin.
Located: 2450 Peters Neck Road, Orient. SCTM# 1000-32-1-8
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program"(LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is CONSISTENT with the LWRP policies and therefore CONSISTENT with the
LWRP.
The structures appear to be beneficial for Hallocks Bay inlet stabilization.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
1 , All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both supporting and non-
supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.
A copy of the LWRP is available in the following places: online at the Town of Southold's website
(southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all local
libraries and the Town Clerk's office.

The project consists of the ordinary and routine maintenance of a historically existing erosion control structure,specifically the in-place replacement of an existing timber groin that pre-dates the
Town's jurisdiction over erosion control structures along the Town's bayfront Together with the surrounding groins to the east and west,the subject groin is part of a larger groin field that has
historically served to control shoreline erosion and stability along this developed shoreline through beach retention,and through its replacement,the groin will continue to help maintain the sandy
beach along a shoreline that is vulnerable to potentially severe erosion The replacement groin is proposed with the same location,configuration,and length of the existing functional groin,with a
low-profile design such that the seaward end of the grom is elevated no higher than 18 inches above the elevation of mean low water(MLW) The protect will thus maintain the historically
existing site conditions without causing adverse impacts to,or increased erosion of,the beach on the subject or surrounding properties,consistent with the permit standards set forth by Section
111-9 of the Town Code and with Policy 4 of the LWRP

The replacement of the existing treated timber groin with a groin constructed with vinyl sheathing provided the water quality benefit of
reducing the amount of treated timber located in and adjacent to surface waters,consistent with the objectives of Policy 5.

Consistent with the permit standards for groins set forth in Section 275-11(C)(1)of the Town Code,the replacement groin is proposed with the same location,
configuration,and length of the existing functional groin,with a low-profile design such that the seaward end of the groin is elevated no higher than 18 inches above the
elevation of mean low water(MLW). The new groin will also be constructed with vinyl sheathing in place of the existing treated timber groin,which provides a potential
benefit to the quality of the adjacent surface waters through the reduction of treated timber located in and adjacent to surface waters The project will thus effectively
maintain the historically existing site conditions without causing adverse impacts to,or increased erosion of,the beach on the subject or surrounding properties,with the
additional benefit of replacing a treated timber groin with a groin constructed with untreated vinyl sheathing Therefore,the project will have no adverse impacts on the
adjoining shoreline,tidal waters,or unvegetated tidal wetland area.
