SCTM# 1000-116-6-20.2 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this'department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with LWRP Policy 6.3 and therefore, INCONSISTENT with the LWRP. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are suggested. A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 5. Manage development in floodplains outside of coastal hazard areas so as to reduce adverse environmental effects, minimize the need for future structural flood protection measures, or expansion of existing protection measures and to meet federal flood insurance program standards. The proposed structure is located in FEMA flood zone AE EL 6'. The enlargement or addition of structures in Special Flood Hazard Area where flooding is high risk does not meet this policy. The site plan has thus been modified accordingly in that the proposed pool has been shifted closer to the dwelling and reduced in size so that the proposed terrace could wrap around the entire pool without changing the previously proposed combined footprint of the proposed terrace and pool. As a result,the area of the proposed pool has decreased by 191 sf from 830 to 639 square feet, and the area of the terrace has increased by an equal area from 2,165 to 2,355 square feet. As a result of these changes, which are depicted on the enclosed four (4) copies of a revised site plan prepared by Jeffrey T. A) Project Design 1) The new dwelling would be constructed in accordance with all current FEMA construction standards, with a first floor elevation one foot higher than the existing, making the new structure safer and better protected from potential flood damage. 2) Town-defined lot coverage would increase only from 8.8 to 10.9 percent as a result of the overall project; and the 3,287 sf habitable footprint of the proposed dwelling represents a 133 sf decrease from the 3,420 sf habitable footprint of the existing dwelling. 3) The new dwelling will be situated farther from wetlands than the existing dwelling,both from the tidal waters of Great Peconic Bay to the south and from the offsite vegetated tidal marsh located to the north of "Lois Lane." Specifically, the following wetland setbacks are achieved with minimum change to the presently developed footprint of the property: a. The minimum wetlands setbacks from the habitable dwelling structure will increase by 10 feet (from 65 to 75) to the northerly wetland boundary and by 2 feet (from 73 to 75)to mean high water to the south. b. The wetland setback from mean high water to the proposed bayside terrace/steps will increase by 7 feet to 61 feet from the 54' setback to the existing bayside deck. c. The proposed swimming pool will be located 75 feet from wetlands, 25 feet more than the setback required pursuant to Section 275-3(D)(1)(a)(5). B) Mitigation measures 1) The existing nonconforming septic system, which is located approximately 80 feet from the surface waters of Great Peconic Bay, will be replaced with a low-nitrogen, innovative/alternative sanitary system(UA OWTS) located at least 100 feet from both surface waters and the vegetated wetland to the north. Unlike conventional septic systems, the UA OWTS is designed to significantly reduce nitrogen loading into the groundwater table and ultimately surface waters. And the site conditions here are perfectly suited for the proper functioning of the proposed leachate absorption field because the geotextile sand filter system, once installed, requires an undisturbed sandy cover which a) allows evapotranspiration and oxygen exchange for better effluent treatment; and b) can be inhabited by native grasses with extensive root systems that inhibit erosion but do not grow deeply or densely enough to clog and inhibit the functioning of the system. Thus, an approximately 6,205 sf portion of naturally vegetated grassland to the west of the dwelling will be temporarily disturbed/cleared to enable installation of the absorption field and subsequently restored and replanted with native grasses to be left undisturbed. 2) A drainage system consisting of leaders, gutters, and drywells will be installed to collect and recharge roof runoff and pool backwash. 3) The proposed driveway and parking areas will be comprised of pervious gravel surfaces. 4) A project limiting fence will be installed to contain site disturbance and potential surface runoff during construction. In early March, based on guidance provided by the Building Department, we submitted a revised site plan prepared by Jeffrey T. Butler, P.E., P.C., dated October 24, 2019, along with a revised project description. Of course, due to the closure of Town Hall and cancellation of all Trustee meetings since March, the application has not yet been noticed or heard by the Boar#, However, as both the New York State Department of Environmental Conservation and ffolk County Department of Health Services have been reviewing the applications submittod to those agencies, further changes have been made to the site plan in response to their co ents, as summarized below: 1) The proposed sanitary system design has been modifi , and the future expansion units are now to be installed at the same time as the prim system during construction, which will eliminate the potential need for re-di Bing a site in the future. As a result, the area of temporary disturbance associated ith a system installation, which is to be subsequently restored with native planting , as increased by 421 sf from 6,205 sf to ' 6,626 sf. However, all proposed sanitary sy em components will remain more than 100 feet from all wetlands. 2) The previously proposed drainage system consisting of d ells ocated less than 75 feet from wetlands has been replaced with a system of leac ' c hers located more than 75 feet from wetlands. As a result, an approximately 618 ea on the east side of the property will be temporarily disturbed and restored with ve plantings. 3) As a result of the design changes, the propose vol e of clean sandy fill required for re- - grading has been decreased from 365 to 116 cu ' yards.
