Main Rd. &Youngs Ave.) C/) ,c r G Q Telephone: 631 765-1938 " Southold, NY 11.971 � • �O P Q Fax: 631 765-3136 01 Fax: LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Michael Domino, President Town of Southold Board of Trustees From: Mark Terry, AICP LWRP Coordinator Date: January 3, 2019 Re: LWRP Coastal Consistency Review GOLDSMITHS BOAT SHOP 'SCTM# 1000-56-7-1 Suffolk Environmental Consulting, Inc. on behalf of GOLDSMITHS BOAT SHOP requests a Wetland Permit to construct ±465.0 linear feet of bulkhead located on the southeast seaward corner of the subject property comprised of a ±350 linear foot long easterly section, a ±90 linear foot long southerly section, and a ±25 linear foot long return; the northerly terminus of the proposed bulkhead will connect into the southerly terminus of the existing bulkhead which ends at the shared easterly property boundary; the proposed bulkhead is to consist of vinyl sheathing (C-LOC or similar), two (2) tiers of timber walers (6"x6") along the seaward face, two (2) tiers of timber clamps (6"x6") along the landward face, a timber cap (2"x18"), secured by timber pilings (10" diameter) along the seaward face of the bulkhead, connected to a backing system via tie-rod comprised of lay-logs (10" diameter), and deadmen (10 diameter); existing rip-rap along the shoreline is to be removed prior to the installation of the proposed bulkheading; backfill is proposed along the landward sections of the proposed bulkhead in order to maintain safe and practical passage for vehicular traffic within the boat yard; the amount of fill is ±1,200 cubic yards of clean fill obtained from an approved upland source. Located: 64150 Route 25, Southold. SCTM# 1000-56-7-1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon'the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the LWRP policies provided that the Board determines that: 1. The existing rip-rap is not functioning to control erosion. Rip-rap provides beneficial habitat to marine and intertidal species and minimizes scouring. Bulkheads provide minimal habitat. 2. The use of vegetative, non-structural measures will not sufficiently protect the shoreline. 3. The enhancement of the existing rip-rap by increasing the protective capacity of natural protective features using practical vegetative measures would not be effective in controlling erosion. ' LWRP policy 4.1.D supports the installation of hard structural measures in the Peconic Bay only where: 1. Avoidance of the hazard is not appropriate because a structure is functionally dependent on a location on or in coastal waters; located in an area of extensive public investment; or reinforces the role of Maritime Centers or Areas for Concentrated Development. Goldsmith Boat Shop (Marina) is a Maritime Center and water dependent. 2. Vegetative approaches to controlling erosion are not effective. See above. To be determined by the Board. 3. Enhancement of natural protective features would not prove practical in providing erosion protection. To be determined by the Board. 4. Construction of a hard structure is the only practical design consideration and is essential to protecting the principal use. There are alternatives available. To be determined by the Board. 5. The proposed hard structural erosion protection measures are: r a. limited to the minimum scale necessary b. based on sound engineering practices If approved, the bulkhead design would stabilize a channel and protect property. To be determined by the Board. 6. Practical vegetative methods have been included in the project design and implementation. Vegetative methods are not included within the design. 7.- Adequate mitigation- is provided and maintained to ensure that there- is no .—._.__._.—_._._.._—._____--_—_adverse-impact.-tomadjace- 't property_or toy.naturalsoastal._pr_oaesse.s_and_natural resources and, if undertaken by a private property owner, does not incur significant direct or indirect public costs. I approved, turbidity controls are recommended. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C,the preparer of this form should review the exempt minor action list,policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area(which includes all of Southold Town). 3. If any question in Section C on this form is answered"yes",then the proposed action may affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus,the action should be analyzed in more detail and, if necessary, modified prior to making a determination that it is consistent to the maximum extent practicable with the LWRP policy standards and conditions. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken.
