POLICY: At the beginning of scheduled Town Board meetings, the attending public is
encouraged to briefly address the Town Board relating to agenda resolutions prior to their
enactment; the public will also be given time at the conclusion of the regularly scheduled
business agenda to address the Board on any given topic.
ONLINE ACCESS: The Tentative Agenda is generally available the Friday before the meeting.
The video of the meeting is usually available to watch live during the meeting. Minutes with
adopted resolutions are available 1-2 days after the meeting. A full copy of the minutes, agenda
and meeting video can be viewed by going to the official Town of Southold website:
www.southoldtownny.gov and following either of the following:
(1) Move pointer over “Government” on the Town website home page. You will find the title

Due to public health and safety concerns related to COVID-19, the Public will not be given
in-person access. In accordance with the Governor’s Executive Order 202.1, said public
hearing of the Town Board will be held via videoconferencing, and a transcript will be
provided at a later date. The public will have an opportunity to see and hear the meeting
live and provide comments virtually.
The hearing will be held virtually via ZOOM Webinar. Instructions and link to attend the
meeting will be available on the Town’s website or by calling the Town Clerk’s office at
(631)765-1800. A telephone number will also be provided to allow members of the public to
attend via telephone.

markers and instructional floats that are lost during the season, at a rate of $99.00 per

PH 6/1 4:30 - McCall Dev Rights Easement Acquisition
RESOLVED that pursuant to the provisions of Chapter 17 (Community Preservation Fund) and
Chapter 70 (Agricultural Lands) of the Town Code, the Town Board of the Town of Southold
hereby sets Tuesday, June 1, 2021, at 4:30 p.m., Southold Town Hall, 53095 Main Road,
Southold, New York as the time and place for a public hearing for the purchase of a
development rights easement on property owned by Walker/McCall, LLC and McCall
Family Holdings Limited Partnership LLLP. Said property is identified as SCTM #1000-
116.-1-10. The address is 21657 Main Road (NYS Route 25) in Cutchogue. The property is
located in the Agricultural-Conservation (A-C) Zoning District and is situated on the southerly
side of Main Road (NYS Route 25) approximately 1063 feet easterly from the intersection of
Locust Avenue and Main Road (NYS Route 25). The proposed acquisition is for a development
rights easement on a parcel consisting of approximately 7.78± acres. In conjunction with the
purchase of the development rights easement, an adjacent parcel known as 21380 NYS Route 25,
Cutchogue, NY and designated as SCTM #1000-109.-1-37 will be subject to a Declaration of
Covenants & Restrictions, including a requirement that the parcel remain permanently attached
to the farm. Upon closing, the Declaration of Covenants & Restrictions will be recorded
simultaneously with the Development Rights Easement.
The exact area of the acquisition is subject to a Town-provided survey acceptable to the Land
Preservation Committee and the property owner. Community Preservation Funds will be used to
acquire the easement plus acquisition costs. The purchase price is $65,000.00 (sixty-five
thousand dollars) per buildable acre, estimated at $505,700 (five hundred five thousand seven
hundred dollars) for the 7.78± acre easement. Purchase price will be adjusted at time of closing
based on final survey acreage determination, plus acquisition costs. The landowner has offered to
sell the development rights to the Town at a purchase price below the fair market value indicated

in the Town’s commissioned appraisal and the landowner may be eligible to claim a bargain sale.
The property is listed on the Town’s Community Preservation Project Plan as property that
should be preserved due to its agricultural value.
FURTHER NOTICE is hereby given that a more detailed description of the above mentioned
parcel of land is on file in Land Preservation Department, Southold Town Hall Annex, 54375
Route 25, Southold, New York, and may be examined by any interested person during business
hours.

THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE COUNTY OF
SUFFOLK, NEW YORK, HEREBY RESOLVES (by the favorable vote of not less than two-
thirds of all the members of said Town Board) AS FOLLOWS:
Section 1. The Town of Southold, in the County of Suffolk, New York (herein
called the “Town”), is hereby authorized to acquire computer hardware and software for use by
the Town. The estimated maximum cost thereof, including preliminary costs and costs
incidental thereto and the financing thereof, is $250,500 and said amount is hereby appropriated
for such purpose. The plan of financing includes the issuance of bonds in the principal amount
of $250,500 to finance said appropriation and the levy and collection of taxes on all the taxable
real property in the Town to pay the principal of said bonds and the interest thereon as the same
shall become due and payable.

Section 2. Bonds of the Town in the principal amount of $250,500 are hereby
authorized to be issued pursuant to the provisions of the Local Finance Law, constituting Chapter
33-a of the Consolidated Laws of the State of New York (referred to herein as the “Law”), to
finance said appropriation.
Section 3. The following additional matters are hereby determined and declared:
(a) The period of probable usefulness applicable to the object or purpose for
which said bonds are authorized to be issued, within the limitations of Section 11.00 a. 108 of the
Law, is five (5) years.
(b) The proceeds of the bonds herein authorized and any bond anticipation
notes issued in anticipation of said bonds may be applied to reimburse the Town for expenditures
made after the effective date of this resolution for the purpose for which said bonds are
authorized. The foregoing statement of intent with respect to reimbursement is made in
conformity with Treasury Regulation Section 1.150-2 of the United States Treasury Department.
(c) The proposed maturity of the bonds authorized by this resolution will not
exceed five years.
Section 4. Each of the bonds authorized by this resolution and any bond
anticipation notes issued in anticipation of the sale of said bonds shall contain the recital of
validity as prescribed by Section 52.00 of the Law and said bonds and any notes issued in
anticipation of said bonds shall be general obligations of the Town, payable as to both principal
and interest by a general tax upon all the taxable real property within the Town. The faith and
credit of the Town are hereby irrevocably pledged to the punctual payment of the principal of
and interest on said bonds and any notes issued in anticipation of the sale of said bonds, and
provision shall be made annually in the budget of the Town by appropriation for (a) the
amortization and redemption of the bonds and any notes in anticipation thereof to mature in such
year and (b) the payment of interest to be due and payable in such year.
Section 5. Subject to the provisions of this resolution and of the Law and
pursuant to the provisions of Section 21.00 of the Law relative to the authorization of the
issuance of bonds with substantially level or declining annual debt service, Section 30.00 relative
to the authorization of the issuance of bond anticipation notes and Section 50.00 and Sections
56.00 to 60.00 and 168.00 of the Law, the powers and duties of the Town Board relative to
authorizing bond anticipation notes and prescribing the terms, form and contents and as to the
sale and issuance of the bonds herein authorized, and of any bond anticipation notes issued in
anticipation of said bonds, and the renewals of said bond anticipation notes, and as to executing
contracts for credit enhancements and providing for substantially level or declining annual debt
service, are hereby delegated to the Supervisor, the chief fiscal officer of the Town.
Section 6. The validity of the bonds authorized by this resolution, and of any
notes issued in anticipation of the sale of said bonds, may be contested only if:
(a) such obligations are authorized for an object or purpose for which the
Town is not authorized to expend money, or

Southold, in the County of Suffolk, New York, adopted a bond resolution entitled:
“Bond Resolution of the Town of Southold, New York,
adopted May 18, 2021, authorizing the construction of
improvements to the Town boat ramp, stating the estimated
maximum cost thereof is $200,000, appropriating said amount

principal amount of $200,000 to finance said appropriation, and the levy and collection of taxes
on all the taxable real property in the Town to pay the principal of said bonds and the interest
thereon;
SECOND: AUTHORIZING the issuance of bonds in the principal amount of
$200,000 pursuant to the Local Finance Law of the State of New York to finance said
appropriation;
THIRD: DETERMINING and STATING that the period of probable usefulness
applicable to the object or purpose for which said bonds are authorized to be issued is thirty (30)
years; the proceeds of said bonds and any bond anticipation notes issued in anticipation thereof
may be applied to reimburse the Town for expenditures made after the effective date of this bond

resolution for the purposes for which said bonds are authorized; and the proposed maturity of
said bonds will exceed five (5) years;
FOURTH: DETERMINING that said bonds and any bond anticipation notes

general obligations of the Town; and PLEDGING to their payment the faith and credit of the
Town;
FIFTH: DELEGATING to the Supervisor the powers and duties as to the
issuance of said bonds and any bond anticipation notes issued in anticipation of said bonds, or
the renewals thereof; and
SIXTH: DETERMINING that the bond resolution is subject to a permissive
referendum.

WHEREAS, the County of Suffolk and each of the ten Suffolk County Towns are in a State of
Emergency with the entire State of New York as declared by the Governor as of March 7, 2020,
due to COVID-19; and
WHEREAS, in light of the foregoing, the Town of Southold, the Supervisor, the Board of
Assessors and the legal representatives of the Town recognize the need to reduce expenses, to
conserve resources and to maintain some type of “social distancing” into the future. Therefore,
there is a need to make certain changes to the current procedure for service upon the Town of a
Small Claims Assessment Review (SCAR) petition(s) judicially challenging the assessment of
real property as authorized under Article 7 of the Real Property Tax Law. Changes to the current
service of process would not only limit the personal contact between the public and assessment
staff, but also greatly reduce the already limited resources of the town reviewing and processing
the grievance complaints filed each year; and
WHEREAS, the filing period for such petitions is imminent and the adoption of an E-Filing
system is in the best interest of both Petitioners and the Town; and
WHEREAS, the use of a uniform E-Filing system for filing a SCAR petition(s) upon the Town is
currently provided for by the Real Property Tax Law §104(1)(c) and the proposed uniform E-
Filing system provides Complainants with the same protections they currently enjoy; and
WHEREAS, the adoption of a uniform E-Filing system is not intended to replace a Petitioner’s
ability to file a SCAR petition in accordance with the current statutory and regulatory framework
but rather it is to be an alternative thereto; and
WHEREAS, the Procedures and Protocols will be located at:

adequately address the concerns of the Petitioner and the Town; and

A. No person shall double-park a vehicle on any Town highway or roadway.
B. No person shall park a vehicle in whole or part on a sidewalk located adjacent to a highway.
C. No vehicle shall be parked upon any public highway or roadway without first being
registered and inspected pursuant to the Vehicle and Traffic Law of the State of New York.
D. On a one-way roadway, vehicles shall be parked facing in the direction of authorized traffic
movement; on a two-way roadway, such motor vehicle shall be facing in the direction of
authorized traffic movement on that portion of the roadway on which the vehicle rests.
E. No person shall park a vehicle so as to obstruct any driveway except with express
permission of the owner.
F. In an established or designated parking area, a vehicle is to be wholly within the markings
or signage where established or designated lines and markings are indicated.
G. The stopping, standing or parking of vehicles in any location designated as a crosswalk or
pedestrian crossing is hereby prohibited.
§ 260-27 Pedestrian Crosswalks
A. Purpose. The Town Board of the Town of Southold finds that, with the increasing
development and population of the Town of Southold, transportation activities are
increasing and impacting the local streets. Regulation of pedestrian traffic on local streets is
necessary so as to provide for the safety and welfare of the Town's citizens and for the
orderly flow of vehicular and pedestrian traffic on busy local streets.
B. There shall be a pedestrian crosswalks at the following locations:

§ 260-27 § 260-28 Penalties for offenses.
A. Every person convicted of a traffic infraction for a violation of any provision of this chapter,
which is not a violation of any provision of the Vehicle and Traffic Law of the State of New
York, and said traffic infraction is not covered by Subsection B below, shall, for a first
conviction thereof, be punished by a fine not to exceed $110 or by imprisonment for not
more than 15 days, or by both such fine and imprisonment.
III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.

Local Law entitled, “A Local Law in relation to an Amendment to Chapter 280, Zoning”
reads as follows:
LOCAL LAW NO. 2021
A Local Law entitled, “A Local Law in relation to an Amendment to Chapter 280, Zoning”.
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose.
The purpose of this local law is to address issues concerning accessory recreational uses.
II. Chapter 280 of the Code of the Town of Southold is hereby amended to include the
underlined words as follows:
§ 280-13 Use regulations.
In A-C, R-80, R-120, R-200 and R-400 Districts, no building or premises shall be used and no
building or part of a building shall be erected or altered which is arranged, intended or designed
to be used, in whole or in part, for any uses except the following:
C. Accessory uses, limited to the following uses and subject to the conditions listed in § 280-
15 herein:
(15) Recreational uses.
A. Permitted recreational uses include, but are not limited to, uses such as tennis
courts; pickleball courts; volleyball courts; paddleball courts; basketball courts;
shuffleboard courts; playgrounds; jogging; hiking; outdoor ice skating rinks; outdoor
skateboard/roller skate facilities; football, baseball, soccer playing fields, and the like,
provided the following criteria are met:
(1) the use is accessory to a community center or other not-for-profit use;
(2) the recreational use is located on, or within 200 feet of, the parcel with the
principle use;
(3) the use shall be for the use of the general public;
(4) the subject property on which the recreational use is to be located must be
owned by a community center or similar not-for-profit corporation, or subject
to a lease by the community center or not-for-profit corporation for a period of
not less than 10 years;
(5) the recreational use shall be subject to special exception approval by the
Zoning Board of Appeals;
(6) the following activities are prohibited:
a. private events, leagues, private clubs, organization activities or other

uses which exclude participation by the general public
b. the charging of a fee for use of the facility
c. Retail sales, including the sale of food
d. Outdoor lighting

III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect after filing with the Secretary of State as provided by law.

WHEREAS, there has been presented to the Town Board of the Town of Southold, Suffolk

vehicles on certain Town roads; and
WHEREAS, it has been presented a Local Law entitled “A Local Law in relation to an
Amendment to Chapter 260, Vehicles and Traffic, in connection with Traffic and

WHEREAS that the Town Board of the Town of Southold held a public hearing on the
aforesaid Local Law at which time all interested persons were given an opportunity to be heard,
be it
RESOLVED that the Town Board of the Town of Southold hereby ENACTS the proposed
Local Law entitled, “A Local Law in relation to an Amendment to Chapter 260, Vehicles
and Traffic, in connection with Traffic and Pedestrian Safety” reads as follows:
LOCAL LAW NO. 2021
A Local Law entitled, “A Local Law in relation to an Amendment to Chapter 260, Vehicles
and Traffic, in connection with Traffic and Pedestrian Safety”.
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose.
The purpose of this local law is to improve safety for pedestrians and vehicles, as well as
dealing with impacts to the public’s health, safety and welfare.
II. Chapter 260 of the Code of the Town of Southold is hereby amended by removing the
struck through portions and adding the underlined portions as follows:
Article IV Truck Vehicle Traffic
§ 260-26 Restricted truck vehicle traffic.
A. Purpose. The Town Board of the Town of Southold finds that, with the increasing
development and population of the Town of Southold, transportation activities are
increasing and impacting the local streets. Regulation of truck vehicle usage on local
streets is necessary so as to provide for the safety and welfare of the Town's citizens and
for the orderly flow of vehicular and pedestrian traffic on busy local streets. There are
numerous other alternate local streets linking state and highways in the area.
B. Vehicles, trucks, tractors, tractor-trailer combinations, tractor-semitrailer combinations
or tractor-trailer-semitrailer combinations in excess of a registered weight of 10,000
8,000 pounds are prohibited from traveling upon the following streets. Such exclusion
shall not be construed to prevent the delivery or pickup of merchandise or other property
along the streets from which such vehicles or combinations are otherwise excluded:
